The city's Department of Community Development is in receipt of your request to modify the approved
Performing Arts & Events Center (PAEC) site plan. The project was granted Process III approval on July 24,
2015 (city file nos. 14-100496-UP & 15-103435-CO). According to the May 26, 2017, subn-dtted
memorandum (enclosed), minor modifications to site parking are requested. Subsequent to the approval of
the PAEC, the city entered negotiations with a developer for a construction project adjacent to the PAEC.
Based on the proposed portion of the PAEC property to be conveyed for the adjacent development (hotel
parcel), 16 parking spaces will be eliminated from the PAEC site. Further analysis of available off -site parking
is contained in the May 26, 2017, memorandum. As a result, it is proposed to increase the encumbrance of
the TC III parcel from 80 to 96 parking spaces to offset the 16 spaces that are being conveyed to the new
development project (hotel parcel).
The request for site plan modification is hereby approved. Pursuant to Federal Way Revised Code (FWRC)
19.15.090(3), the modification request is consistent with city codes.

Federal Way Revised Code (FWRC) Chapter 19.15.090(3)
The Director of Community Development hereby makes the tollowing tinaings purs
modification process as set forth in Federal Way Revised Code (FWRC) 19.15.090(3).
Proposal — A performing arts center is normally subject to Use Process 11 or III review pursuant to
FWRC 19.230.050. This modification proposal involves the parking lot component of the Performing
E. EvenN Center (PAEC) project that WaS previously� -ranted a Process I I I approval on July 24,
2015. Accooing to the May 16,201�7, submitted mttuorandorn (enclosed), minor modifications to site
parking are requested. Subsequent to the approval of the PAEC, the city entered negotiations with a
developer for a construction project adjacent to the PAEC. Based on the proposed portion of the PAE
property to be conveyed for the adjacent development (hotel parcel), 16 parking spaces will be 1

2. Comprehensive Plan& Zoning —Zoning for the subject site is City Center -Frame (CC-F). Performing
arts center uses are permitted in this zone subject to the provisions of the FWRC 19.230.050 "Hotel,
Convention and Trade Centers." The Federal Way Comprehensive Plan (FWCP) designation for the
subject site is City Center -Frame.
3. Site Plan Review Process —The current proposal is for a Site Plan Modification Approval
(Administrative Decision). The Director of Community Development makes a written decision on the
application based on criteria listed under FWRC 19.15.090(3).
4. State Environmental Policy Act (SEPA) —The property is within the area covered by the city's Planned
Action Environmental Impact Statement (EIS). The city confirmed the project was within the EIS scope
and issued a letter of approval on August 8, 2014.
5. Public Notice & Comment— Site Plan Modification Approval is an Administrative Decision and no
public notification is required.
6. Required YaMs�— Per FWRC 19.230.050., the project has zero foot, front, side and roar setbacks
which are nriaMeted by Movement of the eastern property fine� The code required inaxii'llum five fo
setback from the principal pedestrian right-of-way is also unaffected by the property line movement I

7. Parking— Requirements and conditions for parking were established by the July 24, 2015, land use
approval. The approval determined that the maximum demand would be 368 parking stalls and
typical peak evening demand would be 3 )3 )3 stalls. The approval identified that 383 stalls were
provided using a combination of onsite and shared offisite parking.
Adjacent parking includes 93 stalls at the Walmart parking lot, 30 stalls at Town Square Park, and 80
spaces on the TC III parcel (fon-ner Target property). The TC III parcel contains additional spaces
beyond the 80 included in the shared parking calculation. The total shared parking is 203 spaces
(93+30+80=203).
The approved site plan depicts 180 parking spaces on the PAEC property. Subsequent to the approval
of the PAEC, the city entered negotiations with a developer for a construction project adjacent to the
PAEC. Based on the proposed portion of the PAEC property to be conveyed for the adjacent
proposed to increase the encumbrance of the TC III parcel from 80 to 96 parking spaces to offset the
16 spaces that are being conveyed to the new development project (hotel parcel).
8, The application and attachments have been deten-nined to be consistent with the FWCP; all applicable
provisions of the FWRC; and with the public health, safety, and welfare. The proposed development is

compliance with future City of Federal Way codes, policies, and standards relating to this development.

PARKING DEMAND AND AVAILIBILITY
The City is currently undergoing construction of the Performing Arts and Event Center at the south east
corner of the intersection of Pete Von Reichbauer Way S and S 314th Street. As part of the approval of
the project, requirements and conditions for parking were established by the Land Use Approval dated
July 24, 2015. Those requirements were determined based on a Memorandum and Parking Study
prepared by TraspoGroup dated January 23, 2014.
The approval determined that the maximum demand would be 368 parking stalls and typical peak
evening demand would be 333 stalls. The approval further identified that 383 parking stalls were
provided using a combination of onsite and shared offsite parking.
The offsite parking included 93 stalls at the adjacent parking lot owned by Walmart at the south west
corner of the intersection of Pete Von Reichbauer and S 314th St, 30 stalls at the adjacent Town Square
Park to the south, and 80 available stalls at the adjacent TC III parcel (former Target property). The TC
III parcel contains additional spaces that were not included in the shared parking. The total shared
parking accounted for is 203 spaces.
The approved plans depicted 180 onsite spaces associated with the Performing Arts and Event Center.
Subsequent to the approval of the Performing Arts and Event Center the City has entered negotiations
with a potential hotel developer to construct a hotel adjacent to the Performing Arts and Event Center.
Based on the proposed property to be conveyed for the hotel development 16 parking spaces will be
eliminated from the Performing Arts and Event Center onsite lot.
The new total onsite parking is therefore 164 parking stalls. Combined with the available offsite parking a
total of 367 parking stalls are available, which is greater than the Land Use Approval typical peak demand
of 333 stalls.
The TC III parking lot to the north of the former Target, which is owned by the City, contains 116
parking stalls. Previously only 80 of those spaces were allocated to the Preforming Arts and Event Center
based strictly on the needs of the Performing Arts and Event Center, not as a relationship to the number
of available spaces.
It is therefore proposed and intended to increase the encumbrance of the TC III parcel from 80 to 96 to
offset the 16 spaces that are being conveyed to the hotel parcel.
