The City's Planning Division has completed an administrative land use review of the proposed Personal
Wireless Service Facility (PWSF) panel antenna placement on an existing PWSF monopole located at 30833
Pacific Highway South. The Comprehensive Plan and zoning designation for the subject property is
Community Business (BC). The subject property's PWSF use is permitted pursuant to Federal Way City
Code (FWCC) § 22-762. The Process I application was submitted and determined to be complete on
February 27, 2009. The Department of Community Development Services hereby approves the Process I
application.
Land Use Review — According to submitted materials, the applicant proposes to replace seven existing
panel antennas with similar antennas, add one additional equipment cabinet to be placed inside an
existing equipment shelter, and add one additional panel antenna on the east elevation of the monopole.
City staff has indicated prior to the submittal that the replacement of seven panel antennas and additional
equipment cabinet sheltered from view qualifies as "routine maintenance and repair" and is exempt from
PWSF development standards per FWCC 22-966(c)(6). However, the addition of one panel antenna does
require a Process I Master Land Use Application pursuant to FWCC review processes for improvements
and additions to developed sites.
2. Prioritized Locations — The proposed antenna will be located on an existing 154-foot PWSF monopole
originally granted land use approval prior to the 1990 incorporation of the City of Federal Way. The
project applicant has proposed the antenna placement in priority location (2) Existing broadcast, relay
and transmission towers as the intent is to bolster coverage for that particular PWSF location; therefore,
placing the proposed antenna in priority location (1) Structures located in the BP,4 trail is not feasible.
3. Development Standards — The proposed PWSF panel antenna's size and visual characteristics are simil
to the existing/replacement antennas attached to the monopole, thereby reducing aesthetic impacts to
surrounding land uses. The proposed antenna will extend foux feet above the existing monopole and wi
be placed on the east elevation. I

5. Additional Permits — The City's Building Official has indicated an electrical permit will be required. No
building permits are required for this proposal.
f. Process I 7hresholds — The proposed improvements do not reduce required parking, landscaping,
buffering, open space, or public areas; do not change the location of utilities or easements; and create n*
impacts to sensitive areas or significant trees.
ELECTROMAGNETIC FIELD STANDARDS (EMF) AND PERMIT LIMITATIONS
Withm* six months of the approval date, the applicant is required to submit a project implementation report
that provides cumulative field measurements of radio frequency (ENT) power densities of the newly

APPEALS
The effective date of this decision is March 20, 2009, or three days from the date of this letter. Pursuant to
FWCC Section 22-355, any person who received notice of this administrative decision may appeal the
decision to the Federal Way Hearing Examiner by April 3, 2009. Any appeal must be in the form of a letter
delivered to the Department of Community Development Services with the established fee. The appeal letter
must contain a clear reference to the matter being appealed and a statement of the alleged errors in the
Director's decision, including the identification of specific findings and conclusions made by the Director
disputed by the person filing the appeal. No work on the proposal can commence until the end of the appeal
period.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and

Verizon Wireless (hereafter referred to as "Verizon") is a wireless telephone company operating
throughout Washington. Verizon is a public utility licensed to operate in Washington by the Federal
Communications Commission (FCC). It is Verizon's desire to work with the City of Federal Way to
ensure that this project is consistent with local ordinances and zoning regulation while providing
facilities for communication services.
VeriZon is requesting approval to modify an existing personal wireless communication facility.
Verizon's proposed modifications consist of replacing seven (7) existing panel antennas with seven
(7) new panel antennas and add one (1) new panel antenna to an existing monopole located at 30833
Pacific Highway South. One (1) additional equipment cabinet win be located inside the existing
building.
Radio Frequency Engineers (RF) determined that the proposed modifications will result in better
coverage and allow for expanded services to be offered to customers in the Federal Way area
surrounding the facility.

The site is classified CommunityBusiness (13C). Personal Wireless Service Facilities are an allowed
use in the BC zone per the Federal Way City Code. According to correspondence with the Federal
Way Planning Department, a Process 1 review is required to modify the site and detertnille if City
code requirements are met and if the proposal will result in a more adverse visual impact.
Accordingly, a Process 1 application is submitted.
According to FWCC Section 22-762 Personal wireless service faCilit�y in the BC zone:
Setbacks:
1. For developed sites, the setback requirements shall be those of the principal use of the
subject property. For undeveloped sites, the setback requirements for new freestanding
PWSFs shall be 20 ft. for front, side, and rear yards.

Not applicable as Verizon is not proposing any ground disturbance.
Review Process:
2. Subject to meeting all applicable development standards, the review process used shall
be process I, except for the following proposals:
a. Process III for the following proposals:
(1) The PNXTSF is located within 300 ft. of a residential zone; provided the PV7SF
is less than 15 ft. above the building or structure, plus any height granted under 5 22-
967 (2) (b);
Verizon is not proposing a new PWSF, but is proposing to modify an existing site, the location of
which was approved in the original applications for the facility.
Height
3. Maximum allowed height for a new freestanding PWSF shall be the minimum
necessary to provide the service up to 100 ft., plus any height granted under § 22-1047. A
PWSF shall be allowed up to 120 ft. if there are two or more providers; except that a
lattice tower of between 120 ft. to 150 ft. will be allowed under a combined application of
four or more providers.
Verizon modification of the existing PWSF will not result in increased heights of ATerizon's antennas
or the existing monopole.
Landscaping
4All PWSF shall be landscaped and screened in accordance N';'rith Article XVII of this
chapter and the provisions of the PWSF development regulations. At a minimum, a five
ft. type III landscaping area shall be required around the facility, unless the community
development services director determines that the farijir)T is adequately screened.
Verizon is not proposing to expand the existing ground equipment area, nor remove existing mature
trees or landscaping, not remove existing fence. No new landscaping is proposed.
Development Standards
5. New freestanding PWSFs are allowed subject to height limits and collocation
provisions. PWSFs are allowed on existing towers, on private buildings and structures, on
publicly used structures not located in public rights -of -way, on existing structures located
in the BPA trail, and on existing structures in appropriate public rights -of -way. Refer to
22-967 for development standards applicable to allowed types of PWSFs.

The following development standards shall be followed in the design, siting, and
construction of a personal -,%ireless service facility:
(1) Building- or structure -mounted PWSFs not located in the public right-of-way.
PWSFs mounted on existing buildings and structures not located in a public right-of-
way shall conform to the following development standards:

The PA7SF shall consist only of the following types of facilities:
1. A microcell or a minor facility,- or
Z A PWSF that exceeds the minor facility thresholds for number of
antennas, dimensions, and/or area, but creates no more adverse impacts
than a ininor facility, as determined by the director of community,
development services, subject to meeting all of the follo-wing standards:
i, The facility shall not create substantially more adverse visual
impact than a minor facility; and
iL The equipment cabinet for the PWSF shall meet all requirements
of subsection (5) of this section; and
ir. The maximum size of the PWSF panels and number of antennas
shall be determined by the director of community development
services, based on the specific project location, surrounding
environment, and potential visual impacts; and
iv, The PWSF shall comply with all other applicable standards of the
Federal Way City, Code.
Verizon's proposed replacement antennas do not meet the defir-rition of a or facility, however, as
this is a modification project primarily consisting of replacement of existing equipment, the project
will not result in an increase of visual impact. The replacement antennas and additional antennas are
to be mounted on the same mount at one hundred and fifty four feet above ground. The proposal
will not alter the existing visual impact of the facility. The ground equipment meets the requirement
of subsection 5 and the project otherwise complies with all applicable standards.
b. The combined antennas and supporting structure may extend up to, but not
exceed, 15 feet above the existing or proposed roof or other structure
regardless of whether, the existing structure is in conformance with the
existing maximum height of the underlying zone as outlined in the use zone
charts, Article XI of this chapter, District Regulations. Antennas may be
mounted to rooftop appurtenances provided they do not extend beyond 15
feet above the roof proper.
c. The antennas are mounted on the building orstructure such that they are
located and designed to minimize visual and aesthetic impacts to surrounding
land uses and structures and shall, to the greatest extent practical, blend into
the existing environment pursuant to subsection (4) of this section. Panel and
parabolic antennas shall be screened from residential views and public right-
o f--way unless meeting the provision of F\K7CC 22-960(b)(2).
The antennas do not extend more than fifteen feet over the height of the support structure. The
existing monopole is one hundred fifty four feet tall; Verizon's antennas will be attached at the same
level as they are currently, with a tip height of one hundred fifty-eight feet.
(2) PWSFs located on structures within appropriate public rights -of -way......
Not applicable as Verizon's proposal is not located in the public right-of-way.

Not applicable to this project.
(4) Screening standards for all PWSFs. PWSFs shall be screened or camouflaged through
employing the best available technology and design, as determined by the city. This may
be accomplished by use of compatible materials, location, landscaping, color, stealth
techniques such as, but not limited to, artificial trees and hollow flag poles, and/or other
methods or techniques to achieve minimum visibility of the facility as -viewed from public
streets or residential properties. In addition, the provisions for landscaping as outlined in
the use zone charts, Article XI of this chapter, District Regulations, shall apply.
No changes to the existing mature screening trees and landscaping are proposed. Additional
equipment will be located inside the building. Antennas will be located on the same mounts as the
existing antennas and visual chance will be minimal if any change at all. Antennas are gray which
matches existing site conditions.
(5) Standards for electronics equipment enclosures.
There is an existing aboveground completely enclosed building in which existing equipment is
located. Verizon proposes to add one equipment cabinet inside the existing building. There Nvill be
no visual change or increase in noise as the cabinet will be located within the building.
(7) Security fencing.
No changes proposed to the existing six feet tall security fence.
(8) Cumulative effects. The city ,,hall consider the cunnilarive visual effects of P\N,'SF,,
mounted on exi-sting structures and, located on a pc given

whether additional permits may be granted
so as to not -adversely effect the visual character of the city.
(9) Signage. No wireless equipment shall be used for the purpose of mounting signs or
message displays of any kind, except for small signs used for identification and name of
provider.
(10) Use zone charts, height and permit process.
a. The final approval authority for applications made under this section shall be defined
by the appropriate permit process as outlined in the use zone charts, Article XI of this
chapter, District Regulations.
b. Allowed heights shall be established relative to appropriate process as outlined in the
use zone charts, Article XI of this chapter, District Regulations.
No changes are proposed to existing identification signage. No new signage proposed.

According to Reiised Code of Washington (RCV/) 43.21C.0384:
(1) Decisions pertaining to applications to site personal wireless service facilities are not
subject to the requirements of RCW 43.21C.030(2)(c), if those facilities meet the
following requirements:
(a)(i) The facility to be sited is -a lanicrocell and is to be attached to an existing structure
that is not a residence or school and does not contain a residence or a school; or (ii) the
facility includes personal wireless service antennas, other than a rnicrocell, and is to be
attached to an existing structure (that ma3, be an existing tower) that is not a residence or
school and does not contain a residence or a school, and the existing structure to which it
is to be attached is located in a commercial, industrial, manufacturing, forest, or
agricultural zone; or (iii) the siting project involves constructing a personal wireless
service tower less than sixty feet in height that is located in a commercial, industrial,
manufacturing, forest, or agricultural zone; and
(b) The project is not in a designated environmentally sensitive area; and
(c) The project does not consist of a series of actions: (i) Some of which are not
categorically exempt; or (ii) that together may have a probable significant adverse
environmental impact.
(2) The department of ecology shall adopt rules to create a categorical exemption for
microcells and other personal wireless service facilities that meet the conditions set forth
in subsection (1) of this section...
"Microcell" means a wireless communication facility consisting of an antenna that is
either: (i) Four feet in height and with an area of not more than five hundred eighty
square inches; or (ii) if a tubular antenna, no more than four inches in diameter and no
more than six feet in length.
Verizon's proposed antenna attachment is categorically exempt from SEPA review, The proposed
antennas are not microcells but are to be attached to an existing monopole structure that is not a
residence or school and does not contain a residence or school the proposal and is located iii a
commercial zone.
The proposed project is consistent with existing uses in the neighborhood and has been designed to
minimize visual impacts, The proposal complies with all applicable code requirements.

This AMENDMENT TO Option and Least U Amendmenf') is made this

Partnership d/b/a Verizon Wireless, ��� and R.S.T. Enterprises, Inc., as "Lessor." The
Lessor and Tenant are at times collectively referred to hereinafter as the "'Parties" or individually as
the "Parly'.

A. This Amendment pertains to that certain Option and Lease Agreement dated February
16, 1982 ' together with all exhibits, amendments and addenda thereto (collectively, the
"Agreement") for the lease of certain premises ("Premises") located at 30837 Pacific Highway
South, City of Federal Way, State of Washington, on property legally described as set forth on
Exhibit A to the Agreement.
B. R.S.T. Enterprises, Inc. is successor -in -interest to Federal Way Disposal, Inc.
C. Seattle SMSA Limited Partnership dfb/a Verizon Wireless is successor -in -interest
to Chicago Title Insurance Company.
D. The Parties acknowledge that a Memorandum of Sublease was recorded on
1wvHwp-L9,-20D0_. in connection with Tenant's use of the Premises upon the tower currently operated
by American Tower Corporation; and that Lessor's consent has been obtained for the sublease
contemplated therein.
E. The Parties wish to amend the Agreement to extend the term, increase the rent
and amend certain other provisions of the Agreement.
NOW, THEREFORE, in consideration of the foregoing and mutual covenants herein

Should Lessor suspect that Hazardous Materials have been released, discharged or disposed of by
Tenant or its employees, agents or contractors in violation of the foregoing provisions, Lessor shall
have the right to test for same and if Lessor reasonably confirms such release, disposal or discharge
by Tenant or its agents, employees or contractors, Tenant shall pay the cost of such testing in
addition to the foregoing.

Communications Commission in which the Premises is located by reason of a merger,
acquisition or other business reorganization; or to any entity which acquires or receives an
interest in the majority of communication towers of Tenant in the market defined by the
Federal Communications Commission in which the Premises is located. As to other parties,

Collocation Fee for each applicable Subtenant, defined as any future third -party subtenant
