FILE Background The St. Luke's Lutheran Church Wetland Buffer Reduction request submitted in March 2009 (file #09- 10103 l-UP) proposed that a wetland buffer be reduced from 50 feet to 25 feet. The wetland and associated buffer are located • the St. Luke's Lutheran Church property, as well as • the New Hope Church property. When the formal application was submitted • St. Luke's Lutheran Church, city staff was advised that both churches were in discussion regarding New Hope Church's participation in the wetland buffer reduction project. These discussions continued during the time that the City issued an environmental decision for the wettand buffer reduction request, and the discussions were reflected in the staff report prepared for the environmental determination in case New Hope Church formally elected to participate in the wetland buffer reduction request. the request. In the end, the City issued Process JII approval for reductiOn of the wetland buffer for only those portions of the wetland buffer located on the St. Luke's Lutheran Church property.' New Hope Church must submit a separate new wetland buffer reduction request. Wetland Buffer —Reduction the New Hon Church site is degraded with vigorously growing, invasi-L'n species including blackberries. Generally, reduced wetland buffers are required to be cleared of invasive species, restored, and planted with native plant species. In order for New Hope Church to obtain wetland buffer reduction approval, the following must be addressed: 1 The application for the St. Luke's Church Wetland Buffer Reduction Request contained only signatures and title reports for the St. Luke's Church site. Formal authorization from New Hope Church was never received, thus this property was not included in the land use decision. File #10-105371-00-AD Doc, I.D. 56809 ISHMERMOMM Revised Code (FWRC) 19.40. A preapplication waiver may be granted per FWRC 19.40.030, "Exceptions." Note that information from the St. Luke's wetland buffer reduction preapplication conference (file #08-105633-PC) is included with this letter. ......... r------ Review Process — Process III Project Approval is used to review the wetland buffer reduction request. The request also requires review under the State Environmental Policy Act (SEPA). Under Process 111, the Director of Community and Economic Development makes a written decision on the application based on decisional criteria listed under FVvrRC, including 19.65.100(2). A SEPA checklist (enclosed) must be submitted and reviewed prior to the City issuing an environmental threshold determination, and environmental review must be concluded before the Process HI approval is granted. Public Notice — All property owners within 300 feet of the site are notified of the land use application and the environmental decision. Notification includes comment and appeal periods. The formal applications must be accompanied by a total of two sets of stamped mailing envelopes, prepared in 3 accordance w6ft City's �"uitements. Both envelope sets ShAll be addressed to all owners of real property located within 300 feet of site boundaries. In accordance with the City's procedures, all envelopes must contain the Department of Community and Economic Development's return address (33325 8h Avenue South, Federal Way, WA 98003-6325). A paper list of addressees is required to be submitted along with the envelopes, in addition to an assessors map with the 3 00-foot boundary depicted. 5. Application Fees —Process III review fees are $2,392.00 and SEPA review fees are $948.00. A completed and signed master land use application (enclosed) must be submitted with the formal application. 6. Wetland Report and Peer Review — The regulated wetland is situated on the western portion of the New Hope Church property. The wetland delineation prepared by Sewell Wetland Consulting, Inc. for the St. Luke's Church wetland buffer reduction project only contained delineation of this portion of the wetland; no other information about this portion of the wetland was provided. A formal report that addresses wetland buffer reduction criteria (FVTRC 19.175.040[5] [a through c]) and a mitigation plan for the New Hope Church site must be submitted with the formal application. The City will use their contract wetland consultant to review the New Hope Church wetland buffer reduction proposal, first requesting an estimate of review fees. The estimate would be forwarded to your attention for payment in advance of any review. The report must at a minimum list the size of the wetland, fully document existing conditions of the buffer on your property, and fully address the decisional criteria, including any recommended conditions for wetland buffer reduction, including recommendations for invasive species removal. A table of contents or index is requested. 2 Fifty -foot buffers apply to Category III wetlands that are over 10,000 square feet in area, while 25-foot buffers apply to Category III wetlands that are between 2,500 and 10,000 square feet in area. 3 See the City handout titled Mailing Labels (enclosed). Implementation — Following approval of the wetland buffer mitigation plan, the applicant is responsible for invasive species removal and installation of wetland buffer enhancements. Wetland buffer mitigation will be monitored for a period of five years from the date of completion. The applicant shall obtain the services of a qualified wetland biologist to conduct the buffer monitoring. In addition, the applicant will be required to post a performance and maintenance bond for the wetland buffer mitigation work, which shall be in place before any mitigation work begins.
