Per Federal Way Revised Code(FWRC) 19.145.110: 19.145.110,"Exemptions" "The following activities and developments are exempt from the provisions of this chapter. All exempted activities shall use reasonable methods to avoid potential impacts to critical areas. An exemption from this chapter is not an endorsement to degrade a critical area; ignore risk from natural hazards; or otherwise limit the ability of the director to identify and abate such actions that may cause degradation to a critical area. "(1) Activities and development in response to emergencies that, in the opinion of the director, threaten public health, safety or welfare; or that pose an immediate risk of damage to property and that require remedial or preventative action in a timeframe too short to allow for compliance with the requirements of this chapter. In the event a person determines that the need to take emergency action is so urgent that there is insufficient time for review by the department,such emergency action may be taken immediately.The person undertaking such action shall notify the department within one working day of the commencement of the emergency activity.The director will determine what, if any, mitigation shall be required to protect health, safety, welfare,and environment and to repair any resource damage." The project description is as follows: Request is to install a chain link fence(like existing)on our property line fencing in the wetland buffer.The purpose of the request is to stop the homeless camps from moving onto Frito Lay's property causing hazardous conditions for anyone who may wander onto the wetland buffer and to protect the wetlands. We would propose to install the same type of fencing as the rest of the property is fenced as it's extremely difficult to climb and/or cut. We would propose leaving the existing fence so the addition of the new fence would basically enclose the wetland buffer protecting it from any intruders. Mr.Sorenson June 19,2017 Page 2 CONCLUSION The city reviewed the request and supporting materials along with applicable sections of FWRC 19.145, and finds that placement of the fence within the wetland buffer qualifies for an exemption as the development is in response to an emergency that threatens public health, safety,and welfare and is also an immediate risk of damage to property that requires preventative action. In accordance with FWRC 19.145.110.1,the requested activity qualifies for a Critical Areas Exemption and is hereby approved.This approval does not exempt the project from other local,state,and federal permit requirements.
