The Process I MLU application is hereby approved pursuant to conclusions based on findings made by the department's Planning Division. CONCLUSIONS Various sections of the Zoning and Development Code indicate that certain developments, activities, or murwz —Based on the findinp_'s below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal Way Revised Code (FWRC) 19.15.03 0(l) and 19.5 5.020: I . The proposed improvements are not exempt from Use Process review as they do not meet Criteria set forth in FWRC 19.15.020 — Exceptions. f. The proposed improvements are consistent with applicable chapters of F)VRC Title 19 including Z:0 but not limited to: Permits and Review Processes; Process I — Director's Approval; Community Design Guidelines; and City Center Core (CC-C). 3. The health, safety, and welfare of the citizens of the city are preserved. 4. The proposed improvements are exempt from State Environmental Policy -4ct review as the scope of work meets categorical exemption WAC 197-11-800(3) repair, remodeling, and maintenance activity. FINDINGS OF FACT I Proposal — The applicant proposes to upgrade the exterior fagade of the existing building by altering 0 0 the existing sloped roof to a flat fagade for the portion of the building that will be leased by the applicant. The fagade will be covered by corrugated metal, with signs mounted onto the new building fagade. 2. Comprehensive Plan & Zoning Designation — The zoning and comprehensive plan designation for the subject property is City Center Core (CC-C) zoning district. The properby's proposed use of an Mr. Phillips April 22,2015 Page 2 electronics retail store is a permitted use pursuant to FWRC 19.225.020 and does not constitute a change of use. 3. Nonconformance — Fagade improvements do not involve a change of use, new floors, or enlargement of existing building footprint, abandonment, the cessation of use for more than one year, and alterations are less than 50 percent of the assessed value of the existing improvement. Therefore, improvements do not trigger nonconforming development compliance requirements s forth in FWRC 19.3 0.090. 4. Height — The height of the tallest roofline is approx. 21 feet, which is below the 70-foot height maximum. Proposed exterior fagade treatment provides greater articulation to the west and south elevations that are visible fi-om the public right-of-way.
