Thank you for participating in the preapplication conference with the City of Federal Way's Development
Review Committee (DRQ held on February 19, 2015. We hope that the information discussed at that
meeting was helpful in understanding the general requirements for your project as submitted.
This letter summarizes comments given to you at the meeting by the members of the DRC. The members
who reviewed your project and provided comments include staff from the City's Planning and Building
Divisions and Public Works Department, and representatives from Lakehaven Utility District and South
King Fire and Rescue. Where appropriate, pertinent Federal Way Revised Code (FWRC) sections are
noted and/or enclosed. The items listed below do not include all regulations applicable to the subject
proposal. In preparing your application, all pertinent portions of the city's land use code must be
consulted. In preparing your formal application, please refer to the complete FWRC and other relevant
codes for all additional requirements that may apply to your project. Various comments from other
agencies are either included as enclosures or have already been provided to you.

PROJECT DESCRIPTION
The applicant proposes a two -lot short plat on approximately 5.8 acres (252,974 sq. ft.) containing a
Category I Wetland and major streams. The property is zoned RS35.0.
MAJOR ISSUES
A summary of the major project issues follows this section based on the plans and materials submitted for
preapplication review. Accordingly, these issues may change due to modifications and/or revisions to
your plans. Major issues indicated, only represent comments that the DRC consider most significant to
your project. They do not include all of the comments provided under "Department Comments." The
major issues section is only provided as a means to highlight critical requirements or issues. Please read
the entire list of department comments in the next section of this letter.

Planning Division
• The subject property contains major streams and a Category I Wetland. The Department
requires an addendum to the wetland and stream investigation and delineation report
submitted by Landau and Associates, if the report is older than 5 years at the time of
application.
• Contact the King County Health Department regarding requirements for proposed and
existing septic systems and wells impacting the proposal.
• Please maintain the minimum lot area for Lot 2 (35,000 sq. ft.).
Public or Traffic Division
• A Transportation Concurrency permit is required per FVFRC Chapter 19.90.
• Traffic Impact Fee (TIF) payment per FVTRC 19.91.

1. Land Use Process — Pursuant to FWRC 18.30.010, short plats are an administrative decision
processed by the Department of Community Development The Director of Community Development
is required to issue a decision on the short subdivision request, confirming compliance with the
decisional criteria of FVTRC 18.30.110(2). A two -week appeal period follows preliminary plat
approval, and there is no public hearing unless an appeal is filed. I

2. Noticing Requirements — Public notice for a complete short plat proposal is required per FWRC
18.30.080. Within 14 days of issuing a Letter of Complete Application, notice is published in the
Federal Way Mirror, posted on the subject property every 500 lineal feet of property adjoining a
public right-of-way (by the applicant), and posted at the City's three designated notice boards by
staff.
0. Environmental Review (SEPA) — Short plats are typically exempt from the requirements of
environmental (SEPA) review, unless the proposal/work directly impacts lands covered by water.
Therefore, based on your preapplication submittal we believe that SEPA will not be required.

5. Open Space —Pursuant to FWRC 18.55.060(2), all residential subdivisions shall provide open space
in the amount of 15 percent of the gross land area of the subdivision (including easements, flag poles,
and tracts etc.). Under a short subdivision in 2000, the applicant paid 15% of the assessed land value
at that time in lieu of open space. Accordingly, the following provision applies:
"For lots within an existing subdivision, where open space was already dedicated or a fee in
lieu paid, the percent of open space required will be the difference between the open space
dedicated prior and 15 percent" — FVY'RC 18.55.060(2).
Therefore, no further open space fees or land dedications will be required.
6. Critical Areas
Wetlands -- A Category I Wetland and related buffers are shown on the city's critical area inventory in
relation to the subject property. In 2010 Landau Associates prepared a wetland and stream
investigation and delineation. Per FWRC 19.175.0 10, the city has determined that wetlands, may exist
on or within 200 feet of the subject property'. A wetland and stream delineation addendum is a

Streams — The northwest comer of the property contains a 23,000 sq. ft. conservation easement with
the City of Federal Way. A major stream is located within the easement, please note no land surface
modification or improvements may take place or be located in the stream or within the 100-foot
setback from the ordinary high water mark.
7. King County Health Department — Approvals from the King County Health Department (KCHD)
are required for the proposed septic system on Lot 2 (i.e. location and soil compatibility), existing
septic system, and well/spring decommissioning. The applicant must contact and obtain permits from
the agency directly (Doug Jones at do Lu_,j___C, -Up: Health ). Meeting Follow
Department approvals may determine short plat feasibility. During a short plat submittal,
requirements include approval of the proposed subdivision if the project is to be served by on -site
septic. Please see Lakehaven's comments on servicing.
Zoning Designation and Use —The subject property is located in a Residential Single Family
(RS3 5. 0) zoning district. The following outlines only a portion of the zoning regulations governing
the proposed uses in the RS35.0 zone. Detached -dwelling units are permitted within RS zones per

to submitting a Master Land Use Application.

Lot 2 complies with the lot area requirement.
9. Access — An easement shall be recorded for the shared driveway shown on the plat map for Lot 1 and
Lot 2, dimensioned graphically and described on the preliminary short plat map. The description
should include who the easement is in favor of and maintenance responsibilities, etc. Under a separate
instrument number, written documents establishing the easement must be approved by the city
attorney and filed with the King County Recorder's office (FVVRC Chapter 19.135.120).
10. Clearing, Grading, and Tree Density Requirements — A clearing and grading plan meeting FWRC
19.120.020 and FWRC 19.120.040 prepared by a licensed engineer must be submitted with the
formal short plat application, if clearing and grading work is proposed. Requirements for the plan are
found in F)ATRC Chapter 19.120.040(l) & (2). Prior to beginning clearing and grading activities, all

area shall be marked and protected per FWRC Chapter 19.120.160.
The proposal is subject to the tree density requirements of FWRC 19.120.130(l). Single-family lots
require tree densities of 25 tree/units per acre. The proposal requires 145 tree units for the 5.8-acre
site. A formal application must indicate trees to be removed or retained. A tree and vegetation
retention plan shall be incorporated into the clearing and grading drawing for construction, prepared

The plan prepared by a certified landscape architect must show a tree unit per acre calculation,
provide a tree survey (table) identifying the location, approximate size, species, number of trees/tree

accordance with FWRC 19.120.160. Existing trees and vegetation in good health, and not considered
to be invasive species, shall be retained on the subject property to the maximum extent possible
(FWRC Chapter 19.120.130). Please note retained trees typically have a higher tree unit count than
replaced.
Review FWRC 19.120.120 for minimum standards for rockeries and retaining walls. The site design
should minimize the need for rockeries and retaining walls and should not require rockeries or
retaining walls in excess of six feet in height.
C1. School Mitigation Fees —The Federal Way School District will be circulated this application. On the
date of a building permit application, school mitigation fees are assessed for all new dwelling units
($5,363 per single family home at 2014 rates). Fees are subject to change.

13. Recording — The City will record the short plat at the expense of the applicant with the King County
Recorder's office after the Public Works Development Services Division approves construction/as-
built plans. Recording of a short plat shall comply with FWRC. 18.30.300 and 18.30.280. The
applicant must substantially complete required improvements or in lieu of improvement completion a
performance bond/security may be filed with the City. All traffic mitigation fees must be paid in full
prior to recording.

Transportation Concurrency Analysis (FWRC 19.90)
1. Based on the submitted materials for one (1) additional single-family residential lot, the Institute of
Transportation Engineers (ITE) Trip Generation - 8th Edition, land use code 210 (Single -Family
Detached Housing), the proposed project is estimated to generate approximately I new weekday PM
peak hour trip. Alternatively, the applicant may submit a site specific trip generation study for the
proposed development.
2. A concurrency permit is required for this development project. The PW Traffic Division will perform
concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak
period to accommodate the proposed development. Please note that supplemental transportation
analysis and concurrency mitigation may be required if the proposed project creates an impact not
anticipated in the six -year Transportation Improvement Plan (TIP).
3. The estimated fee for the coneurrency permit application is S�� (I - 10 Trips). This fee is an
estimate and based on the materials submitted for the preapplication meeting. The concurrency
application fee must be paid in full at the time the concurrency permit application is submitted with
land use application. The fee may change based on the new weekday PM peak hour trips as identified
in the concurrency trip generation. The applicant has the option of having an independent traffic
engineer prepare the coneurrency analysis consistent with City procedures; however, the fee remains
the same.

Based on the submitted materials for one single family lot, the estimated traffic impact fee is $3,20530

of the impact fee payment amount to either building permit issuance; or to later than closing of the sale )f

the deferred fees will be recorded at the applicant's expense on each lot at the time of plat recording for
residential land divisions.
I . The applicant/owner would be expected to construct street improvements consistent with the planned
roadway cross -sections as shown in Map 111-6 of the FWCP and Capital Improvement Program (CIP)
shown as Table 111- 19 (FVV`RC 19.13 5.040). Based'on the materials submitted, staff conducted a
limited analysis to determine the required street improvements. The applicant would be expected to
construct improvements on the following streets to the City's planned roadway cross -sections:
12"' Avenue S is a Principal Collector planned as a Type "T" street, consisting of a 28-foot street
with 2-foot shoulder, 8-foot ditch, and 5-foot sidewalks in a 60-foot right-of-way (ROW).
Assuming a symmetrical cross section, half street improvements are required as measured from
51e street centerline with no ROW dedication.
2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the
required street improvements (FV§rRC 19.135.070). Information about right-of-way modification
requests is available through the Public Works Development Services Division. These modification
requests have a nominal review fee currently at $105.50.
Access Management (FWRC 19.135)
1. Access management standards are based on roadway safety and capacity requirements. FWRC
19,135.280 provides access standards for streets based on planned roadway cross -sections. Please
note that access classifications are per Drawing 3 -1 A in the Public Works Development Standards.
2. Please show all neighboring driveways within 150 feet of the proposed driveway(s).
3. Driveways that serve only residential use may not be located closer than 25 feet to any street

Fire Apparatus Access Roadway
Fire apparatus access roadways shall be required for every building when any portion of an exterior
wall of the first story is located more than 150 ft. from fire apparatus vehicle access.
• Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance
of not less than 13 feet 6 inches.
• Shall be designed and maintained to support the imposed load of a 75,000 pound fire apparatus
and shall be provided with a surface so as to provide all-weather driving capabilities.
• Shall be not less than a 32-foot inside turning radius and not less than a 40-foot outside taming
radius.
•; With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac at the dead
end. All such cul-de-sacs shall be not less than 80 feet in diameter.
• Gradient shall not exceed 15 percent.
EXCEPTION: When buildings are completely protected with an approved automatic fire
sprinkler system, these provisions may be modified by the chief.
Automatic Fire Sprinkler Systems
