Dear Mr. Oehler:
This letter responds to your June 29, 2018 (received July 13, 2018) written request for a minor
deviation from the sign setback requirements of Federal Way Revised Code(FWRC) 19.140.170(2).
In summary, you are requesting an approximately one-foot reduction in the sign setback requirement,
in order to locate the proposed 1/4-inch plated aluminum monument sign(attached to a one-foot deep
rock) approximately four feet from the right-of-way line from SW Dash Point Road, rather than the
required five-foot setback.
Analysis: Pursuant to FWRC 19.140.170(2), the required setback from the property lines for all
signs shall be not less than five feet from the subject property line in residential zones.
The 10-foot-wide sign easement area within Tract D of the Soundview Manor plat was clearly
intended for subdivision identification signage. However,the 10-foot-deep tract is not of sufficient
depth to allow any signage, due to the required minimum five-foot front,and minimum five-foot rear
setback requirement of FWRC 19.140.170(2).
The rock to which the sign is attached can be considered an appurtenant feature and/or landscape
feature. Therefore, the proposed sign depth can be considered a total of approximately '/-inch. With
a sign depth of only '/-inch, the only necessary relief or deviation from FWRC setback requirement
is for the 1/4-inch depth, which is a minimal distance and is minimally intrusive into the required five-
foot setback.
Decision: Pursuant to FWRC 19.140.170(3)(d), a '/-inch minor deviation from the required five-foot
property line setback is hereby approved to locate the proposed sign with an approximate setback of
4 feet 113/4 inches from either the front and/or rear property line.
This minor deviation is the minimum necessary to allow a sign within a sign easement and tract
specifically identified for signage purposes. This decision is a minor deviation as allowed by FWRC
19.140.170(3)(d)and does not constitute a zoning variance under the FWRC.

Subject: Minor Deviation for Monument Sign Placement
Dear Ms. Dunlap:
This letter is a request for a minor deviation from the sign setback requirement as described in FWRC
19.140.170(2).
As part of the HE conditions for Soundview Manor, the plat was required to provide arterial buffer
landscaping along a majority of the project frontage with SW Dash Point Rd. This was accomplished by
the creation of two 10' wide tracts (Tracts C and D) adjacent to the south right of way line of SW Dash
Point Rd. During final plat coordination and recording (Rec. #20171228000828) we gained approval
from the city's planning department for the creation of an entry sign easement at the west end of Tract D.
The proposed ''A" plated aluminum monument sign will be attached to an irregular shaped rock that has
approximate dimensions of 6-ft. long x 4.5-ft. high x 1-ft. wide. To minimize the impacts of the
monument sign placement with respect to the sign setback requirements, the monument rock will be
placed so that the back of the rock is setback a minimum of 5-ft. from the property line of Lot 1. The
front of the sign would be approximately 4-ft. from the southerly right of way line and approximately 18-
ft. south of the back of sidewalk within SW Dash Point Rd. The request for deviation would be for
allowing the face of the rock and attached monument sign to be setback approximately 4-ft. from the
north line of Tract D / south right of way line rather than the required 5-ft. setback. This is a minor
deviation from the 5-ft. setback as required by code. From a visual perspective, since the monument sign
is placed so far behind the sidewalk along SW Dash Point Rd. it would be very difficult for the public to
discern that the monument sign did not fully comply with code setback requirements.
Regarding the sight distance issue with respect to the proposed monument sign. There is 28-ft. from face
of curb to the south right of way line of SW Dash Point Rd. As a result, a typical vehicle will be able to
fit entirely within the distance measured from face of curb to the south right of way line. The 10-ft.wide
Tract D and the proposed monument sign are adjacent to the south right of way line. Therefore, the
proposed monument sign will not fall within the site distance triangle. This was also worked out prior to
the approval of the entry sign easement on the final plat.
We feel that this request will not adversely affect the protection of public health, safety and welfare, the
environment,and public and private property.
