The city updated the Critical Ares Code in June 2015,and the code section that dealt with this type of work no longer exists(Federal Way Revised code[FWRC] 19.165.060"Rehabilitation").However,the same code update also added a section that addresses maintenance activity.Pursuant to FWRC 19.145.110,"Exemptions,"the following activities arc exempt from the provisions of Chapter 19.145,"Environmentally Critical Areas": "(2)Operation,maintenance,or repair of existing public improvements,utilities,public or private roads,parks,trails,or drainage systems if the activity does not further alter or increase impact to,or encroach further within,the critical area or buffer and there is no increased risk to life or property as a result of the proposed operation,maintenance,or repair,and no new clearing of native vegetation beyond routine pruning." The requested maintenance is necessary in order to restore the stream flow,protect the existing bridge,and allow inspection and potential maintenance of the bridge.Environmental review pursuant to the State Environmental Policy Act(SEPA)has been completed previously(city file SEP95-0013).That environmental threshold determination has subsequently been relied on over the years for the same activity.Staff concurs that use of the existing environmental document is appropriate for the current maintenance activity request.Therefore,no new SEPA threshold determination is required(WAC 197-11-600[2][3]&[4][a]). CONCLUSION The requested activity qualifies for a Critical Areas Exemption and is hereby approved.This approval does not exempt the project from other local,state,and federal permit requirements.A Hydraulic Project Approval(HPA) is required from the Washington State Department of Fish&Wildlife(WDFW). BACKGROUND: The proposed action is to dredge approximately 300 lineal feet (approximately 150 to 200 cubic yards) of Hylebos Creek north and south of South 373rd Street to remove sediment and minimize adverse flooding impacts to abutting house and South 373rd Street. SEPA review is required because the proposal is located on lands wholly or partly covered by water and within a Federal Way defined critical area (major stream) . Analysis of the proposal is based on the submitted environmental checklist, conceptual drawings, and supporting documents . B. Environmental Elements: 1 . Earth: The 1973 USDA Soil Conservation Service " Soil Survey of the King County Area" classify onsite soil as Norman Sandy Loam. Dredging is proposed during the seasonally dry period (July to September) . A Temporary Erosion Sedimentation Control Plan may be required with the related land surface modification application to insure the proposal has minimal impacts to the stream. Approximately 150 to 200 cubic yards of material deposited within the streambed will be exported to the City maintenance shop at Steel Lake and stored for future use as select backfill in street restoration and pipe trench projects. Construction access will be via South 373rd Street. Construction vehicle staging will occur on South 373rd Street to minimize impacts to abutting private property. 2 . Air: Short term impacts to air quality may occur during operation of heavy equipment. Construction activity, especially site preparation work, will contribute to a short term increase in local suspended particulate levels. Construction activity also contributes to carbon monoxide levels through the operation of construction machinery, the use of trucks to deliver equipment and materials, and worker access to the site by automobile. These activities also involve emissions of hydrocarbons and oxides of nitrogen, potentially elevating the level of photochemical oxidants, such as ozone, in the ambient air. Compliance with local, state and federal air quality standards will provide sufficient mitigation of these potential impacts . In addition, site watering will decrease suspended particulates . 3. Water: Hylebos Creek is classified as a "major stream' Pursuant to Federal Way City Code (FWCC) Section 22-1 . A Process One Land Surface Modification permit will be obtained prior to commencement of construction. 4 . Plants: Revegetation of disturbed areas may be necessary following completion of dredging activity. No significant trees or shrubs are located in the construction area. 5. Animals: The project vicinity includes limited wildlife habitat due to area-wide clearing for animal grazing/pasture use. 6. Energy and Natural Resources: Construction vehicle servicing and maintenance shall occur offsite to reduce potential stream impacts from petrochemical contamination. 7 . Environmental Health: Concur with checklist. 8. Land and Shoreline Use: One site is developed with a single family residence, the other affected lots are vacant and used for 2 animal grazing/pasture. Hylebos Creek does not fall within State Shoreline Management Act (SMA) jurisdiction pursuant to WAC 173-18- 040 (1) because it has a mean annual flow less than 20 cubic feet per second. Hylebos Creek is classified as a "major stream" pursuant to FWCC Section 22-1 due to presence of resident or migratory fish populations within the stream. Therefore, the proposed stream dredging may be authorized by the Director of Community Development Services pursuant to FWCC Section 22-1311 to correct detrimental water quality or habitat conditions . Also, a Process One Land Surface Modification (LSM) approval is necessary because the proposal is not categorically exempt from LSM permit requirements . The proposal is located within a wetland as identified by Washington State Department of Wildlife and U.S . Fish and Wildlife Service National Wetland Inventory. Even so, applicable stream intrusion permit process and design requirements take precedence over wetland permit process and design requirements due to the proposed scope of work. 9. Housing: Concur with checklist. 10 . Aesthetics: Concur with checklist. 11 . Light and Glare: Concur with checklist. 12 . Recreation: Passive recreation opportunities at the site will not be encouraged because the site is located on private property. 13. Historic and Cultural Presentation: Concur with checklist. 14 . The purpose of this letter is to request your approval of allowing to use an existing environmental document for this project pursuant to Federal Way City Code 18-117,request your approval of using Director's Approval as the landuse permit process for this project in accordance with FWCC Section 22-1311, and request waiving the requirement of having a pre- application meeting for the project. Project Summary The proposed project consists of removing approximately 93 cubic yard of streambed gravel from West Hylebos creek underneath the old S 373rd Street bridge within public right-of-way. More detailed project information is presented in the attached project analysis. Request Using Existing SEPA Document Gravel removal at this same location was conducted by the City of Federal Way several times in the past in the years of 1991, 1995, 1997,and 2002. In 1995, a SEPA checklist was prepared and a Determination of Non-significance was issued(see State Environmental Policy Act Determination of Non-significance—Hylebos Stream Dredging, Federal Way File No. SEP95- 0013). In both 1997 and 2002, it was determined that a new SEPA threshold determination was not required for the gravel removal operation because"(1)the environmental impacts associated with the gravel removal were previously evaluated in the 1995 SEPA review, pursuant to the SEPA rules; and(2)the proposal does not represent any new or substantial changes that are likely to have significant adverse environmental impacts beyond those evaluated in previous environmental decisions."(see West Hylebos Creek Bridge Gravel Removal—SEPA Compliance Analysis; File No. 02-101305-00-AD). The scope of the currently proposed project is essentially the same as the projects conducted in the past, only this time the extent of the gravel removal will be reduced to be within public right- of-way. Therefore, SWM requests that the existing SEPA document can be used for the proposed project. Development Approval Process Director's Approval was granted for the gravel removal project in 2002 in accordance with Federal Way City Code Section 22-1311 (see West Hylebos Creek Bridge Gravel Removal 300 Block of south 373rd Street; File No. 02-101305-AD). Since the scope of the proposed project is essentially the same as the 2002 project, SWM requests that the same development approval process can be used for the proposed project. Pre-application Meeting SWM also requests that the requirement of having a pre-application meeting for this project is waived because a pre-application meeting for this project does not appear to be of benefit due to the simplicity of the project. SWM Project Engineer CC: Paul Bucich, P.E., SWM manager Project File Day File South 373" Street Bridge Gravel Removal-2008 Project Analysis Background The project consists of removing approximately 93 cubic yards streambed gravel from West Hylebos Creek underneath the old S 373`d Street bridge within public right-of-way to provide clearance needed for bridge inspection. The project is proposed as a result of a bridge inspection report received in October 2007 from King County Road Services Division. The report requests the City of Federal Way to dredge the West Hylebos Creek underneath the old South 373rd Street bridge so that the bridge can be inspected. King County Road Services Division is conducting the bridge inspection in accordance with agreements among the City, King County, and Washington State Department of Transportation, and in accordance with the requirements by state and federal laws. The gravel removal operation at the same site had been conducted by King County for 20 years as part of their street and drainage system maintenance program, by the City of Federal Way in 1991, 1995, 1997,and 2002, and by WSDOT in 2006. Existing Condition Currently the clearance from the bottom of the bridge girders to the bottom of the channel is less than 12 inches. In order to inspect the bridge, gravel underneath the bridge needs to be removed at least 3 feet in depth. SWM Division and WSDOT recently completed a project of Spring Valley Restoration and South 373`d Street Bridge Replacement. The project consists of constructing a new bridge on S 373rd Street located approximately 200 ft east from the old bridge, realigning West Hylebos Creek channel to the new bridge, creating fish habitat in the newly created stream on both sides of S 373`d Street, and creating/enhancing wetland on the properties located on both sides of S 373`d Street. As a result of the project, flow going through the old bridge has been dramatically reduced. The only flow now going through the old bridge is from localized spring. Source of Gravel The source of the gravel is from upstream of this location. Since West Hylebos Creek is no longer going through the old bridge,there should not be enough flow to carry any more sediment to this location. Proposed Actions The project proposes to remove approximately 93 cubic yards of gravel from the old creek channel underneath the old South 373`d Street Bridge. Sediment/erosion control measures utilizing Best Management Practices as outlined in the King County Surface Water Design Manual will be in place during construction to aid in minimizing potential water quality impacts. Gravel will be removed by using either vactor truck or excavator with a closed bucket. With either method, all heavy equipment will be operated from the bridge or stream bank above ordinary high water mark and will not enter the stream channel. Mats will be used to minimize soil disturbance. During construction, the small amount of flow in the stream will be diverted around the project site. The project time frame will coincide with summer low flow period in accordance with the Washington State Department Fish and Wild Life HPA permit. The project will avoid fish-spawning seasons and therefore reduce the potential impacts to fish. Excavated material will be disposed of at an offsite upland location. As part of the Spring Valley Restoration and South 373`d Street Bridge Replacement project,the properties on both sides of the bridge have been planted recently with native plants. To eliminate disturbance to planting, all heavy equipment will be operated from the bridge or road way shoulder. 22-1311 Rehabilitation. The director of community development may permit or require the applicant to rehabilitate or maintain a stream by requiring the removal of detrimental materials such as debris, sediment and invasive, non-native vegetation. Approval of stream rehabilitation shall be based on a review of a plan containing, at a minimum, an analysis of existing conditions, identification of the source, if possible, of the degradation of the stream or riparian zone, proposed corrective actions, including installation of native species within the riparian corridor, performance standards, monitoring schedule, planting plans, erosion and sedimentation control plans, and grading plans as necessary. The director shall require an applicant to retain the services of a qualified professional in preparing the restoration plan. These actions may be permitted or required at any time that a condition detrimental to water quality, stability of stream banks, degradation of existing naturally vegetated buffers, or in stream habitat exists. Intrusions into regulated steep slopes and associated setbacks will be allowed for purposes of approved stream rehabilitation projects. (Ord. No. 90-43, § 2(80.100), 2-27- 90; Ord. Upon review of the current proposal, it was determined that it is consistent with the gravel removal described and reviewed in the May 18, 1995, SEPA checklist and July 13, 1995,Determination of Nonsignificance(DNS).The 2008 proposal is essentially the same as the project proposed and conducted in 1995;however,the current proposed action is to occur in the summer of 2008 rather than in the summer of 1995.The current proposal involves removal of a smaller amount of gravel than removed in 1995. The proposed action was determined by the Responsible SEPA Official,pursuant to WAC 197-11- 600(3)(b),to not require a new SEPA threshold determination because:(1)the environmental impacts associated with the gravel removal were previously evaluated in the 1995 SEPA review,pursuant to the SEPA rules;and(2)the proposal does not represent any new or substantial changes that are likely to have significant adverse environmental impacts beyond those evaluated in previous environmental decisions. Similar gravel removal actions were conducted by the Public Works Department and approved by the Department of Community Development Services in 1997 and 2002,and by the Washington State Department of Transportation in 2006.The 1997 and 2002 projects relied on the 1995 SEPA documents. Environmental conditions in the vicinity of the proposal have not significantly changed since 1995. Planning Division staff considered the potential implications of the listing of Puget Sound Chinook salmonids as endangered species.Although Chinook salmon have historically been present in Hylebos Creek and were observed in the creek in 2001,the proposed project should not adversely impact Chinook salmon due to the nature and timing of the project.The proposed action must receive a Hydraulic Permit Approval(HPA)from Washington Department of Fish and Wildlife(WDFW)and conditions attached to the permit will regulate construction practices and construction timing and mitigate potential impacts to salmonids and associated habitat.An HPA was required and approved for the same proposal in 1995, 1997,and 2002.Construction activity for the proposal will occur in the"low flow"summer months when salmon and salmon redds are not present in the creek.Compliance with conditions on the HPA as required by WDFW will adequately mitigate potential impacts to salmonids. Pursuant to Federal Way City Code(FWCC)Section 22-1311 regarding stream rehabilitation,the Director of Community Development Services may permit stream rehabilitation or stream maintenance by requiring the removal of detrimental materials such as debris,sediment,and invasive non-native vegetation.The requested gravel removal is necessary in order to restore the stream flow and protect the existing vehicular bridge from localized flooding and to allow inspection and maintenance of the bridge. Similar stream maintenance actions previously occurred at the same site in 1991,twice in 1995, in 1997, in 2002,and by the Washington State Department of Transportation in 2006. CONCLUSION The proposed gravel removal meets the standards of FWCC Section 22-1311 by removing detrimental gravel and sediment which,in the past,has created a localized flooding condition at the project site and prohibits inspection and maintenance of the bridge. Environmental review pursuant to the State Environmental Policy Act has been completed and no comment or appeal periods apply.
