The City of Federal Way's Department of Community Development has received your request to perform
maintenance on the culvert located on South 304th Street to the east of Pacific Highway 99.This culvert
connects the Steel Lake outlet channel and Redondo Creek, and requires maintenance to avoid failure.
The existing concrete pipe is severely separated and is causing embankment material from the roadway to
leak through the culvert, leaving voids around the pipe.Temporary maintenance activity is proposed for
the week of August 25, 2014.
The proposed maintenance activity falls within the applicability of FWRC 19.120,"Clearing, Grading,
and Tree and Vegetation Retention"and FWRC 19.150,"Critical Areas Administration."Based on
submitted information we find that the proposed maintenance activity is exempt from the need to submit a
`Clearing and Grading Plan Approval' pursuant to the criteria of FWRC 19.120.030. We also agree the
work is exempt from critical area regulation per FWRC 19.150.080(2)as we understand the Public Works
Director has approved a maintenance plan.The submitted maintenance plan adequately addresses erosion
control measures and subsequent replanting that may be necessary.Consider this letter approval to
conduct the work.

Subject: SWM Maintenance Plan for South 304th Street Culvert Lining CDS
The South 304th Street culvert east of Pacific Highway 99 connecting the Steel Lake
outlet channel and Redondo Creek requires maintenance to avoid failure. The existing
concrete pipe is severely separated at the concrete pipe segment joints and embankment
material from the roadway is leaking through the culvert leaving voids around the pipe.
An HDPE lining installation by the SWM maintenance crew is planned for the week of
August 25th, 2014 and involves accessing the stream bottom to push the HDPE lining
through the existing culvert and grout the annular space between the lining, existing pipe
and embankment material. Temporary maintenance activity to install the HDPE lining is
only planned for the week of August 25th. This memo provides the maintenance plan per
the City of Federal Way Revised Code(FWRC) section 19.150.080 which documents
repair activities, specifies the work to occur,outlines the area of impact and discusses
mitigation measures. The culvert lining location is a non-fish bearing stream and does
not require Hydraulic Project Approval (HPA) from Washington Department of Fish&
Wildlife.
A 30"outside diameter, solid wall Snap-Tite HDPE lining with dual notched male/female
mechanical joints sealed with a rubber gasket will be installed from the downstream end
of the culvert and pushed upstream. The private property north and downstream of S
304th Street right-of-way is owned by the Estate of Vera Spoerry and Bessie, Olga, Nadya
and Sill Danilchik. The City has contacted Kristina Danilchik, Bessie's daughter and
representative to the City, and verbally obtained permission to complete the maintenance
activity. A follow-up letter request for temporary access was sent to Kristina and the
owners to formally document permission and the City is awaiting receipt of the signed
letter.
The attached exhibit shows the anticipated limits of maintenance activity which include
an approximately 10-ft wide path beginning on the north side of S 304th Street at an
existing path/trailhead and working space approximately 50-60 feet wide in the channel
bottom. A mid-sized excavator with rubber tracks will use the path to access the stream
channel where 24-ft long segments of HDPE pipe will be staged and inserted into the
existing culvert. The immediate area around downstream invert will be cleared of
vegetation and sediment to allow full access to the existing pipe and synthetic sheet
matting will likely be temporarily placed across the channel bottom as a working surface.
The upstream end of the culvert will be accessed by foot only and the invert will be
cleared using hand tools. Existing vegetation in the access areas include brush, shrubs,
and bushes but no trees that will be impacted. Photos of the existing condition are
attached for reference.
After the lining is inserted, concrete ends sealing the interstitial space between the HDPE
lining and the existing concrete culvert will be installed at each end of the culvert and
grout will be pumped through PVC piping into the annular space between the existing
culvert and the HDPE lining. The grout pump and concrete trucks will be situated on S
304th Street and are not anticipated to cause any additional impact. Once grouting is
complete, the PVC pipe openings in the concrete ends between the HDPE lining and
existing culvert will be fully sealed and lining installation is complete. Any material
cleared around the culvert ends will be restored as needed. The excavator will be used to
remove existing trash in and around the path as it exits and vegetation recovery will be
monitored over the next several months. If vegetation struggles to recover during the
monitoring period, SWM will utilize volunteer groups to re-plant the area as need to
mitigate the impact.
The proposed HDPE lining maintenance activity described in this maintenance plan is a
one-time event. Please do not hesitate to request additional information or clarification if
needed.

The city hereby adopts the June 19, 1999, city of Federal Way final wetland inventory report,to show
the locations of certain regulated wetlands in the city. The city hereby adopts the Lakehaven utility
district wellhead one-,five-, and 10-year capture zone maps, as now existing or amended.

19.150.030 Basis for determination.
The determinations regarding whether the subject property is regulated under this division, as well as
the extent and nature of the regulations that will apply to the subject property,will be determined
based on environmental information and mapping possessed by the city as well as other information
and mapping provided by or through the applicant.The city may require the applicant, at the
applicant's expense, to provide any information, mapping, studies, materials, inspections or reviews
that are reasonably necessary to implement this division and to require that such information, studies,
mapping, materials, inspections and reviews be provided or performed by a qualified professional
acceptable to the city. Other provisions of this division detail other information and inspections that
may be required in some instances.

19.150.040 Reasonable use of the subject property.
(1)The provisions of this section establish a mechanism whereby the provisions of this division may
be modified or waived on a case-by-case basis if their implementation would deprive an applicant of
all reasonable use of the subject property.
(2)An applicant may apply for a modification or waiver of the provisions of this division using process
IV; except, that applications for projects on single-family residential lots platted prior to the
incorporation of the city may use process III.
(3)The city may approve a modification or waiver of the requirements of this division on a case-by-
case basis based on the following criteria:
(a)The application of the provisions of this division eliminates all reasonable use of the subject
property.
(b) It is solely the implementation of this division, and not other factors, which precludes all
reasonable use of the subject property.
(c)The applicant has in no way created or exacerbated the condition which forms the limitation
on the use of the subject property, nor in any way contributed to such limitation.
(d)The knowledge of the applicant of limitations on the subject property when he or she
acquired the subject property.
(e)The waiver or modification will not lead to, create nor significantly increase the risk of injury
or death to any person or damage to improvements on or off the subject property.
(4)If the city grants a request under this section, it shall grant the minimum necessary to provide the
applicant with some reasonable use of the subject property, considering the factors described in
subsections(3)(a)through (e)of this section.The city may impose any limitations, conditions and
restrictions it considers appropriate to reduce or eliminate any undesirable effects or adverse impacts
of granting a request under this section.

19.150.060 Bonds.
The city may require a bond under Chapter 19.25 FWRC to ensure compliance with any aspect of
this division.

19.150.070 Dedication.
The city may require the applicant to dedicate development rights or an open space easement to the
city to ensure protection of steep slopes,wells, streams, regulated lakes and regulated wetlands and
other areas within the jurisdiction of this division.

19.150.080 Exemptions.
The following activities are exempt from the provisions of this division:
(1) Emergencies that, in the opinion of the director of community development,threaten the public
health, safety and welfare;
(2)Normal and routine maintenance and repair of the following facilities,for which a maintenance

(a)Existina drainage ditches; provided, however,that this exception shall not apply to any
ditches used by salmonids other than to permit free migration of salmonids to their spawning
grounds;
(b)Surface water facilities;provided,that such activities shall not involve conversion of any
regulated wetland not currently being used for such activity;
(c)Existing public facilities and utility structures or rights-of-way.
The maintenance plan may be designed to address individual facilities or facility components, area-
wide facilities or city-wide systems.The maintenance plan shall jdentify the nature of the potential,,,
maintenance or repair activities;specifications for work which may occur within potential sensitive
Nga specifications for restoring and/or mitigating impacts, specifications for timing of maintenance
or repair activities, and process for contacting or notifying the city of pending maintenance or repair
activities to ensure compliance with the approved plan.The public works director may require that an
appropriate bond or security be maintained with the city to ensure restoration of disturbed areas.
