The request to replace the septic system was previously approved through Shoreline Substantial Development Permit Exemption#07-102628-00-SH. The proposal was to replace an existing beach front failing septic system with a new sealed fiberglass septic system of comparable size and in the same location as the existing system.However,due to construction access issues,staging,and logistics,an amendment to the prior exemption has been requested to allow for the access of construction related vehicles/materials waterward of the ordinary high water mark,on a one-time short term basis.The proposed repair work is described in your April 15,2008 letter. Pursuant to the State Shoreline Management Act and the City of Federal Way Shoreline Master Program, your amended proposal is exempt from the Shoreline Substantial Development Permit process requirements based on the terms and conditions identified below.The proposal to use the beach areas for access to assist in the replacement and repair of the failed septic system is classified as"normal maintenance or repair of existing development"per Washington Administrative Code(WAC) 173-27- 040(b). Pursuant to WAC 173-27-040(e),local governments may attach conditions to the shoreline exemption to ensure consistency of the project with the Shoreline Management Act and the local master program.The amended conditions below are established to ensure consistency with the local master program and the Shoreline Management Act. CONDITIONS OF APPROVAL 1. Construction materials and debris shall not be stockpiled or disposed of on the beach. 2. The duration of construction access through the upper 20' (waterward)of the ordinary high water mark shall be limited to 1 DAY between the normal construction hours of 8:00am to 6:00pm Monday through Friday. Use of the beach for construction access and materials delivery(backfill and 3 septic tanks)shall be restricted to the exempt repair/maintenance of the failed septic system ONLY. 4. Applicant shall obtain any necessary right-of-way permits associated with accessing the beach. 5. Spill response kit and spill containment shall be onsite prior to accessing the beach. 6. Disturbed shoreline areas shall be restored to original conditions within 24 hours of completing materials delivery. 7. Applicant will schedule a final inspection of the beach access area with the planner 48 hours in advance of the start of work for the purposes of verifying that the beach areas have been restored to pre-existing conditions. The proposed action is also categorically exempt from the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(3),repair,remodeling,and maintenance activities. The King County Healthpepartment will not allow us::'to have a grinder pump installed because the particulates will enter the drairnf eld system and clog it. This type of a system is effective for a sewer system, but is not feasible for a septic system. We understand the City's requirement that the septic system must be set back 50'from the high water mark. fiver,Vve are trying to repair the existing system that was already installed prior to this requirement.
