You have proposed to install two new Sirius XM dual -band panel antennas and one RX high -band dish on an existing monopole. Additional ground equipment will be added to a new concrete pad within the existing fenced lease area. Your application is hereby approved per the findings noted below. Be advised, work cannot begin until you receive an electrical permit. FINDINGS OF FACT 1. The applicant proposes to add two new Sirius XM panel antennas and one new RX dish on an existing 150-foot monopole located behind the building at 30933 Pacific Highway South in Federal Way. The monopole was originally approved by King County, prior to the incorporation of Federal Way. Associated ground equipment will be added to new concrete pad within an existing lease fenced area on the above -referenced property. 2. No material change or expansions are proposed to the existing leased equipment enclosure and therefore, zoning review of such improvements are exempt pursuant to Federal Way Revised Code (FWRC) 19.255.010(3)(g). The applicant proposes to locate the Personal Wireless Service Facility (PWSF) on "Existing broadcast, relay and transmission towers," which is the second priority location of the five prescribed in FWRC 19.255.010(4). A higher prioritized location ("structures located in the BPA trail") is not feasible as there are no alternative BPA towers in the proposed vicinity. Staff finds the applicant has met the burden to utilize the second prioritized location. The antenna proposed should provide the full benefit of service to the area. 4. No height increase of the existing monopole is proposed with the new PWSF. 5. The city must consider the cumulative visual effects of PWSFs mounted on existing structures in determining whether additional permits may be granted so as to not adversely affect the visual character of the city. As shown on the site plan and elevation drawings, the new antennas and equipment placement are not a substantial increase to the existing site. The PWSF will not adversely affect the visual character of the city. Mr. Daniel Baum May 21, 2013 Page 2 CONCLUSIONS OF LAW 1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in FWRC 19.255.010(3), "Exceptions." 2. Process II "Site Plan Review" is the appropriate Master Land Use application as the proposal is for a new PWSF collocated on an existing monopole. Per FWRC 19.220.120, "Personal Wireless Service Facility," Process H is required when the PWSF is located within 300 feet of a residential zone or ch 1gftwds a Multi -Family Residential (RM1800) zone to the south, within 300. feet of the r. subj Atv 3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(25)(ii); PWSFs attached to an existing structure that is not a residence or school, and located in a commercial zone. 4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Community Business (BC). Pursuant to FWRC 19.220.120, PWSFs are a permitted use in BC zones. 5. The proposed improvements meet Process II site plan criteria set forth in FWRC 19.60.050 and FWRC Chapter 19.255, "Personal Wireless Service Facilities." 6. Electrical permit approval is required prior to constructing the improvements. APPEALS The effective date of this decision is May 24, 2013. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by June 7, 2013. Any appeal must be in the form of a letter delivered to the department with the established fee. As the applicant is the only person of record, you may waive your right to appeal in writing to the assigned planner below. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
