The site is zoned Neighborhood Business(BN)and pursuant to Federal Way Revised Code(FWRC) 19.215.020 Entertainment, a fitness studio is a permitted use.The proposal for a"dry"fitness studio will not provide amenities like showers,swimming pools,or Jacuzzis.As defined in FWRC 19.05.030,a change of use is determined to have occurred when it is found that the general character of the operation has been modified.This determination typically includes a review of hours of operation,required parking,traffic generation,general appearance,outdoor storage,and surface water runoff or discharge.The applicable review in this case considers parking and traffic generation. The City of Federal Way does not have a parking requirement specific to fitness facilities,and mixed use development parking is determined on a case-by-case basis.You provided the number of parking spaces the shopping center has at 689 total parking spaces for 195,000 sq.ft.,which is sufficient for retail and entertainment uses of the shopping center based on Institute of Transportation Engineers(ITE)Parking Guidelines. The ITE does not calculate traffic generated by small fitness centers;however,peak hour traffic and daily trips is less for large scale fitness centers than grocery stores,the primary use of the shopping center.Peak traffic would likely occur at roughly the same time as the previous video store use, in which case it is not anticipated that a small fitness center would have a negative impact on peak hour traffic. For the above reasons it has been determined that your proposal does not constitute a change of use and no further land use review is required.For your information,a business license will be required,as will a building permit for any remodeling within the tenant space. Because the space was occupied by a different use (video rental store)we need to do a change-of-use analysis to determine if the fitness center would have more impact(mostly in terms of traffic generation and parking usage). if the fitness center is considered a change of use, then a Use Process 1 land use permit would be required tablish the new use. If not, no land use nit is required(a business license is required and a building permit is required for any remodeling within the tenant space). The main thing I need from you for the change-of-use analysis is some more information about the parking. Total number of parking spaces on-site and total square footage of buildings on site. I'm assuming it's a shared parking concept between the FM and smaller tenants)? Also,what would the hours of operation be? Once you provide that information to me I'll ask one of my staff to do the change-of-use analysis and we'll let you know the outcome. Let me know if you have any questions. I'm hoping you can help me;I need to know what the property is zoned and if a fitness facility with a"dry" fitness concept(no showers, swimming pools, Jacuzzis)would be a permitted use there. If not, is there any way to go about getting the use approved? Also,we would like to put a Promotional/ Marketing trailer on site for about 60-90 days during the construction of our space. As soon as we open for business,the trailer will be removed. It's comparable to a trailer you would find at a new housing development site. However, the trailer would be used to provide the public with general information about the, soon to be open,club. Once the club is open for business,the trailer would be removed.
