On November 2, 2004, the City of Federal Way Department of Community Development Services
received your request for legal lot recognition of a 1969 four -lot short plat of tax parcel number 302104-
9034. The City has reviewed the documentation you have submitted, specifically the King County
Engineer's Subdivision Application Numbered 07283, approval for which was granted by King County
*iiwLwr4.2 ' 1269. The Cit4i concurs that the 1969 subdivision application for the subject property is valid,
and that four lots and one 30' x 660' access easement exist on the subject property.
To this end, the City hereby issues a Letter ofDirective to the King County Assessor's Office for the
segregation of the property per the approved June 12, 1969, subdivision application, for the purpose of
obtaining individual tax lot numbers.

Those Lots underlie and are completely contained within the above referenced Subject
Property which is currently identified on the King County Assessor's Map as Tax
Account Number 34.

The Applicant, Fitchard, originally identified six (6) lots for approval (Numbered I
through 6).
King County correctly noted under the Conditions/Reasons Stipulation that lot #1 on the
Application was already recognized as a previously created legal lot.
(To Wit: "Lot deeded to son is not included in number of lots allowable (4).
The County further noted under the Conditions/Reasons Stipulation that lot # 2 on the
Application was merely a roadway and needed to be identified as an easement - not a lot.
(To Wit: "Private Road must become a recorded easement to serve butting lots. ")
Ultimately, the County approved four (4) lots contained within the Application that were
identified as follow: Lot #3, Lot #4, Lot #5, and Lot #6.
Under the Application's Conditions/Reasons Stipulation, the County noted the new
Short -Subdivision Law's provision that provided for 4 or fewer lots.
(To Wit: "However, only 4 lots are allowed under Short Platprocedure.
The County was then guided by the new Short Subdivision Laws of the State of

effect (August 12, 1969).
By the way, this was one of the first times the County had actually identified and
approved such a subdivision application as a "Short -Plat".
A special note was attached for the King County Building Department that stated,
"Easement must be recorded with the County Auditor".
N.B. Prior to the 1974 State Recording Act, King County did not require these old Short
Subdivisions to be recorded nor was it the practice to 10 so.

Lot numbered 3, 4, 5, and 6 noting that they were legally subdivided and approved by tHe
County on June 12, 1969 under the applicable subdivision laws of the State of
Washington and King County in place at the time of approval. I

Office in order that we may receive individual tax lot numbers.

The applicant has requested that the City recognize the enclosed 1969 short plat of the subject property.
Based on the documentation submitted, it seems acceptable to me, but I thought I should run this past law to
be sure I'm not missing something. I'll put in a call to King County to see if they have an idea why the four
lots never showed up on the accessor's map.
