Hi Gary, This email authorizes the removal of a dilapidated bridge from Lake Lorene, which is considered a wetland. Federal Way Revised Code 19.175.030(3) states: Rehabilitation. The director of community development may permit or require an applicant to rehabilitate and maintain a regulated wetland by removing detrimental material such as debris and inappropriate vegetation and by requiring that native vegetation be planted. These actions may be required at any time that a condition detrimental to water quality or habitat exists. The bridge is detrimental to wetland habitat and is also causing flooding problems. Removal of structures like these is the intent of the above code section. Work shall be done with manual labor(without the use of heavy equipment). Any pieces of debris resulting from the work shall be removed. Contact me if you have any questions. That would require a permit. Simply removing the existing bridge does not require a permit—but it does require Director approval. I just need to know how you'll be removing it—what type of equipment you're using, that you'll remove any debris that comes loose, etc. the point is if you do it sensibly it's not an issue. If you have a backhoe sitting in the water and tearing up the bank, etc.,that's not appropriate in a sensitive area like that. Why don't you respond back and describe how you'll remove it and we can handle this by email. To be clear, I'm not getting into the issues of ownership, etc.—that's between the HOA and the homeowners. We have experience another occurrence of flooded streets in our last heavy rain storm and thought I'd check for resolution. In the first email I suggested that part of the problem of the lake level being to high was the obstructions in the discharge path. specifically and an old dilapidated "bridge" that blocks the exit path once the level rises. During the rain storm, I removed a bunch of the debris plugging up the path where the water was trying to exit. As I stated before, someone at City Hall told the homeowner they needed a permit to remove this... that makes absolutely no sense. Here are a couple of pictures of this piece of %$#@. It is an obstruction which also could be classified as a Safety Hazard... Recently, during the heavy rains, we had a homeowner that had water in his driveway within 6" of going into the garage. The street appears to have had at least a foot of water on it. The city was called, it was investigated and I was informed that part of the problem was that the lake level was higher than originally intended. I discussed same with Ryan, he made me aware that the outflow of the lake was an HOA responsibility. I investigated both out flows, the one the city installed 5-6 years ago and the creek between Lorene and Jeane. The city installed outflow was partially clogged with leaves, tree debris and other natural materials. I cleared that away and water exit rate increased. There is a growth of cattails at that exit point that are starting to become a problem for exit flow... you are aware of our cattail issue. The creek was also significantly clogged up where it exits under a homeowners fence. Somehow a 30 foot log became sideways and with the natural debris... exit flow was hampered. Contributing to the problem are a couple of dilapidated bridges that homeowners installed probably more than 20 years go. These bridges go from their side of the creek to the park. Again debris was building up on the Lorene side, hampering exit flow. I moved one bridge out of the stream and removed the debris. Lake level dropped at least 8 inches, maybe 12. I am now getting to the reason for this email... by the way, cattails are also hindering flow in this creek. Back in February 2013, we wrote letters to these two homeowners, telling them we considered the bridges safety hazards and wanted them removed. If they felt they wanted them to stay, 6 go thru the process of getting authorized and make it happen. In the interim, I told them to install "private property" signs. They appear to be dangerous and I didn't want the HOA libel if someone entered onto the bridge from the park side and became injured. 8 months later, while investigating the lake level issue, I find these homeowners have done nothing with the bridges. They are still in the flow path of the stream. I reviewed the p►at maps for that area, found there was an easement from center of creek to 15' both sides for "drainage and maintenance". I decided these specific homeowners didn't own them, and that the HOA could remove. We sent them a letter which explained our intention to remove and if they had issue contact the HOA. I want to get these things out of the exit stream before the next heavy rainfall and street flooding starts again. One homeowners has contacted the HOA and wants an opportunity to be heard, the other sent us a letter, it's attached. It appears she doesn't care if the bridge is removed, she stated she contacted the city and a permit is required.... I said to myself, that can't be correct.... is it?
