Vehicle Service Station, 28718 Military Road South, Federal Way
Dear Mr. Malik:
The Department of Community Development Services has received your inquiry regarding a potential
vehicle service station located at 29718 Military Road South. The comprehensive plan and zoning
designation of the subject property is Neighborhood Business (BN). Vehicle service stations are an
allowed use in BN zones, but limited to one station per intersection. According to available King County
records and the city's permit database: the existing vehicle service station improvements were built in
1969 the city issued a demolition permit April 6, 2005, to remove the fueling systems piping, electrical,
puraps, underground storage tanks, and concrete slabs; and the demolition activities were inspected and
fi-nalled August 8, 2008.
RESPONSE
The following are responses to four items referenced in the June 18, 2010, email to department Director
Greg Fewins regarding several zoning issues related to re -opening the vacant vehicle service station
located at the above -referenced address. In the interest of clarity, I have paraphrased your questions in
bold type with a response below. I
1 . What is the maximum threshold for alterations that can be made to the existing structure?
The vehicle service station is a nonconforming use due to another station located on the northwest
comer of the intersection of 288th Street and Military Road South. In order to continue the service
station use pursuant to Federal Way Revised Code (FWRC) 19.30.080, the following two
thresholds apply: (1) -no structural alterations or increases in gross floor area are allowed, and (2)
changes or alterations, other than normal maintenance, in any one consecutive 12-month period ti
any structure is limited to 15 percent of the assessed or appraised value.

the building in excess of the 15 percent threshold are necessary. Replacement of the fitel purnps
and canopy would not be considered an expansion of gross floor area provided the replacement
pumps and canopy are similar in quantity and size to the previous service station.
Any structural modifications to the exterior wall would exceed a nonconforming use threshold as
referenced above; therefore, no structural modifications would be permitted.

3. What are the landscaping requirements?

4. What types of city permits are required?
Any replacement structures such as a fuel pump and canopy will require a Process I Master Land
Use application. The city will require building permits for the improvements needed to occupy
the building. An environmental checklist and public notice pursuant to State Environmental
Policy Act (SEPA) procedures will be required if underground tanks with a total capacity greater

to SEPA review. Applicants may request to waive preapplication meetings by submitting a letter
to the Director of Community Development Services. Please contact the city's Permit Center at
253-835-2607 for specific permit requirements.
Please contact Lakehaven Utility District at 253-941-1516 for water/sewer connections and South
King Fire & Rescue at 253-946-7248 for fire prevention requirements.

I like to conform per our meeting We can open the gas station on following conditions.
1) Can make change up to 15% of exiting value in building.
2) No outer wall of building can not be be change.
2) we need to maintain the landscaping.
3) Gas tank permit Etc can be obtain after submit the plan and paid fees to City.
