The existing single-family residence at this site is located in a Commercial Enterprise(CE)zoning district. A single-family residence is not a permitted use in the CE zone; however, the existing single- family residential use at the site is considered a legal non-conforming use. In response to your question about rebuilding the structure if destroyed, Federal Way Revised Code (FWRC) 19.30.200(below)would apply. 19.30.200 Special provision for damaged improvements. If a nonconforming use or development is damaged by sudden accidental cause, that use or development. including associated improvements, may be reconstructed if it meets the following requirements: (1) The use or development, including associated improvements, as reconstructed, is not cmv more nonconforming than it was immediately prior to the damage. (2) The applicant applies for building and any land use permits to reconstruct the damaged improvement within six months of the date of the damage and reconstructs the improvement pursuant to such permits. Since we share the fax machine with multiple divisions, it's possible that someone inadvertently picked them up and failed to pass them on to us. We apologize if you were given misinformation regarding fees. You may have spoken to a planner, and they are not necessarily familiar with submittal requirements. We checked with the Planning Manager and, because the properties are essentially adjacent to one another, he approved us charging a single fee of$100.50 for both.
