The Director of Community Development Services has reviewed your request,received December 23,
2008,to waive the required preapplication for the above-referenced project. Subject to the understandings
noted below,your request is hereby granted,pursuant to the criteria in Federal Way City Code(FWCC)
Sections:
1. FWCC Section 22-1653(2)(a)(1): "The simple nature of the request."
2. FWCC Section 22-1653(2Xa)(3): "The site has previously undergone preapplication, site plan,or
other land use review for the same or similar development proposal and it is unlikely further
preapplication review will provide any benefit to the City or the applicant."
Be advised that proceeding without preapplication review increases the risks of an incomplete
application;or increased processing time; or that any recent updates to City codes,policies,or
development standards may affect your project.Also,this waiver will apply only to a formal application
that is generally consistent with previous land use applications and approvals for the site.In addition,
consistent with the preapplication timelines in FWCC Section 22-1657,this waiver is valid only for a
period of one year from the date of this letter.

• M This letter is a formal request to waive the Pre-application Conference for the proposed 24 Hour
o Fitness located at 33620 21'Avenue SW in Federal Way. According to Federal Way Municipal
`" Code (FWMC) 22-1653, a waiver to the Pre-application Conference may be requested by the
E applicant. The director of community development may grant the waiver and issue a written
o• ° response confirming the waiver. The waiver is requested,as the applicant's representatives have

met with the community development director to discuss the project. Dietrich Wieland, the
. applicant's architectural representative,met with the community development director on May 15,
2008 to discuss the various land use approval options available to the applicant. The applicant has
a 3 proceeded with the Type IV Variance request with hearing examiner approval. The applicant
y — received a substantial amount of information from this meeting and is well aware of the variance
a criteria and the submittal requirements for application completeness.

This request is submitted with the Type IV Variance request application. All pertinent information
• M is contained within this packet. Generally, the applicant seeks a variance to allow a 45,000 SF
health club in a vacant structure. The structure was previously occupied by an Albertson's grocery
store. 24 Hour Fitness would propose tenant upgrades to provide childcare services, a 25 meter
swimming pool,spa,sauna,a basketball court,tanning rooms,and a small retail area for members
Group and non-members,in addition to a large exercise equipment area. As the building is a pre-existing
Mackenzie, structure,limited site work is proposed. However,the applicant will work with the City of Federal
Incorporated Way to provide site amenities that encourage pedestrian and bicycle access to the site, while
Architecture creating a welcome transition from the site to the neighborhood. Proposed site amenities would
