The trash enclosure and required screening shall be constructed per the approved red lined building permit drawings. PROCEDURAL INFORMATION The effective date of this decision is June 14, 1999. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services (33530 First Way South, Federal Way, WA, 98003) by June 28, 1999, by any person who receives a copy of this decision. Unless modified or appealed, this site plan approval is valid for a period of one year from the effective date of this decision. If no further action is taken within one year, the decision will expire. The applicant has proposed to remodel and do site improvements at 28815 Military Road South. The existing building is currently vacant and has been vacant for over one year. 2. Zoning for the subject site is Neighborhood Business (BN). This zoning district permits restaurant uses pursuant to Federal Way City Code (FWCC) Section 22-722. The proposal is subject to the Process II, Site Plan Approval, as it does not meet the land use process exemptions under FWCC Section 22-32. 3. The proposed remodel is exempt from SEPA.review pursuant Washington Administrative Code (WAC) 197-11-800, Categorical Exemptions, as there is no change of use associated with the project. 4. The proposal has been reviewed for consistency with all applicable zoning regulations including FWCC Section 722 (Neighborhood Business, Restaurant); FWCC Article V, Site Plan Review; FWCC Article IV, Nonconformance; FWCC Article XVII, Landscaping; and Article XIX, Community Design Guidelines. Nonconformance — The proposal does not include any change of use or increase in gross floor area. Per the cost estimate submitted by the applicant, the cost of the proposed improvements, other than tenant improvement and normal maintenance, do not exceed 50 percent of the assessed value of the existing improvements on the site. The subject site was previously occupied by Pizza Hut, a restaurant, but currently the site has been vacant for over one year. Per FWCC Section 22-334(5), if the use conducted on the subject site has ceased for more than one year, the applicant shall repair and/or restore the improvements on the site (e.g. drainage, landscaping, curbing, parking, parking lot landscaping, etc.) to a condition as near as physically possible to the condition required by the requirements of approval of the existing development. The proposal includes upgrading perimeter landscaping, interior parking lot landscaping, closing the north driveway, and making the building American Disability Act (ADA) accessible. 6. Landscaping — The applicant has proposed to install five feet Type III landscaping along the north, south, and west property line. Street trees are proposed along the east side and north property lines. The current proposal to install vegetation in addition to the existing vegetation meets the current FWCC perimeter landscaping requirements on all sides except the east side. On the east side, street trees are proposed, and since the proposal does not exceed any other nonconformance thresholds except that the landscaping needs to be restored to a condition as was originally approved for the site, no additional landscaping is required on the east side. Interior parking lot landscaping meets the minimum FWCC requirement of 20 square feet of landscaping per parking stall. Overgrown facade landscaping is proposed to be removed and scaled down. 7. The Public Works Department reviewed the application and required the existing northern driveway on Military Road South to be closed as it is only 90 feet to the signalized intersection at South 288th Street, is not safe, and does not meet city code requirements. Also, the two parking stalls next to the southern driveway on Military Road South are required to be removed to provide a minimum throat length of 25 feet at the driveway exit. The Public Works Department also reviewed the project for consistency with applicable water quality conformance requirements and determined that the proposal does not trigger water quality requirements as there is no increase in gross floor area. 8. Right-of-way modification request was granted by the Director of Public Works on May 27, 1999. Per the right-of-way modification approval letter, the following are required for right- of-way improvements: a) The developer shall install street trees and street lighting behind the existing sidewalk on both Military Road South and South 288th Street. Construction drawings will need to be prepared and approved prior to issuance of a building permit. b) A four foot wide strip of property must be dedicated to the city for right-of-way along South 288th Street prior to issuance of a building permit. c) The developer shall sign a "No Protest Local Improvement District Waiver" prior to issuance of a building permit. 9. The proposal has been found to meet applicable Community Design Guidelines, as it includes pedestrian corridors from the building to the right-of-way, building placement adjacent to the right-of-way, and fenestration and facade treatment. 10. The proposed location of the trash enclosure shall be moved north so that it is not located in the required ten foot setback from the south property line. The screening of the trash enclosure as proposed meets the FWCC Section 22-949 requirements of 100 percent sight obscuring screening, including vegetative screening. The proposed screening shall be adjusted when the proposed location of the enclosure is moved north so that it is adjacent to the trash enclosure. Pursuant to FWCC Section 22-394(b), and the forgoing findings, the proposal is found to be consistent with the Federal Way Comprehensive Plan; all applicable provisions of the FWCC; and with the public health, safety, and welfare, provided that the stated condition of approval is met. Final construction drawings will be reviewed for compliance with specific regulations, conditions of approval, and other applicable city requirements. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. After evaluating the existing conditions along Military Road South and South 288' Street, review of Federal Way City Code (FWCC) provisions (Sections 22-1496, 22-1477), and the direction provided by the City Council, the Public Works Department hereby determines the following requirements for street improvements to be applicable to the development of the property. FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to modify, defer, or waive the required street improvements only after consideration of the following four specific criteria. These criteria were reviewed to determine their application with respect to this request. (1) "Improvement as required would not be harmonious with existing street improvements" Right-of-way and pavement widths are adequate at this time. However, the City Comprehensive Transportation Plan requires a six foot wide planter strip next to the curb and an 8' wide sidewalk on both Military Road S. and S. 288`h Street. The Safeway store on the southeast comer of this intersection has recently been required to install similar improvements as part of a remodel proposal. Therefore these projects will be consistent and harmonious. (2)"Unusual topographic or physical conditions preclude the construction of the improvements as required" As the modification request letter states, the site slopes up from Military Road S. Due to the location of the existing building, the developer will likely need to build a three to four foot high retaining wall along the property frontage on Military Road S. to accommodate the required frontage improvements. In addition, two power poles are located approximately 10' behind the curb, in the center of the new sidewalk location. A signal pole on the corner is located 7' behind the curb, on the edge of the new sidewalk location. On S. 288' Street, two power poles are located approximately 8' behind the curb, again within the new sidewalk location. Utility vaults are underground, however lids -will need to be adjusted to the new sidewalk grade. A crosswalk signal is located-7' behind the curb, within the new sidewalk location. Topography is not an issue on S. 288' Street. While none of these physical constraints individually would preclude construction, in combination they do add substantially to the amount of work and cost required for the project. For a project of this nature, which is not an expansion of the existing building or a change in use, it is appropriate to consider alternatives that will reduce the amount of construction while also improving conditions within the neighborhood. The developer has agreed to close the northernmost driveway on Military Road S., a significant improvement to traffic safety at this intersection. This will include replacement of approximately 28' of curb and sidewalk. The most appropriate alternative for sidewalk - and planter strip is to leave the existing sidewalk in place and require the developer to install street trees and street lights behind the sidewalk. A four foot wide strip of right- of-way on S. 288' Street will need to be dedicated. (3)"Proper vertical or horizontal alignments cannot be determined because the existing streets do not have correct alignment" Existing streets in this area are correctly aligned. This criteria does not apply. (4) "The required improvement is part of a larger project that has been scheduled for construction in the City's Transportation Improvement Program." The City's Transportation Improvements Program does not currently identify Military Road S. or S. 2881 Street as scheduled improvement projects. The criteria does not apply to this project. In summary, as a part 9f this site redevelopment, the developer will be required to dedicate four feet of right of way along S. 2881 Street frontage, and install street lights and street trees on both Military Road S. and S. 288' Street frontages. Street lighting shall be installed at appropriate intervals and shall meet City design standards. Mounting street lights on existing power poles will not be accepted. Additionally, the property owner shall execute a "No Protest Local Improvement District Waiver", prior to issuance of a building permit. The City will prepare this form for the owner's signature and will record it with King County Records and Electiions. The property owner shall pay all applicable recording fees. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Plans for fire apparatus access roads shall be submitted to the fire department for review and approval prior to construction. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 20 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de- sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 12 percent. [K.C.F.D. #39 Administrative Policy Guideline No. 1006] Designated fire lanes may be required for emergency access. This may be done during the plans check or after the facility is in operation. 1 When required, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction by parking and other obstructions. Fire apparatus access road gates shall comply with K.C.F.D. #39 Administrative Policy Guideline No. 1003 (copy attached). Fire apparatus access roads shall be installed and made serviceable PRIOR to and during the time of construction. FIRE -EXTINGUISHING SYSTEMS Plans and specifications for automatic fire -extinguishing systems for the protection of commercial -type cooking equipment shall be submitted to the fire department for review and approval prior to installation. The automatic fire -suppression system shall be connected to the fire alarm system (last zone) in all buildings having an automatic fire detection system. PORTABLE FIRE EXTINGUISHERS Portable fire extinguishers shall be installed in accordance with Uniform Fire Code Standard 10-1. FIRE DEPARTMENT ACCESS TO BUILDINGS Exterior doors and openings required by the Uniform Fire Code or the Uniform Building Code shall be maintained readily accessible for emergency access by the Fire Department. An approved access walkway leading from fire apparatus access roads to exterior openings required by the Uniform Fire Code and/or the Uniform Building Code shall be provided when required by the Chief. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Numbers shall contrast with their background. Numbers shall be a minimum of six (6") inches in height. When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for life-saving or firefighting purposes, 2 the chief is authorized to require a key box to be installed in an accessible location. The key box shall be of a type approved by the chief and shall contain keys to gain necessary access. Additionally, the remodel will include some site revisions as, required by the City of Federal Way. The reason for our request is because we feel it is redundant. Our landscape Architect, Calvin Jordan of Calvin Jordan Associates previously met with Deb Barker on November 25, 1998. At that time the required revisions were discussed and agreeded upon. The site and landscape were prepared per the directions from your department. It is our opinion that another meeting would be redundant and would further delay the re- development of the site. We suggest that it is in the best interest of both the City of Federal Way and our Client, Pizza Hut inc., to swiftly complete the permit process the subsequent construction of the redevelopment of this site. STORMWATER 1. Since there is no increase in impervious surface area proposed, additional storm drainage quantity control is not required. However, treatment of runoff for enhanced water quality is required. Pursuant to the City's current policy on implementation of Federal Way City Code (FWCC) section 22-330 and 22-1196, the storm drainage system serving the site must conform to current treatment standards for water quality. Therefore, the existing storm drainage system will need to be retrofitted, unless water quality is presently provided meeting current standards. All water quality facilities shall be designed and constructed in accordance with the requirements of the KCSWDM and the City's amendments. 2. Provide a copy of the approved as -built storm drainage plans for the site with building permit application. R-O-W IMPROVEMENTS 1. A cost estimate for the improvements associated with this project should be provided by the applicant along with an appraisal or current assessment of the existing on -site building. In the event that the improvements exceed 25 percent of the value of the existing improvements, off -site street improvements may be required. 2. For traffic related issues, see Traffic Division memorandum. MISCELLANEOUS 1. Checklists are available, upon request, to assist in the preparation of plans for various stages of development. 2. Prior to issuance of any building permit, the construction of the site improvements must be bonded. Bonding may be in one of three forms, a cash deposit, assignment of funds in a financial institution, or a bond from a surety. The amount of the bond will be 120 % of the cost of construction to be estimated by the applicant's engineer, using the bond quantity worksheets available from the Public Works Dept. At the end of construction and after the City receives payment of inspection fees, as -built mylars, and the applicant has completed all the inspector's punch list items, the bond will be reduced to 30 % of the original bond amount. This amount will be retained for a two year maintenance period. Any defects that show up during the maintenance period will require correction and subsequent inspection fees shall be paid before the maintenance portion of the bond will be released. S. (Military road and 288�). In addition to the proposed lighting plan, we have attached lighting calculation for the existing conditions and replacement of all luminaries with new units. The following paragraph discusses the results. Luminaries are Type 3 Medium Cut Off (based on GE Fixture). The proposed lighting plan shows very significant improvement over the existing conditions. The existing conditions have significant dark spots that increase the uniformity ration (average/min.) to very high. The proposed plan corrects the dark spots and increases the uniformity ratio. Factors that impact the lighting layout are the existing overhead power lines. These lines limit the pole height and location. Because of the shorter than desired mounting lit (approximately 25% the light level along the parking lot across military road from Pizza Hut drops off slightly. With the exception of one small area the uniformity ratio is 5 to 1. When parking lighting is installed in this area the uniformity ratio should increase to better than 3 to 1. Attached to this letter are the lighting calculation for the existing conditions and the replacement of all lamps. The calculation shows that the light levels are improved very much, and that higher wattage lamps will not compensate for the limited pole height. We request your approval of the submitted lighting design based on the existing site conditions and the significant improvements to the existing conditions. After evaluating the existing conditions along Military Road South and South 288' Street, review of Federal Way City Code (FWCC) provisions (Sections 22-1496, 22-1477), and the direction provided by the City Council, the Public Works Department hereby determines the following requirements for street improvements to be applicable to the development of the property. FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to modify, defer, or waive the required street improvements only after consideration of the following four specific criteria. These criteria were reviewed to determine their application with respect to this request. (1) "Improvement as required would not be harmonious with existing street improvements" Right-of-way and pavement widths are adequate at this time. However, the City Comprehensive Transportation Plan requires a six foot wide planter strip next to the curb and an 8' wide sidewalk on both Military Road S. and S. 288' Street. The Safeway store on the southeast corner of this intersection has recently been required to install similar improvements as part of a remodel proposal. Therefore these projects will be consistent and harmonious. (2)"Unusual topographic or physical conditions preclude the construction of the improvements as required" As the modification request letter states, the site slopes up from Military Road S. Due to the location of the existing building, the developer will likely need to build a three to four foot high retaining wall along the property frontage on Military Road S. to accommodate the required frontage improvements. In addition, two power poles are located approximately 10' behind the curb, in the center of the new sidewalk location. A signal pole on the corner is located 7' behind the curb, on the edge of the new sidewalk location. On S. 288' Street, two power poles are located approximately 8' behind the curb, again within the new sidewalk location. Utility vaults are underground, however lids will need to be adjusted to the new sidewalk grade. A crosswalk signal is located 7' behind the curb, within the new sidewalk location. Topography is not an issue on S. 288' Street. While none of these physical constraints individually would preclude construction, in combination they do add substantially to the amount of work and cost required for the project. For a project of this nature, which is not an expansion of the existing building or a change in use, it is appropriate to consider alternatives that will reduce the amount of construction while also improving conditions within the neighborhood. The developer has agreed to close the northernmost driveway on Military Road S., a significant improvement to traffic safety at this intersection. This will include replacement of approximately 28' of curb and sidewalk. The most appropriate alternative for sidewalk and planter strip is to leave the existing sidewalk in place and require the developer to install street trees and street lights behind the sidewalk. A four foot wide strip of right- of-way on S. 288`' Street will need to be dedicated. (3)"Proper vertical or horizontal alignments cannot be determined because the existing streets do not have correct alignment" Existing streets in this area are correctly aligned. This criteria does not apply. (4)"The required improvement is part of a larger project that has been scheduled for construction in the City's Transportation Improvement Program." The City's Transportation Improvements Program does not currently identify Military Road S. or S. 288' Street as scheduled improvement projects. The criteria does not apply to this project. In summary, as a part of this site redevelopment, the developer will be required to dedicate four feet of right of way along S. 2881 Street frontage, and install street lights and street trees on both Military Road S. and S. 288' Street frontages. Street lighting shall be installed at appropriate intervals and shall meet City design standards. Mounting street lights on existing power poles will not be accepted. Additionally, the property owner shall execute a "No Protest Local Improvement District Waiver", prior to issuance of a building permit. The City will prepare this form for the owner's signature and will record it with King County Records and Electiions. The property owner shall pay all applicable recording fees. The Traffic Services Division of the Public Works Development has required, per FWCC Sec. 22-1524, frontage improvements on Military Road South and South 288'h Street include removing the existing sidewalk and adding a six foot planter strip with trees between the curb and a new eight foot sidewalk, and the installation of street lights. Pursuant to FWCC 22-1477, this letter is to request a right-of-way improvement modification to this requirement. We request a waiver to the requirement to remove the existing sidewalk and adding a six-foot planting strip between the curb and a new eight foot sidewalk along Military Road South and South 288f Street. The reasons for the waiver request are as follows: The improvements, as required, would not be harmonious with existing improvements. Both streets currently have a sidewalk next to a standard curb and gutter. Within the block, the sidewalk placement is also adjacent to the curb. Unusual topographic or physical conditions preclude the construction of the improvements. The distance from the back of curb to the ROW line is less that the 14 feet required to install a 8-foot sidewalk and 6-foot planter. Depending on the street frontage, the remaining distance varies between 12 and 13 feet. The property slopes up from Military Road South at a 15% grade. The relocation of the back edge of the sidewalk �jg f feet from its current location will require a retaining wall to be installed along most of the landscaped area on Military Road South. As such, an 8-foot to 10-foot strip of mature landscaping will be removed. The vehicular entry from Military Road South into the site will also require modification. The modification will increase the existing grade. Additionally, without realignment, the proposed handicapped pedestrian access from Military Road South will exceed the slope allowed by Code. The area where the sidewalk would be relocated on South 288h Street is occupied with utility vaults, vent pipes and metal covers along most of the frontage. The relocation of the sidewalk would require many of these elements to relocated or the sidewalk be moved further into the site to avoid conflict. Therefore, we feel the existing topographic and physical conditions preclude the relocation of the existing sidewalk. We also request a review of the street light requirement. The intersection of Military Road South and South 288'h Street is currently lighted.
