RE: Request for Minor Modification ooExisting Wireless Facility CFRg1.4n00%("§ 09"
Site Address: 30911 Pacific PrrCase Nm/ Highway --'----'``~/'~°°'=ww
APN: 0821045024
Sprint Project No.: SE52X[G4/Mirror Lake Tac161
Dear City ofFederal Way, Department ofCommunity Development:
On behalf of Sprint, we are pleased to submit this request to for the proposed modification Wireless Communication Facility (OWCF") at the location referenced above, as an Eligible Facilities Request for a
to Sphnt'sexisbng
minor modification under Section 6409.
Applicable Law
In 2013 Congress passed the Middle Class Tax Relief and Job Creation Act ofZU13 47 U.S.C.
On October 17, 2014, the Federal Communications Commission adopted FCC Order 14-153 to help define the
"substantially change language of Section 6409(a). This Order was released to the public on October 21, 2014. It
contained the following pertinent section (Section 188) dealing with modifications to approved cell towers:
... a modification substantially changes the physkal dimensions of a tower or base station if it meets any of
thefollowing criteria:
md7
the structure more than six feet;
(3) it involves installation of more than the standard number of new equipment cabinets for the technology
involved, but not to exceed four cabinets;
(4) it entails any excavation or deployment outside the current site of the tower or base station;
(5) it would defeat the existing concealment elements of the tower or base station; or
(6) it does not comply with conditions associated with the prior approval of construction or modification of
the tower or base station unless the non-compliance is due to an increase in height, increase in width,
addition of cabinets, or new excavation that does not exceed the corresponding "substantial change"
thresholds identified above.
Sprint proposes to modify the existing WCF by removing the existing antennas mounted internally at the 144' RAD
height, and replacing with new antennas and associated equipment mounted externally at the 144' RAD height, as
further detailed and set forth within the previously submitted construction drawings prepared, signed, and sealed
on April 13, 2018 by State of Washington professional engineer Bret A. Mccomb ("CDs"). As the CDs demonstrate,
none of the aforementioned criteria apply to the proposed modification.
Specifically, the proposal:
(1) Does not increase the height of the WCF;
(2) Does not protrude more from the edge of the WCF by more than twenty (20) feet
(3) Does not involve installing new equipment cabinets at the site;
(4) Does not involve any excavation or deployment outside the site;
(5) Is consistent with the currently existing concealment elements of the WCF; and
(6) Complies with all associated conditions of prior approval
Conclusion
Federal law prohibits the City of Federal Way from exercising municipal discretionary review of Sprints Building
Permit application because it is an "eligible facilities request" that "does not substantially change" the physical
dimensions of the existing WCF. As such, we request the City of Federal Way approval of the project as required
under Section 6409(a).
Sincerely,
Lorelei Foronda, Land Use

rights with respect to the use and further sublicense of the communication tower and site ("Tower Site")
under the Agreement are subleased from AirTouch Communications, Inc. and/or its Affiliates
("AirTouch") and are subject to a sublease agreement (as amended from time to time) ("AirTouch
Sublease) between Licensor and AirTouch, pursuant to which Licensor subleases a portion of the Tower

to obtain Licensee's agreement to the following provisions, which provisions may not be superseded,
altered or amended by the Agreement (including any conflicting or inconsistent provisions in the
Agreement) or any attachment, exhibit, amendment, supplement, schedule, or other written instrument
associated with the Tower Site or the Agreement:
