Dear Applicant:
The City of Federal Way is in receipt of your Request for Change of Use application dated October 20,
2015.The applicant proposes to utilize the former Baden Sports facility located at 34114 2l' Ave S.
(Parcel No. 2 1 2 1 04-903 3), which is zoned Commercial Enterprise(CE), as a site for the storage of boats.
The use category is hereby defined as parking lots for storage of recreational vehicles and other oversized
vehicles.
Zoning Compliance Review Process
FWRC 19.15.025 addresses a change of use at a developed site as follows:
19.15.025 Zoning and use review process for new tenants—Change of use at a developed site. The
purpose of this section is to review and determine compliance with applicable zoning and development
code requirements when a new use is proposed to occupy an existing building or site. When a land use
changes from one use category in the zoning charts to another use category,a zoning compliance review
shall be performed as part of the use process review, when required,or in conjunction with the required
business registration and/or building permit review. Each paragraph in a zoning chart is a use category. If
the new use is in the same use category as any previous legal use of the site, no zoning compliance review
is required.
Analysis
Storage of recreational vehicles and other oversized vehicles is a new use at 34114 21' Ave S.and is
permitted pursuant to Federal Way Revised Code(FWRC) 19.240.070. The site was previously used by
Baden Sports as a manufacturing facility, which is also a permitted use per FWRC 19.240.080.The two
uses are not located within the same zoning chart use category however; therefore,a zoning compliance
review is required as indicated above.
The minimum required lot size for the storage of recreation vehicles and other oversized vehicles within
the CE zone is 1.5 acres. The subject property is 2.63 acres, thereby surpassing the minimum
requirements.
The minimum number of parking stalls required for the proposed use is decided administratively on a
case by-case basis per. FWRC 19.240.020. As the application indicates the primary use will be for
storage, and not the sale, rental, or lease of said vehicles, customer traffic and on-site employees are
expected to be minimal. With approximately sixty automobile parking stalls and three semi-truck parking

stalls, the site exceeds the minimum number of stalls required for the previous manufacturing/
warehousing use(fifty-nine stalls).The proposed use is likely to have a lower need for parking than the
previous use. It has been determined that there is a sufficient amount of parking stalls for the proposed
use.
Required minimum setbacks for the proposed use in the Commercial Enterprise zone are 20' in the front;
minimum side and rear yards shall be 20 ft. along residential zones and 15 ft. along all other zones per
FWRC 19.240.020(Note 2). Upon review, it was found that there are no abutting residential properties
and the subject property exceeds the minimum setback requirements for the proposed use.
Your zoning change is considered to be in compliance with the relevant zoning requirements and is
hereby approved.
