This is a response to your June 18, 2018, inquiry and request for a permit to build a 200 square foot shed at
your vacant property at 4227 South 32611, Place.

no principal use existing on the property, an accessory use (shed) is not allowed.
Building a shed on the property would be a zoning code violation and the city may issue a Notice of Violation
and Order to Correct; and the city could issue a civil infraction. The city would also require the shed to be
removed. A shed may be built at the property only after a house (principal use) is buih at the property.
The property is coned single- family residential. The property may not be used for commercial purposes or for
a construction company tool storage, and as previously communicated by my staff, no further tree removal or
vegetation clearing is allowed at the vacant property.

There is still continued code violation work being performed on the property. I will be filing a non code enforcement complaint with tl
county, regarding the Septic and L & I regarding the electrical. I will be speaking with a lawyer regarding filing a Writ of Mandamus,
and possibly filing suit. I have included several members of the King County Public Health Department as well, as well as the King

18.30.010 Application and review process.
The general procedure for processing an application for a short subdivision consists of the following steps:
(1) An optional preapplication conference between the proponent and city staff to discuss land use, site design, transp
environmental issues-
(2) Review of the short subdivision application to determine whether or not the application is complete and acceptable
(3) Review of the application by the department of co unity development services, public works department, Lakeha
district, c4 of Tacoma public works department, and county department of public health, if systems are to be ull
(4) Approval, approval with conditions, or denial of the short subdivision by the director of the department of communit
services.
(65) Review of engineering drawings for required public improvements.
(6) Approval of engineering plans by public works director,
(7) Substantial completion of required improvements.
(8) Recording of short subdivision in the office of the county division of elections and records.

-Items 11 and 12 above refer to subdivision of property. Again, application for subdivision of the land has been submitted, and
therefore, these sections do not apply to the property in question.
13. Additionally, as there is no permit, no notices were mailed out regarding the decision of the Director of the Department of
Community Development Services -The Director has made no land use decision on this site because there has been no action
that requires the Director's approval. If the land owner were to apply for a residential permit, no notice is necessary and no
decision would be required by the Director.
14. As you can see, he has installed a privacy fence and grading has been performed: -The "privacy" fence is permitted without a
permit since it is less than 7 feet in height. The portion of pavement at the site that is fenced is actually upon his property and
survey of that fence is being reviewed.

This is a follow up to the on-line form you submitted on 6-11-18 regarding property tax parcel number 282410 0360
which is located just east of 32634 Military Road S. in Federal Way.
City Code Compliance staff visited the site on 6-11-18 and talked with David the property owner.
City staff is not involved with title transfers and has no comment on this subject,
City staff has informed the owner that nofurther tree removal orgrading isallowed onthe site until avalid building
permit is issued, except as discussed below.
Removal of downed trees and branches is allowed.
Excavation for septic system design and testing isallowed.
Construction ofafence isallowed. Nopermit isrequired unless the fence isover 7feet taU�
It appears that the fence foundation that has been installed at the site may be located off the subject property as shown
inthe photos. However, the fence location is a private matter between property owners and is civil dispute between
property owners. The City has norole inthis civil dispute. VVesuggest you discuss this with the other property owner or
take other legal steps asyou deem appropriate.
