The Department of Community Development Services is in receipt of your March 3, 2008, request for an
Administrative Decision. The request is in regard to a property zoned RM 3600 located at 29002 Military
Road South. The submitted inquiry requests two decisions from the Department of Community
Development: (1) add fill material on the subject property adjacent to Military Road South for improved
vehicular access; and (2) remove overhanging vegetation and blackberry bushes. It is stated in your
request that your intention is to develop the subject property, and the two above -referenced items are
necessary for survey and engineering activities. Filling activities and overhanging vegetation/blackberry
vine removal is regulated under Federal Way City Code (FWCC) § 22-1091 et seq.
REsPONSE To FILL INQUIRY
The submitted inquiry stated the subject property's grade is lower than the adjacent right-of-way (Military
al o stated that the amount of fill would be less than 100 cubic yards. FWCC § 22-1093(13) is the
relevant portion of the City's zoning code pertaining to your fill request. The following seven criteria
must be met to be permitted outright:
1. The subject property contains a permanent building or an active use.
2. The action will not change stormwater or groundwater conveyance.
3. The proposed action is outside any area that is within the j unisdiction of FWCC 22-1221 et seq.
(Critical Areas).
4. In any one-year period, not more than 100 cubic yards of fill material is deposited on the subject
property.
5. No significant trees are to be removed.
6. If the subject property is two acres or larger and has more than 20 percent or more vegetation, the
land surface modification will not remove more than 20 percent of that native vegetation.
7. The land surface modification will not result in more than a two -foot increase or one -foot
decrease in the average elevation of the subject property.
According to the City's database and zoning map, the subject property is currently vacant and does not
contain a pen-nanent building or active use (criteria 1). Also, the City's critical areas inventory indicates
that a Category 11 wetland occupies a substantial portion of the subject property (criteria 3). Since the

approved development permit or via discretionary approval pursuant to FWCC § 22-1094, which requires
Process III land use approval -
OVERHANGING VEGETATION AND BLACKBERRY VINE REMOVAL
In addition to the fill material request, your inquiry also stated the need to remove overhanging vegetati
and blackberry vines to assist the needs of survey and engineer technicians. Due to the Category 11
wetland occupying most of the subject property as delineated on the City's Critical Areas map, only
minimal clearing can be authorized. FWCC § 22-1093(5) allows "exploratory excavations under the
direction of a professional engineer licensed in the state; provided, that the extent of the land surface
modification does not exceed the minimum necessary to obtain the desired information." Removal of
vegetation is limited to what is necessary to survey the property and must be supervised by a profession
engineer.
