This letter is in response to your inquiry regarding the allowance of your business on 29015 Military
Road in an existing small shopping area zoned "Neighborhood Business" (BN). As you have described
your business provides a service of transferring art through "heat press" upon T-shirts and other garments
as requested by patrons. The activity involves taking an order, creating approved art work for your
customers, cut the art work and transfer the art upon the clothing provided you by your customers. There
are no chemicals that are used in the process, and you are not creating the clothing within your business
which would be classified as manufacturing and would not be permitted within this zone.
Your specific business is not listed as a particular use within the zoning ordinance, but our Code und
FWRC 19.215.010 permits "retail uses and services that are not specifically listed" as approved by th
Director if the use is consistent with policies of the Comprehensive Plan. Under policies for
neighborhood businesses in our Plan, LLTP-43 encourages "neighborhood retail and personal services
locate at appropriate locations where local economic demand and design solutions demonstrate
compatibility with the neighborhood." At the shop you propose to locate your business, there already
exists a small shopping mall with small retail and service business and therefore, meets this policy sin
your operation will be located in one of the existing shops.
We can establish that the service you plan to render can be considered "retail" as indicated and defined
with our Code. The Neighborhood Business zone allows for retail establishment defined as "a
commercial enterprise which provides goods and/or services directly to the consumer, where such goods
are available for immediate purchase and removal from the premises by the purchaser." Such
establishments allowed include "laundry, dry cleaning, beauty and barber, and shoe repair services"
which are intended for personal service similar to the service you offer. As you have described, the
garment will be provided for your service and the customer will take from the premises the garment being
serviced, thereby meeting the definition of "retail establishment."

Today I received a phone call from a customer who is having difficulty understanding what additional documents he
needs to submit or complete along with the Business Registration Packet to the City of Federal Way.
The customer, Jose, is the owner of ""Cuto ade"", UBI# 603-111-222 and the company prints design logos onto T-
shirts or prints custom logos for adherd ;g onto vehicles.
It seems that my customer has been informed by your office that he will need to submit/include a specific type of
document in order to complete the City of Federal Way Business Licensing process. My customer, Jose, does not know
what document is holding up his application process and has turned to our office. I assume he is referring to a permit?
Could your office please let me know what document he needs to submit.
