IN CONSIDERATION OF the approved City of Federal Way ("City") building permit for
application No. 14-102699-MF relating to real property legally described as:
Legal description of property attached hereto as Exhibit "A" and incorporated
herein by reference, in King County, Washington, and portions of vacated streets
adjoining ("Property"),
the undersigned as Grantor(s) declares that the above described Property, is hereby subject to a
perpetual easement for a natural or constructed to water conveyance system ("System") and
hereby dedicates, covenants, and agrees as follows:
1. City shall have the right to ingress and egress over the Property to access such easement
area for inspection of and to reasonably monitor the System for performance, operational
flows or defects in accordance with City's Surface Water Management Divisions
procedures.
2. if City determines that maintenance or repair work is required to be done to the System,
the Manager of the Surface Water Management Division of the Department of Public
Works ("Manager"') shall give notice of the specific maintenance and/or repair required.
The Manager shall also set a reasonable time in which such work must be completed by
the Grantor, its heirs, successors or assigns. If the above required maintenance and/or
repair is not completed within the time set by the Manager, the City may perform the
required maintenance and/or repair. Written notice will be sent to the Grantor stating the
City's intention to perform such maintenance. Maintenance work will not commence until
at least seven (7) days after such notice is mailed. If, within the sole discretion of the

be waived and maintenance and/or repair work will begin immediately.
3. If at any time the City reasonably determines that any existing retention/detention system
creates any conditions detrimental to the receiving surface water system, public and/or
private property, the Manager may take any measures pursuant to Federal Way ReviseO
Code.
4. The Grantor shall assume all responsibility for the cost of any maintenance and for repai
to the System. Such responsibility shall include reimbursement to the City within thi
(30) days of the receipt of the invoice for any such work performed. Overdue paymenj
will require payment of interest at the current legal rate as liquidated damages. If le,

action ensues, the prevailing party is entitled to costs and/or fees.
5. The Grantor is hereby required to obtain written approval from the Manager prior
filling, piping, cutting, or removing vegetation (except in routine landscape maintenanc:
in open vegetated drainage facilities (such as swales, channels, ditches, ponds, etc.),
performing any alterations or modifications to the drainage facilities contained with

Property as described previously. Any notice or consent required to be given or otherwi
provided for by the provisions of this Declaration of Covenant shall be effective up

personal delivery, or three (3) days after mailing by Certified Mail, return rece I L

f. Grantor agrees to indemnify, defend, and hold City, its elected officials, officerli
employees, agents, and volunteers harmless from any and all claims, demands, losse
actions and liabilities (including costs and all attorney fees) to or by any'and all persons"
entities, including, without limitation, their respective agents, licensees, or representative
arising from, resulting from, or connected with this Declaration of Covenant except to
extent caused by the sole negligence of the City. I
This covenant is intended to protect the value and desirability of the Property, and shall inure
to benefit all of the citizens of City of Federal Way, and shall run with the land, and shall touch
and concern the land, and shall be binding on all heirs, successors, and assigns.

Your recent request to further reduce the traffic impact fee is hereby denied. City staff, following FWR[19.91.
have already reduced the standard Multi -Family L4partmenMtraffic impact fee by37Y6 consistent with Multi -Family
(Mid -Rise) in the ITE Trip Generation Manual. Traffic Division staff feel that this is a generous but accurate reduction
given the characteristics of the site. We will consider future requests that follow the prescribed process in FWRC
19.91.070(B) requiring a trip generation study of 3 or more similar sites conducted by a licensed traffic engineer. Also
see code sections [andD;subnnitdngthestudydoesnotnecessari|yguaranteethatyourinopactfeem/i||befurther
reduced, and may indicate that a greater fee should be required. The City will also charge for the review of such a study.

MSC and the design team believe that the above traffic mitigation scenario more accurately reflects the
actual nature of the project and the resulting traffic trips and or needs of the project.
* Typically for homeless type projects, the number of residents that actually have cars is 25%. So 44 units @ 25%

* The residents are typically un-employed — 75%. So no day trips to jobs, etc. this would can a trip rate of 25%
of units.
* The project intends to provide a project based van for the residents. This would be utilized for getting the vets to
VA appointments, recreational outings shopping outings, etc.
* The project is on the rapid line for Sound transit, with a high frequency of buses per hour. The project will also
provide the residents with bus passes as part of the supportive service program.
* Approximately 10 of the spaces will be for staff use for providing the supportive services. The fee range for this
