Dear Mr. Garrow:
The City of Federal Way's Development Review Committee met on January 23, 1997 to review
your application submitted for a boundary line adjustment (BLA) between tax parcels #042104-
9037 and 042104-9048. Drawing corrections must be made and/or additional information
provided before the City can continue review of the application and recording of the BLA
document.
Attached is a Public Works Review Checklist and Planning redline drawing comments. The red -
lined drawings and review checklist indicate minor corrections or information needed. Please
revise the document as requested then return the red -lined drawings and revised boundary line
adjustment drawings and/or attachments for continued processing.
Submit original mylar set, photo mylar set and two blue line sets of the BLA for recording along
with the appropriate recording fees ($44.00 check made out to King County Records and
Elections). Property corners must be set at the time of mylar submittal.

Each parcel owner and his heirs, assigns or successors shall hold the other owners and
possessors of the above dascribed parcels harmless fmrn any end ail claims. demard9,
losaas, damages, expenses, aftomey'e fees, costs and lieNlitles of every kind and desorlpttort
including personel Inlury and for any damage to or loss or deslnxtion of property whatsoever
suffered by him or his heirs, successors and assigns, arising from or related to his use,
maintenance and repair of the Easement Area and the Ilnes located therein.
S. MISCELLANEOUS.
5.1 Release of Obligations. At such time as a party no longer has an interest In his
above described parcel, he shall be released and discharged from any obligations
under this Easement Agreement accruing thereafter.
6.2 Utigatlon; Legal Fees. In the event of IlQgation between the panes hereto,
declaratory or otherwila, In connection with this Easement Agreement, the prevailing
party shall recover its costa and attorneys' fees actually incurred, which shall be
determined and fixed by the court as part of the judgment. The parties covenant and
agree that they Intend by this section to compensate for attorneys' fees actually
Incurred by the prevailing party to the particular attorneys involved at such attorneys'
then normal hourly rates end that We section shall constitute a request to the court
that such rate or rates be deemed reasonable.
