On December 2, 2005, the City of Federal Way's Department of Community Development Services received your • onal Wireless Service Fa6i1itj,4LWSQ on an existin,,i monopo e, behind the building. at 30933 Pacific Highway South in Federal Way. The parcel number is 0821 04-9064. The zone is Community Business (BC). -A Verizon PWSF already exists at the top of the pole. The monopole was originally approved by King County, prior to the incorporation of Federal Way. The proposal calls for four new antennas (.35.8" x 5.5" x 4.7), including three now and one in the future, a Base Transceiver Station (BTS) unit (17' x 11 " x 5"), and a Global Positioning System (GPS) antenna (6.12" by 5") to be placed at approximately 136 feet above the ground on an existing 154-foot-high monopole on private property. The proposal includes an equipment cabinet (50" tall by 42" wide) to be 1!.Iaced within the existing compound. Pursuant to Federal Way City Code (FWCC) Article IV, ','Process I = Director's Approvdl," your proposal is found to be consistent with the provisions of Chapter 22 — Zoning. Your Process I proposal is hereby conditionally approved. iNmulri' It relating to this site. Final construction drawings (if required)' will be reviewed for compliance with specific regulations and other applicable City requirements. J Al April 25, 2006 Page 2 1, Within six months after the issuance of its operation permit, the applicant shall submit a project implementation report which provides cumulative field measurements of radio frequency (EW) power densities of all antennas installed at the subject site. Also, the applicant shall ensure that the PWSF will not cause localized interference with the reception of area television or radio broadcasts or the functioning of other electronic devices. 2. A permit for a PWSF shall expire ten years after the effective date of the permit approval. Renewals will be considered. 4. Work on the project may not commence until all of the following have occurred: the City provides a written authorization to proceed with construction, the appeal deadline has passed, and payment is made on any outstanding fees. 5. To assure compliance with the approved final plans, the applicant shall also contact the Planning Division of the Department of Community Development Services for a final inspection of the new antennas. At that time, the applicant shall submit an affidavit to the Planning Division that verifies that the'PWSF has been installed in accordance with the approved plans. Zoning, Land. Use, and Review Process. The zoning for the proposed site is BC (Commercial Business). PWSFs are permitted in the BC zone pursuant to FWCC Section 22-762. Per this chart the re�ejuired review for a cmtscleldpi new PW`SF at this site would be Process -I . Vote 2 e-, , ' the PWSF is located within 300 feet of a residential zone; however, the site is already developed, so we would refer to FWCC Section 22-32.2: "Review processes for improvements and additions to developed sites." Process I applies to this application. For a Process I land use review the Director of Community Development Services makes a decision based on criteria listed under FWCC Article' IV.B. (Section 22-35 1, et seq.). The particular criteria for PWSFs (FWCC Sections 22-966 through 22-975) are addressed below. 2. State Environmental Policy Act (SEPA). The project is exempt from SEPA review, since it meets the categorical exemption as described in the Washington Administrative Code (WAQ 197-11 - 800(25)(a)(ii), in that your proposal is for personal wireless service antennas "to be attached to an existing structure (that may be an existing tower) that is not a residence or school, and the existing structure to which it is to be attached is located in a commercial zone." Standardsfor Electronic Equipment Enclosures, FWCC Section 22-967(5). 'Mere are four priorities listed, pertaining to enclosures. The Code states, "In proposing an equipment enclosure in a particular location, the applicant shall analyze the feasibility of locating the proposed equipment encl6su'r­'e­­'fiI each of the higher priority locations and document, to the City's satisfaction, why locating the equipment enclosure in each higber1priority locati . • is not •` proposed." The plans show that Clearwire's equipment shelter is within the allowable dimensions of "priority c." The equipment is to be placed in the existing enclosed compound. T Security Fencing, FWCC 22-967(7). The proposal will utilize the existing security fencing around the existing compound. 8. Cumulative Effect. Pursuant to FWCC Section 22-967(8), the City shall consider the cumulative visual effects of PWSFs mounted on existing structures and/or located on a given permitted site in determining whether additional permits may be granted so as to not adversely affect the visual character of the City. The applicant has submitted photo simulations showing that the additional permits may be granted with no adverse impact to the City. FWCC Section 22-971 requires a signed statement indicating that the applicant agrees to allow for the potential collocation of additional PWSF equipment by other providerson the applicant's structure or within the same site location, as part of the permit application. This does not apply to the proposal, since the existing structure is owned by an entity other than the applicant. 11. EMF Standards and Interference., FWCC Section 22-972 states that within six months after the issuance of its operation permit, the applicant shall submit a project implementation report which provides cumulative field measurements of radio frequency CENT) power densities of all antennas installed at the subject site. However, I do not see a letter that provides the new project description; nor it I see a project description on the set of plans. We need a specific project description along the lines of the following, both on the plans, and on your letter of application: "The proposal is for the collocation of a PWSF 'on an existing monopole, including four panel antennas, which measure _ by _ (three to be installed now and one in the future), four microwave dishes, which measure by one GPS antenna, and an above -ground equipment enclosure, which measures _ by to be placed within the existing compound." Please show on the plans where the future, fourth antenna is to be placed. V The plans (elevation view) do not correspond to the photo -simulations. Please remedy this situation. Also, please show the entire array of panels and dishes (as they will appear) on the plans. 3. You have not provided the following, which was requested in the last letter. Please provide photographs looking out to the "viewshed" in all four cardinal directions. For exarnple, stand along the street and take a pictur e toward the east, and then take pictures toward the north, south, and west, as far as possible toward the horizon. You may have to take the pictures from slightly different locations in order to see past buildings and such. Please provide these photographs on standard size paper. Since Clearwire does not have the right to deal with the property owner (R.S.T. Enterprises), American Tower Company has the rights in the contract from the property owner to sub -lease the property for any future co-loc tens. The redacted lease will clear up any confusion on the city❑s part and will prove Clearwire has the owner❑s consent from the lease they have signed with ATC (not ATS). When you have the opportunity if it❑s possible to happen in normal business hours today (don❑t want to you work longer on this fine Friday, if it❑s Monday that is fine) could you please respond? Specifically the letter asks for three (3) full size drawings, and three (3) 11 x17 drawings as well as three (3) photo -simulations. I know you have specifically asked for certain submittal sets that differ from what the literature has stated in the past, just want to make sure I get you what you want. SEEM= WA TAC 161 A UE�r Clearwire LLC intends to construct and operate a wireless broadband service in the FCC licensed services known as the Broadband Radio Service "BRS" and Educational Broadband Service ("EBS'). These services operate in the 2500-2690 MHz band and Clearwire LLC will either own or lease aportion of this spectrum in the Federal Way area. In addition, Clearwire LLC will utilize at some base station sites point- to- point microwave to backhaul data to the central office or POP location. These point to point links will operate in both licensed and unlicensed bands allocated by the FCC for these services. All of the equipment utilized by Clearwire LLC has received FCC type acceptance approval and therefore meets all requirements for operation within the appropriate bands. Clearwire will install base station sites that will typically have omnidirectional coverage created by the use of 3 to 4 directional antennas on a lower or rooftop. These sites will typically be separated by 2 to 4 miles. This separation distance can vary significantly depending on terrain, ground clutter (foliage, buildings, etc.) and the available structure heights in the desired coverage area. The technology used by Clearwire to deliver the broadband service to consumers is manufactured ba non -line -of -sight ("NLOS'9 technology and uses a multi -carrier OFDM modulation scheme. OFDM technology allows subscriber units to be placed de the home or office. However, NLOS operation also requires the Clearwire system design incorporate sufficient margins in the RF link budget to accommodate the wide variation in path attenuation. Path attenuation in a NLOS application at 2500MM is vety dependent on the budOig material, thickness, orientation and other characteristics. In ad"n, another characteristic of the OFDM system is the need to use morefrequencies in the cell layout Therefore, the spacing of cells and the orientation of the antennas becomes very critical in the overall system design.
