This is in response to your inquiry about whether a new/used tire shop, used car lot, or a mechanical/body
work shop is allowed at 35400 Pacific Highway South. This property is zoned Commercial Enterprise
(CE) and per Federal Way Revised Code (FVV-RC) 19.240.050 (enclosed), sales, rental, or leasing
facilities for vehicles, trucks, boats, trailers, motorcycles, and equipment are allowed in this zone.
Mechanical repair, body repair, painting, or related services for vehicles, trucks, boats, trailers,
motorcycles, and equipment are also allowed. These uses would require a Process 11, Site Plan Review, if
considered new uses or a Change of Use.
Always Affordable Auto, an automotive repair and detail business, was previously located on the site. A�
such, the proposed mechanical/body work is a similar use and would be pen -rutted upon obtaining a
Business License and complying with the Buildincr and Fire Codes.

A new/used tire shop would also be allowed upon obtaining a Business License and complying with the
Building and Fire Codes as the retail use portion is similar to a previously permitted engines sales
business. However, any outdoor storage of tires must meet the required setbacks of the Fire Code, which
are more stringent than zoning setbacks. In addition, any outdoor storage of tires must also meet the
requirements of Article IV, Outdoor Activities and Storage (enclosed), which require Process I Approval.

"Change of use" occurs when the general character of a use has been modified. This deterinination

(2) Required parking -- In order to determine if there is adequate parking, please provide the
percentage of the building to be used for car sales and how many cars for sale would be on the lot at
any one time. If more than one use is proposed for the building, please provide the square footage
devoted to each use. In addition, please provide the number of existing parking spaces.

(4) General appearance;

Please note that even though the mechanical/bodywork and tire sales are considered not to be a "Change
of Use", any improvements to the site associated with the mechanical/body work or tire sales may require
Process I approval pursuant to FWRC 9.15.03 )0 (enclosed), which addresses improvements and additions
to developed sites-
