Dear Mr. Foy:
The City has completed a land use "Process I" Administrative Review of your proposal. On December 2,
2005, the City of Federal Way's Department of Community Development Services received your
• onal Wireless Service Fa6i1itj,4LWSQ on an existin,,i monopo e, behind the
building. at 30933 Pacific Highway South in Federal Way. The parcel number is 0821 04-9064. The zone
is Community Business (BC). -A Verizon PWSF already exists at the top of the pole. The monopole was
originally approved by King County, prior to the incorporation of Federal Way.
The proposal calls for four new antennas (.35.8" x 5.5" x 4.7), including three now and one in the future,
a Base Transceiver Station (BTS) unit (17' x 11 " x 5"), and a Global Positioning System (GPS) antenna
(6.12" by 5") to be placed at approximately 136 feet above the ground on an existing 154-foot-high
monopole on private property. The proposal includes an equipment cabinet (50" tall by 42" wide) to be

Pursuant to Federal Way City Code (FWCC) Article IV, ','Process I = Director's Approvdl," your
proposal is found to be consistent with the provisions of Chapter 22 — Zoning. Your Process I
proposal is hereby conditionally approved.

1, Within six months after the issuance of its operation permit, the applicant shall submit a project
implementation report which provides cumulative field measurements of radio frequency (EW)
power densities of all antennas installed at the subject site. Also, the applicant shall ensure that the
PWSF will not cause localized interference with the reception of area television or radio broadcasts
or the functioning of other electronic devices.
2. A permit for a PWSF shall expire ten years after the effective date of the permit approval. Renewals
will be considered.
4. Work on the project may not commence until all of the following have occurred: the City provides a
written authorization to proceed with construction, the appeal deadline has passed, and payment is
made on any outstanding fees.
5. To assure compliance with the approved final plans, the applicant shall also contact the Planning
Division of the Department of Community Development Services for a final inspection of the new
antennas. At that time, the applicant shall submit an affidavit to the Planning Division that verifies
that the'PWSF has been installed in accordance with the approved plans.
Zoning, Land. Use, and Review Process. The zoning for the proposed site is BC (Commercial
Business). PWSFs are permitted in the BC zone pursuant to FWCC Section 22-762. Per this chart
the re�ejuired review for a cmtscleldpi new PW`SF at this site would be Process -I . Vote 2 e-, , '
the PWSF is located within 300 feet of a residential zone; however, the site is already developed, so
we would refer to FWCC Section 22-32.2: "Review processes for improvements and additions to
developed sites." Process I applies to this application. For a Process I land use review the Director of
Community Development Services makes a decision based on criteria listed under FWCC Article'
IV.B. (Section 22-35 1, et seq.). The particular criteria for PWSFs (FWCC Sections 22-966 through
22-975) are addressed below.
2. State Environmental Policy Act (SEPA). The project is exempt from SEPA review, since it meets the
categorical exemption as described in the Washington Administrative Code (WAQ 197-11 -
800(25)(a)(ii), in that your proposal is for personal wireless service antennas "to be attached to an
existing structure (that may be an existing tower) that is not a residence or school, and the existing
structure to which it is to be attached is located in a commercial zone."

6. Standardsfor Electronic Equipment Enclosures, FWCC Section 22-967(5). 'Mere are four priorities
listed, pertaining to enclosures. The Code states, "In proposing an equipment enclosure in a
particular location, the applicant shall analyze the feasibility of locating the proposed equipment
encl6su'r'e'fiI each of the higher priority locations and document, to the City's satisfaction, why
locating the equipment enclosure in each higber1priority locati . • is not •` proposed." The

including areas for maintenance or future expansion." The plans show that Clearwire's equipment
shelter is within the allowable dimensions of "priority c." The equipment is to be placed in the
existing enclosed compound.
T Security Fencing, FWCC 22-967(7). The proposal will utilize the existing security fencing around
the existing compound.
8. Cumulative Effect. Pursuant to FWCC Section 22-967(8), the City shall consider the cumulative
visual effects of PWSFs mounted on existing structures and/or located on a given permitted site in
determining whether additional permits may be granted so as to not adversely affect the visual
character of the City. The applicant has submitted photo simulations showing that the additional
permits may be granted with no adverse impact to the City. The proposed antennas are smaller than
the existing antennas, and do • greatly alter the appearance •. the tower.
9. Application Requirements. Pursuant to FWCC Section 22-970, the required materials have been

10. Collocation * . FWCC Section 22-971 requires a signed statement indicating that the applicant agrees
to allow for the potential collocation of additional PWSF equipment by other providerson the
applicant's structure or within the same site location, as part of the permit application. This does not
apply to the proposal, since the existing structure is owned by an entity other than the applicant.
11. EMF Standards and Interference., FWCC Section 22-972 states that within six months after the
issuance of its operation permit, the applicant shall submit a project implementation report which
provides cumulative field measurements of radio frequency CENT) power densities of all antennas
installed at the subject site. Also, the applicant shall ensure that the PWSF will not cause localized

American Personal Wireless Service Facility (PWSF) on December 2, 2005. We then received additional
information on December 16, 2005, and December 30, 2005. After I informed you that the photo -
simulations did not correspond to the plans, you informed me, on January 11, 2006, that the proposal
would be changing. On January 18, 2006, we received a resubmittal.
I have reviewed the items you resubmitted, as well as the items in the file that were previously submitted.

I The proposal is for collocation of a PWSF on an existing monopole with an above -ground
equipment cabinet inside the existing compound. However, I do not see a letter that provides the new
project description; nor it I see a project description on the set of plans. We need a specific project
description along the lines of the following, both on the plans, and on your letter of application: "The
proposal is for the collocation of a PWSF 'on an existing monopole, including four panel antennas,
which measure _ by _ (three to be installed now and one in the future), four microwave
dishes, which measure by one GPS antenna, and an above -ground equipment enclosure,
which measures _ by to be placed within the existing compound." Please show on the
plans where the future, fourth antenna is to be placed.
V The plans (elevation view) do not correspond to the photo -simulations. Please remedy this situation.
Also, please show the entire array of panels and dishes (as they will appear) on the plans.
3. You have not provided the following, which was requested in the last letter. Please provide

the street and take a pictur e toward the east, and then take pictures toward the north, south, and west,
as far as possible toward the horizon. You may have to take the pictures from slightly different

simulations. (3) Clearwire has taken ❑viewshed❑ photos from all four cardinal directions, and last but not least
(4) 1 have obtained a redacted lease showing lease terms. Since Clearwire does not have the right to deal with
the property owner (R.S.T. Enterprises), American Tower Company has the rights in the contract from the
property owner to sub -lease the property for any future co-loc tens. The redacted lease will clear up any
confusion on the city❑s part and will prove Clearwire has the owner❑s consent from the lease they have signed
with ATC (not ATS).
When you have the opportunity if it❑s possible to happen in normal business hours today (don❑t want to you
work longer on this fine Friday, if it❑s Monday that is fine) could you please respond? Specifically the letter asks
for three (3) full size drawings, and three (3) 11 x17 drawings as well as three (3) photo -simulations. I know you
have specifically asked for certain submittal sets that differ from what the literature has stated in the past, just
want to make sure I get you what you want.

chain link construction or similar but comparable construction shall be placed
around the perimeter of the Property (not including the access easement).
TENANT will maintain the property in a reasonable condition. It is under-
stood and agreed that TENAMT"S ability to use the Property is contingent upon
its obtaining after the execution date of this Agreement all of the
certificates, permits and other approvals that may be require� by any Federal,
State or Local authorities. LESSOR SHALL cooperate with TENANT in its effort
to obtain such approvals and shall take no action which would adversely affect
the status of the Property with respect to the proposed use thereof by TENANT.
In the event that any of �uch applications should be finally rejected or any
certificate, permit, license or approval issued to TENANT is canceIled°
expires, lapses, or is otherwise withdrawn or terminated by governmental
authority so that TENANT in its sole discretion will be unable to use the
Propezty for its intended purposes, TENANT shall have the right to terminate
this Agreement. Notice of the TENANT'S exercise of its right to terminate
shall I be given to LESSOR in writing by certified mail, return receipt
requested, and shall be effective upon receipt of such notice by the LESSOR as
evidenced by the return receipt. All rentals paid for the lease of the

which are directly attributable to the improvements constructed thereon by

11. TENANT, upon termination of the Agreement, shall, within a
reasonable period, remove its personal property and fixtures and restore the
Property to its original canditon, reasonable wear and, Lear excepted. If such

this Agreement, TENANT shell pay rent at the then existing monthly rate or on
the existing monthly pro-rata basis if booed upon o longer payment term, until
such time as the removal of personal property and fixtures, which are called
for within this Agreement, are completed.

One entry door of steel construction 3'-6" wide by
61-0" high shall be provided. Three-phase electrical
service with 220 volt 300 amp capacity shall be brought
into the building but no electrical panel other than
a master disconnect breaker shall be provided. Lessor
shall be responsible for roof maintenance and exterior
maintenance except that portion of building enclosed
by the chain link fence.
Tenant will provide at its own expense, internal elec-
trical service, heating, airconditioning, lighting, interior
finish, chain link fence and any other appurtenances as necessai
for Tenant's operation. Tenant shall be responsible
for interior maintenance and maintenance of the yard
area enclosed by the chain link fence shown on Exhibit "A"
attached. Lessor hereby gives Tenant authorization to
proceed with Tenant improvements specified above.
Upon Lessor's receipt of Tenant's notice exercising the
option provided for herein, Lessor shall diligently
proceed to construct the "Building Shell" and will com-
plete construction of same within 120 days of Tenant's
exercise of said option, strikes and other circumstances
beyond Lessor's control excepted.

A. This Amendment pertains to that certain Option and Lease Agreement dated February
16, 1982, together with all exhibits, amendments and addenda thereto (collectively, the
"Agreement") for the lease of certain premises ("Premises") located at 30837 Pacific Highway
South, City of Federal Way, State of Washington, on property legally described as set forth on
Exhibit A to the Agreement.
B. R.S.T. Enterprises, Inc. is successor -in -interest to Federal Way Disposal, Inc.
C. Seattle SSA Limited Partnership d/b/a Verizon Wireless is successor -in -interest
to Chicago Title Insurance, Company.
D. The Parties acknowledge that a Memorandum of Sublease was recorded on
January 19, 2000, in connection with Tenant's use of the Premises upon the tower currently operated
by American 'Power Corporation; and that Lessor's consent has been obtained for the sublease
contemplated therein,
E. The Parties wish to amend the Agreement to extend the term, increase the rent
and amend certain other provisions of the Agreement.
NOW, THEREFORE, in consideration of the foregoing and mutual covenants herein
contained, and other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, it is hereby agreed as follows:

7. Environmental. Tenant shall not transport, use, store, maintain, generate, handle,
dispose, release or discharge any Hazardous Materials (as defined below) in, upon or about the
Lessor's Property or pen -nit Tenant's employees, agents or contractors to engage in such activities in,
upon or about Tenant's Premises, except in compliance with laws. Lessor acknowledges and agrees
that Tenant's operation may include the use of batteries, fuel -powered generators and de mini is
quantities of cleaning materials and solvents commonly used in telecommunications facilities. The
term "Hazardous Material" for purposes hereof shall mean any chemical, substance, material or
waste component thereof which is now or hereafter listed, defined, or regulated as a hazardous or
toxic chemical, substance material or waste or component thereof by any federal, state or local
governing or regulatory body having jurisdiction, or which would trigger any employee or
community "right -to -know" requirements adopted by any such body, or for which any such body has
adopted any requirements for the preparation or distribution of any material safety data sheet. If any
Hazardous Material is released, discharged or disposed of by Tenant or its employees, agents or
contractors on or about Lessor's Property in violation of the foregoing provisions, Tenant shall
immediately, properly, and in compliance with all applicable laws, clean up and remove the
Hazardous Material from Lessor's Property and any other affected property and. clean or replace any
affected personal property (whether or not owned by Lessor) at Tenant's expense. Such cleanup and
removal work shall be subject to Lessor's prior written approval and implementation of any remedial
action plan required by any go verrunental body having jurisdiction or reasonably required by Lessor.
Should lessor suspect that Hazardous Materials have been released, discharged or disposed of by
Tenant or its employees, agents or contractors in violation of the foregoing provisions, Lessor shall
have the right to test for same and if Lessor reasonably confirms such release, disposal or discharge
by Tenant or its agents, employees or contractors, Tenant shall pay the cost of such testing Mi
addition to the foregoing.
8. Agiampvt_ The following provision shall be substituted for in its entirety and
replace the provision in Paragraph 17 of the Agreement:
The Agreement may be sold, assigned or transferred by Tenant without any approval or
consent of Lessor to Tenant's principal, affiliates, subsidiaries of its principal; to any entity
which acquires all or substantially all of Tenant's assets in the market defined by the Federal
Communications Commission in which the Premises is located by reason of a merger,
acquisition or other business reorganization; or to any entity which acquires or receives an
into i-est in the majority of communication towers of Tenant in the market defined by the
Federal Communications Commission in which the Premises is located. As to other parties,
the Agreement may not be sold, assigned or transferred without the written consent of Lessor,
which such consent will not be unreasonably withheld or delayed. Effective as of the date of
this Amendment, Tenant may sublet the Premises without the conse of Lessor ssor provided that

permitting times), and has chosen American Tower Company because of coverage objectives.

Clearwire LLC intends to construct and operate a wireless broadband service in the FCC
licensed services known as the Broadband Radio Service "BRS" and Educational Broadband Service
("EBS'). These services operate in the 2500-2690 MHz band and Clearwire LLC will either own or
lease aportion of this spectrum in the Federal Way area. In addition, Clearwire LLC will utilize at
some base station sites point- to- point microwave to backhaul data to the central office or POP location.
These point to point links will operate in both licensed and unlicensed bands allocated by the FCC for
these services. All of the equipment utilized by Clearwire LLC has received FCC type acceptance
approval and therefore meets all requirements for operation within the appropriate bands.
Clearwire will install base station sites that will typically have omnidirectional coverage created
by the use of 3 to 4 directional antennas on a lower or rooftop. These sites will typically be separated by
2 to 4 miles. This separation distance can vary significantly depending on terrain, ground clutter
(foliage, buildings, etc.) and the available structure heights in the desired coverage area.
The technology used by Clearwire to deliver the broadband service to consumers is
manufactured ba non -line -of -sight ("NLOS'9 technology and
uses a multi -carrier OFDM modulation scheme. OFDM technology allows subscriber units to be placed
de the home or office. However, NLOS operation also requires the Clearwire system design
incorporate sufficient margins in the RF link budget to accommodate the wide variation in path
attenuation. Path attenuation in a NLOS application at 2500MM is vety dependent on the budOig
material, thickness, orientation and other characteristics. In ad"n, another characteristic of the
OFDM system is the need to use morefrequencies in the cell layout Therefore, the spacing of cells and
the orientation of the antennas becomes very critical in the overall system design.
