March of 2014 through a donation, so we have no prior knowledge or history of the site. Upon receipt of the property we walked the site with a relative of the previous owner and saw the pump in question and observed that it was not functioning. The City has not operated the sump pump nor would we. We recently turned the breaker off and will remove the small pump when we have time to work it into the schedule. We have no idea how long the sump pump has been in the current location. One could guess with the pump and flex hose attached that there must have been some ponding and that was a juried rigged method of the past resident to disperse the water? We also reviewed the ALTA/ACSM Land Title Survey (land survey) that shows the wetland delineated on the property. The purpose of this peer review is to provide a professional opinion regarding applicable regulatory requirements in the City of Federal Way Revised Code (FWRC) Title 19, specifically under Peer review comments regarding the Critical Areas Report and land survey include: I . Landau Associates wetlands staff conducted a reconnaissance of the onsite portion of the wetland (identified as Wetland A) on August 19, 2015, and agree with the boundary determination, which generally follows slope of depression. 2. During the reconnaissance, staff from Landau Associates observed dead vegetation on upland inclusions within the wetland and uprooted trees. This may be due to wetter normal conditions that may have occurred as noted in the report, however it is also noteworthy that the region is in a declared drought (Ecology 2015), which may also affect vigor of vegetation observed during the reconnaissance. I The Critical Areas Report includes data forms for four sample points, and the land survey only identifies two of the four sample points. While not a requirement of the FWRC, we recommend that all sample point locations be identified on the land survey. 4. Landau Associates agrees with the wetland rating. The Critical Areas Report identifies the required buffer width associated with the rating of the onsite wetland, and while not a requirement of the FWRC, we recommend that the buffer be included on the land survey. 5. The Critical Areas Report includes a number of figures, and we suggest scales be included on figures, particularly to support evaluation of critical area conditions within 225 feet of the subject property in accordance with FWRC 19.145.410(2). 6. The Critical Area Report provides discussion of USDA Soil Survey information and references that the mapped soil series (i.e., Everett-Alderwood gravelly loam) on the property is not considered a hydric soil in a publication dated 1991. Soils identified in sample plot DP#3 are identified as a sapric muck. As'detailed in the USACE Regional Supplement to the Corps of Engineers Wetland Delineation Manual.- Western Mountains, Valleys, and Coast Region (USACE delineation manual; USACE 2010), the determination of mucky soil material is difficult to distinguish without laboratory testing, however, Landau Associates staff observation of wetland soils in a portion of the onsite wetland appear to satisfy the field procedures for determining the texture of soil materials high in organic carbon provided in the USACE delineation manual. 8. Based on presence of hydric soils and maturity of wetland vegetation, it appears that that changes of hydrology noted have not caused significant change to the forest wetland type. Applicant may elect to further monitor hydrologic conditions to determine wetland extent, which could require several years of monitoring (refer to USACE 2005). �M This technical memorandum has been prepared for use by the City of Federal Way in evaluating the adequacy of the Critical Areas Report for the 35505 Pacific Highway South property. The focus of this review was the wetland delineation. The purpose of the review was to assess the adequacy of the submitted documents for compliance with City requirements as promulgated in FWRC Title 19 and conformance with conventionally accepted critical areas delineation practices. The applicant (Clerget Evergreen LLP) is interested in developing the property, and has requested a review of the wetland delineation completed for the site to establish usable/unusable areas of the property. A Critical Areas Report prepared by Sewall Wetland Consulting, Inc. (dated June 25, 2015) and survey prepared by Barghausen Consulting Engineers, Inc. (dated June 25, 2015) have been provided to the City documenting conditions on the property. We understand that the City is requesting peer review of the Critical Areas Report. We have recently completed a wetland study and delineation with a report done by Sewall Wetlands Consultants. The delineation and report were done in accordance with Federal Way's Critical Areas Ordinance adopted June 301h 21015. 1 had previously discussed that since the Hylebobos wetland buffers have been clearly defined relative to our property boundaries by the delination of the Storage Facility project adjacent to and north of our property, we have included that information from their approved site plan along with other mapping information. Our purpose for this submittal is to define the wetland area, it's classification and its associated buffers, and to establish and record the usable and unusable areas of the property. When the property was purchased there was no standing water on it. Now there is and as the report indicates, there are signs of a change in hydrology. The report also notes a pump located on the City's Brooklake property at the NW corner of our parcel. There is some makeshift piping that evidently was used to pump water out of a sump and onto our property. The site was reviewed using methodology described in the Corps of Engineers Wetlands Delineation Manual (Environmental Laboratory, 1987), and the Western Mountains, Valleys and Coast region Supplement (Version 2.0) dated June 24, 2010, as required by the US Army Corps of Engineers. Soil colors were identified using the 1990 Edited and Revised Edition of the Munsell Soil Color Char-ts (Kollmorgen Instr-uments Corp. 1990). The Corps of Engineers Wetlands Delineation Manual/Regional Supplement all require the use of the three -parameter approach in identifying and delineating wetlands. A wetland should support a predominance of hydrophytic vegetation, have hydric soils and display wetland hydrology. To be considered hydrophytic vegetation, over 50% of the dominant species in an area must have an indicator status of facultative (FAG), facultative wetland (AC), or obligate wetland (OBL), according to the National List of Plant Species That Occur in Wetlands: Northwest (Region 9) (Reed, 1988). A hydric soil is "a soil that is saturated, flooded, or ponded long enough during the growing season to develop anaerobic ' conditions in- th 'e- uppe- r p- ar"f'.- Anaerobic conditions are indicated in the field by soils with hydric features such as iron oxide mottles; hydrogen sulfide odor and other indicators. Generally, wetland hydrology is defined by inundation or saturation to the surface for a consecutive period of 12.5% or greater of the growing season. Areas that contain indicators of wetland hydrology between 5%-12.5% of the growing season may or may not be wetlands depending upon other indicators. Field indicators include visual observation of soil inundation, saturation, oxidized rhizospheres, water marks on trees or other fixed objects, drift lines, etc. Under normal circumstances, indicators of all three parameters will be present in wetland areas Clerget/#15-143 Sewall Wetland Consulting, Inc. It is undetermined what has caused this change in hydrology. It is possible the pump and hosenoted earlier coming in from the northwest comer of the site has been pumping substantial amounts of water into the site which has caused this�lchange in the wetland� it is also possible the newly developed area to thenorth has somehow changed the hydrology of this area either trapping more water on the site that may have drained on the surface or subsurface to the north, or just changing subsurface onditions from the construction, or seepage from the storm ponds. It is clear that some recent change has impacted this wetland eas that -had uplan& plants suchas elderberry were observed to have water marks of deep ponding up to 12" deep. Soils were saturated to within 6" of the surface in the lower portions of the wetland during our site inspection. It appears ponding up to 18" occurs now in this wetland based upon water and sediment marks on vegetation. Using the US Fish and Wildlife Wetland Classification Method (Cowardin et al. 1979), this wetland would be classified as PFO 1 C and PSS 1 Using the WADOE Wetland Rating System for Western Washington 2014 Update, i rating the wetland as a depressional wetland, this wetland "Wetlandscored a total of 17 points with 4 points for habitat, This indicates a Category III wetland. To be considered hydrophytic vegetation, over 50% of the dominant species in an area must have an indicator status of facultative (FAC), facultative wetland (FACW), or obligate wetland (OBL), according to the National List of Plant Species That Occur in Wetlands: Northwest (Region 9) (Reed, 1988). A hydric soil is "a soil that is saturated, flooded, or ponded long enough during the growing season to develop anaerobic conditions in the upper part". Anaerobic conditions are indicated in the field by soils with hydric features such as iron oxide mottles; hydrogen sulfide odor and is indicators. Generally, wetland hydrology is defined by inundation or saturation to the surface for a consecutive period of 12.5% or greater of the growing season. Areas that contain indicators of wetland hydrology between 5% - 12.5% of the growing season may or may not be wetlands depending upon other indicators. PA o 7377=rja�� According to the WDFW Priority Habitat Website with Public access layers activated, there are no priority habitats or species use noted on the site. The closest mapped priority habitat is the large wetland to the wets of the site approximately 300'associated with Hylebos Creek. Clerget/#15-143 Sewall Wetland Consulting, Inc. June 25, 2015 Page 7 A small pump with a hose directed onto the site and towards the wetla was noted coming from the City owned property just west of the northwest corner of the site. We are unclear what this feature is, however it does appear that it was pumping presumably water throug crtland • h the hose that lays aoss onto the site and towards the weat sorn time. I Soil pits excavated in the upland portion of site were generally found to have dry, gravelly loam soils with soil colors of 1 OYR 3 / 3-3 / 4. S L 'ound to be dry within the upper 16 during our observations. A single isolated forested wetland was observed along the north side of the site. Below is a description of this feature; Wetland A is a 21,839sf scrub -shrub and forested depressional wetland located on the north central portion of the site. This wetland was flagglo with wetland flags A 1 -A 19. The wetland is forested with an overstory of Oregon ash and red alder with an understory of crabapple, hardhack, red -osier dogwood and salmonberry. The wetland has the appearance of a wetland that has suddenly become wetter than normal. This change is evidenced by recently killed dead shrubs and trees within the long ponded portions of the center of the wetland, as well as mature trees within the wetland which have recently become uprooted from being inundated. It is undetermined what has caused this change in hydrology. It is possible the pump and hose noted earlier coming in from the northwest corner of the site has been pumping substantial amounts of water into the site which has caused this change in the wetland. It is also possible the newly developed area to the north has somehow changed the hydrology of this area either trapping more water on the site that may have drained on the surface or subsurface to the north, or just changing subsurface conditions from the construction, or seepage from the storm ponds. It is clear that some recent change has impacted this wetland as areas that had upland plants such as elderberry were observed to have water marks of deep ponding up to 12" deep. June 25, 2015 Page 8 Soils within the wetland were found to be a mix of low chroma sandy loams to a sapric muck in the low central portion of the wetland. Soils were saturated to within 6" of the surface in the lower portions of the wetland during our site inspection. It appears ponding up to 18" occurs now in this wetland based upon water and sediment marks on vegetation. Using the US Fish and Wildlife Wetland Classification Method (Cowardin et al. 1979), this wetland would be classified as PFO 1 C and PSS 1. Using the WADOE Wetland Rating System for Western Washington 201-4. Update, and rating the wetland as a depressional wetland, this wetland scored a total of 17 points with 4 points for habitat. This indicates a Category III wetland. Under City of Federal Way Ordinance 19.145.420 "Wetland rating and buffers", Category III wetlands with 4 habitat points have a buffer of 60'.
