The Process I application is a request to modify Heritage Woods preliminary plat condition #5 by replacing the double tennis court with a minimum improvement of a 140' X 200' irrigated, soil amended lawn area graded and seeded to Parks Department standards and 12 park trees; additional park amenities will be constructed by Parklane if any of the $50,000.00 budget remains after the lawn area and trees are installed. The request also includes dedication of the open space tract with recording of Heritage Woods Division I, and park improvements are to be completed by Parklane within 12 months of the recording of Heritage Woods Division I, but in no event later than the recording of Heritage Woods Division II. The proponent of this Process I land use application is the City of Federal Way Parks, Recreation, and Cultural Services Department. The city will be responsible for operation and maintenance of the public park facility when constructed by the developer (Parklane Ventures), and accepted by the city. David Morrison of Parklane Ventures is the developer of Heritage Woods. In a September- 19, 1996, letter to Barbara Simpson of the Parks Department (enclosed), Mr. Morrison agreed to the revision of preliminary plat condition #5 as proposed. There shall be $50, 000.00 expended for construction and material and the developer shall provide records at no cost to the city of all labor, materials, and equipment associated with the park development. Additional park amenities will be constructed by the developer if any of the $50, 000.00 budget remains after the lawn area and trees are installed. The Parks Department will provide the park improvement design of the lawn area, trees, and irrigation system at no cost to the developer. The developer will also erect a sign or monument regarding "Old Military Road" as approved by the Parks, Recreation, and Cultural Services Department Director. Prior to final plat approval of Heritage Woods Division I, the developer shall post a $50, 000.00 bond to ensure construction of the improvements. The open space tract shall be dedicated to the City of Federal Way with recording of Heritage Woods Division I, and the park improvements shall be completed by the developer within 12 months of recording of Division I, or by recording of Division II, whichever is first. Any person with the right to appeal the decision may request the Director of Community Development Services to reconsider any aspect of the decision by delivering a written request for reconsideration to the Department of Community Development within seven calendar days after the date of issuance of the decision. The request for reconsideration shall specify what aspect of the decision to be reconsidered and the reasons for the request. The decision of the director may be appealed whether or not there is a request to reconsider the director's decision. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services, 33530 1st Way South, Federal Way, WA, within 14 calendar days after issuance. The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusions of the Director of Community Development Services disputed by the person filing the appeal. Any additional requirements of FWCC Section 22-397 must also be followed. BACKGROUND Pursuant to City Council Resolution 92-122, application for minor modifications to the preliminary plat of Heritage Woods are subject to the procedures of the Federal Way City Code (FWCC) Chapter 22, Article 6, Use Process I. Under Use Process I, the Director of Community Development Services renders a written decision after considering all of the information and comments submitted on the matter and based upon the decisional criteria in FWCC section 22-394. The criteria includes the following: 1. It is consistent with the Comprehensive Plan; 2. It is consistent with all applicable provisions of the zoning code; and 3. It is consistent with the public health, safety, and welfare. Heritage Woods Preliminary Plat Modification Request — UPR96-0032 Page 2 FINDINGS The site is located in a Residential Single Family (RS9.6) zoning district. The site is designated Single Family High density in the 1995 Comprehensive Plan "Cityshape". 2. Heritage Woods preliminary plat was approved by the City Council on October 22, 1992. The subject open space tract of the Heritage Woods preliminary plat (exhibit 2) will be dedicated to the City of Federal Way and is approximately 4.1 acres in size. 4. The 1992 preliminary plat approval was conditioned to include construction of a double tennis court facility. The tennis court condition of the preliminary plat approval was at the request of the city's Parks, Recreation, and Cultural Services Department. Public parks in residential zones require Process III land use review. Condition #5 of the preliminary plat approval and the park condition were discussed in the 1992 staff report and City Council preliminary plat approval for Heritage Woods. The preliminary plat review and approval included review and approval of the public park under Process III review. 6. Pursuant to City Council Resolution 92-122, application for minor modifications to the preliminary plat of Heritage Woods are subject to the procedures of FWCC Chapter 22, Article 6, Use Process L 7. The request to change the condition of preliminary plat approval (from a double tennis court to amended lawn and tree area) is a minor modification using the decisional criteria in FWCC section 2-113(e) as follows: a) The change will not increase or change the residential density of the plat. b) The change will not result in the relocation of any access point to any exterior street from the plat. c) The change will not result in any loss of buffering or open space area, the change may result in the initial loss of additional trees internally in the plat, however, additional trees are proposed to be planted with the revised proposal. d) The change does not significantly alter the project. If approved, park facilities for a larger segment of the population will be provided due to the general nature of the open field area compared to a tennis court. Adverse impacts and undesirable effects will not result from modifying the physical park improvements from a tennis court to an open grass field. The city will be responsible for operation and maintenance of the public park facility when constructed by the developer (Parklane Ventures), and accepted by the city. 9. David Morrison of Parklane Ventures is the developer of Heritage Woods. In a September 19, 1996, letter to Barbara Simpson of the Parks Department (exhibit 3), Mr. Morrison agreed to the revision of preliminary plat condition #5 as proposed. 10. The Community Development Services Department published a notice of subject request in the Federal Way News on September 28, 1996, posted three notice boards along Military Road South, and at each of the official notification boards of the city. The 14 day comment period expired on October 14, 1996. No written or verbal comments were received regarding the application. 11. The Heritage Woods preliminary plat was submitted for application in 1991, and reviewed under the 1990 Comprehensive Land Use Plan, and the 1991 Comprehensive Park, Recreation, and Open Space Plan. The application to revise condition #5 of the preliminary plat was received in August 1996, and is being reviewed pursuant to the City of Federal Way 1995 Comprehensive Park, Recreation, and Open Space Plan. 12. The City of Federal Way 1995 Comprehensive Park, Recreation, and Open Space Plan identifies in section VII, page 39, that the proposed Heritage Woods public park is classified as a Neighborhood Park. 13. Section VI, page 2, of the comprehensive park plan identifies that under Standard Neighborhood Park Policies (SNP) 4, appropriate facilities for neighborhood parks include: • Children's playground. • Unstructured open play area for general recreation. • Paved game court. • Picnic area. • Trail system. • Natural open space. • Drainage corridors. • Other possible facilities: restrooms, picnic shelter buildings, and tennis courts. Tennis courts are not generally located at neighborhood parks due to the small size of neighborhood parks, and the limited user base of tennis courts. Unstructured open play areas are common facilities for neighborhood parks. Heritage Woods Preliminary Plat Modification Request — UPR96-0032 Page 4 14. Under section VI, page 3, of the parks plan, tennis courts are identified as an appropriate facility at a community park, which are larger and serve more population than a neighborhood park. 15. Condition #5 of the Heritage Woods preliminary plat approval also requires the developer to provide signage regarding the historical aspect of Old Military Road. This application does not request to modify the condition of signage for Old Military Road, and this element still applies to the project. 16. The revised proposal embodies design principles that protect the public health, safety, and welfare by providing a public play field accommodating a wider variety of the population beyond users of tennis courts. CONCLUSIONS The proposal has been reviewed for compliance with the Federal Way Comprehensive Plan, the Federal Way Comprehensive Parks, Recreation, and Open Space Plan, pertinent zoning regulations, and other applicable city regulations. The proposal meets the decisional criteria of Process I review. Based on the findings and conclusions of this review, approval of the condition modification is recommended and the revised condition #5 is shown below. This decision shall not waive compliance with future City of Federal Way codes, policies, or standards relating to this decision. Agreement was reached to dedicate the active open space to the City as a neighborhood park and to construct a double tennis court on the south portion of the park tract. This agreement was upheld by the Hearing Examiner. Subsequent to 1992, the developer refined plans and took the project through the permitting process. Parklane also requested reconsideration of the tennis courts in exchange for park improvements of equal value ($50,000). The tennis court location was inspected and found to be an exceptional location for a formal field area due to its siting at the top of the hill and having peek views of the Sound. The Parks Department would like to have the flexibility to work with the developer to create a park that would be as finished as possible within the budget of $50,000. The formal field and trees would be the first priority but other improvements that would be desirable if there is any leftover budget would be a play area or a trail with fitness stations. The improvements would lead more quickly to a finished usable park than the single improvement of tennis courts in an otherwise undeveloped setting.. The plan could also allow for future court development in a portion of the site that would be further from houses and not obscure views with chain link fencing. Committee Recommendation: The Parks Department requests Council support to work with Parklane for development of a formal field area and other improvements instead of the existing plan for a double tennis court improvement. First question: Can the condition requiring a tennis court facility be changed to a neighborhood park through an administrative procedure? Answer: Yes, as specified in the resolution adopting the preliminary plat, Procoq I is the procedure for minor modification of the plat. Process I decisional criteria V contained in FWCC section 22-394. a[L[ We would need drawings of the neighborhood park to process the application, and $1,333.00 application fee if Parklane is the applicant. Second question: Must the park be completed in conjunction with final plat of phase I of Heritage Woods? Answer: Last August when David Morrison proposed phasing the plat, we determined what requirements would need completion for phase I and phase II. Your letter dated August 10, 1995 to David Morrison stated the park improvements are to be completed in conjunction with final approval of Phase I. I don't have a problem if you are reconsidering the time line for park improvements to allow completion in conjunction with phase II of the plat. A financial guarantee by the developer is appropriate if we defer the park improvements to the second phase. Let me know if you have any other questions or comments.
