3. The proposal is a minor improvement, modification, or addition to a site that is exempt from
SEPA review.
FINDINGS OF FACT
I . Proposal — The applicant proposes a fenced tow yard in the southwest portion of the property. The
outdoor storage area is subject to Process I review per FNVRC 19.125.170, 'Commercial and
industrial uses. 'The project includes using the existing gravel area to store towed vehicles. The
proposed improvements include the addition of a 6-foot-tall cedar fence to be installed directly behind
the existing chain link fencing on the southwest comer of the property, and to install privacy slats to
the existing chain link gates on the south side of the property.
2. Comprehensive Plan & Zoning Designation — The comprehensive plan and zoning designation for the
property is Commercial Enterprise (CE). Pursuant to F)YRC 19.240.050, tow lots are an allowed use
in the CE zones.
3. Setbacks — The setbacks from the west and south property lines are both 15 feet. The western property
line setback has been waived based on the request submitted by the applicant. The reasoning behind
this decision is due to the similar use, contiguous ownership of the subject and adjacent properties,
and lack of proposed improvements (intrusions into setback is for vehicle storage only). Therefore,
vehicles must be kept a minimum of 15 feet from the south property line. Barrier chain fencing will

be located within the fenced area to prevent encroachment of towed vehicles into the 15-foot south
setback area.
4. Screening — The proposed cedar fence will provide a solid screen of the stored vehicles.
Modifications to the existing fencing, as well as the addition of the 6-foot-tall cedar fence, will
provide sufficient screening to ensure the stored vehicles will not be visually obtrusive to surroundi
properties.
5. Community Design Guidelines — As proposed, both the existing and proposed fences comply with
FWRC 19.115.090(2); the existing chain -link will utilize privacy slats for additional screening in
addition to the proposed cedar fence. I
CONDITIONS OF APPROVAL
The required setback to the west of the proposed project site is waived contingent upon the written

the subject or adjacent property changes, and/or upon the City's request, the subject site must comply
with setback and screening regulations in place at that time.
APPEALS
The effective date of this decision is October 27,2014. or three daps from

administrative decision may appeal the decision to the Federal Way Hearing Examiner by November 7,
2014. Any appeal must be in the form of a letter delivered to the Community Development Department

located within the City of Federal Way in the County of King. Due to the nature of the property and
exception to the setback rule being made I agree that Express Towing LLC and it's agents shall abide by
the setback requirements on the West side of the property line should the parcel to the West of the
property line be sold or a significant change of use on that parcel should take place. The understood
setback requirements are fifteen feet from the property line.
