On September 4, 1991, a building permit(#91-1125 CA) was issued to remodel and expand your business. Work authorized under that permit has not been completed and no Certificate of Occupancy has been issued. Furthermore, the permit has expired pursuant to Uniform Building Code (UBC), Section 303(d), due to inactivity greater than 180 days. Currently, the building and planning sections of Community Development Services has a hold on your application for a business license. We have requested that the City Prosecutor's office issue a citation to you for operating a business without the required Certificate of Occupancy. On May 20, 1993, a meeting was held at the City of Federal Way Legal Chambers to determine the status of Federal Way Collision's permit. The following persons were present at the meeting: Carolyn Lake, City Attorney; Mary Killgrove, Administrative Legal Assistant; Hap Watkins, Senior Building Inspector; Richard Cottage, Code Compliance Officer; and Dick Mumma, Building Official. The purpose of our meeting was to come to a resolution of this matter so you could continue to conduct business while in compliance with City regulations. The following conditions were agreed to by all parties during the meeting: V 1. Application for renewal of building permit#91-1125 CA shall be submitted to the Building Official within 14 days of the meeting or by June 3, 1993. ✓ 2. The applicant will pay all fees normally associated with renewal and revision of a permit. 3. The application shall include the following revisions: V a. One hour parapet wall for entire length of the north exterior wall of the building. V b. Complete two hour parapet on east exterior wall. c. Floor plans, including framing details, for the mezzanine over the office area. d. Layout of Area Separation Walls with parapets to reduce H-4 occupancy below the 3000 square foot threshold. • 4. After issuance of the permit, work shall commence within 30 days of the meeting or by June 21, 1993. 5. Work shall be completed, inspected and approved 60 days from the date of meeting or by July 19, 1993. 6. The City shall suspended issuance of citation for occupancy violation until the July 19, 1993 deadline. 7. The City shall withdraw citation for occupancy violation if all work is completed and approved by the established deadlines. 8. The City will remove the requirement for a Fire Suppression System (sprinklers) if the plans are revised to include Area Separation Walls that will reduce each area divided by those walls to a square foot area less than the threshold square footages requiring such sprinkler's system as listed in Chapter 38 of the UBC. 9. The building and planning sections of Community Development Services shall immediately release the_ hold on the business license and allow Mr. Bjorneby to continue business until the July 19, 1993 deadline. If all work is not completed and approved by the established deadline, the City shall request revocation of the business license. Failure to comply with the conditions or deadlines established in our meeting will require the Building Official to recommend citation for occupancy violation. Mumma, CBO, the City Building Official, you were advised that you were in violation of the Uniform Building Code ("UBC") for occupancy of a building in which no Certificate of Occupancy had been issued. This letter further set forth those conditions you agreed to comply with in consideration of the City not proceeding with a criminal citation as a result of your meeting with the City on May 20, 1993. It is our understanding that you have complied with three (3) and the City has satisfied two (2) of the nine (9) conditions as follows: Condition 1. You renewed your application on June 3, 1993. Condition 2. You paid all applicable fees with the renewal permit. Condition 4. You commenced work within 30 days of the May 20, 1993 meeting. Condition 6. The City suspended issuance of a citation. Condition 9. The City authorized the City Clerk to issue the business license, subject to your satisfaction of the conditions. It is further our understanding that you have failed to comply with the following conditions as required by the May 24, 1993 letter: Mr. Robert Bjorneby January 3, 1994 Page 2 Condition 3. For the renewal application, you made hand- written revisions on your original plans indicating a 1 hour parapet wall for the entire length of the north exterior wall of the building and a 2 hour parapet wall on the east exterior wall. Both these walls have been constructed. However, Condition 3 (c) and (d) required that you submit plans, including framing details, for the mezzanine over the office area and for the area separation walls with parapets to reduce H-4 occupancy below the 3,000 square foot threshold. You have failed to submit these plans to the City. The City will review these plans to determine whether or not the mezzanine as constructed and the areas separation walls to be constructed comply with all applicable codes. As you have previously been advised by the City, the mezzanine requires, at a minimum, the installation of handrails pursuant to UBC §3306(i) and guardrails pursuant to UBC §1712 (a) . Condition 5. You have failed to complete all work and have the work inspected and approved on or before July 19, 1993. Condition 7. The City may still proceed to cite you for a certificate of occupancy violation because all work has not been completed and approved by the established deadlines. Condition 8. You have failed to either install a fire suppression system (sprinklers) as required by UBC Section 3802 (f) (2) or alternatively, construct area separation walls as required by Chapter 38 of the UBC, Table 43 (b) that will reduce each area divided by those walls to a square footage area less than the threshold square footage requiring such sprinkler systems. These area separation walls must be indicated in the plans submitted pursuant to Condition 3 (d) and must be constructed to satisfy this Condition 8. On December 10, 1993, Darrell "Hap" Watkins, Senior Building Inspector, inspected the subject property and determined that the foregoing conditions had not been satisfied. You had originally agreed to complete all of these conditions on or before July 19, 1993 . Please be advised that you must satisfy and complete all the outstanding conditions within 30 days from the date of this letter, or the City Prosecutor will issue a citation for violation of Section 303 (d) of the UBC and Section 9-29 of the Federal Way City Code, and shall request revocation of your business license. Violations of these codes may result in a maximum penalty of six (6) months in jail and/or a $5,000 fine for each continuing day of the violation.
