Oil June 22, 2016, the City of Federal Way's Community Development Department issued a Technical
Review Letter for the mechanical eqUiprilent enclosure and building addition at the above -referenced
address. The improvements were constructed Without land use or building permit approval. Tile

department is unable to grant land use approval for the constrUcted improvements as they encroach into
the rear yard setback. As stated Ili the letter, the review of the Building Permit and Use Process I
Applications were put on hold until the setback Issue is resolved.

The Department of Community Development is in receipt of the Process I Master Land Use Application
for the mechanical equipment enclosure and building addition. The improvements were originally
constructed without land use or building permit approval and this is an "after the fact" land use
application. A code violation case was opened and you were notified by City staff that Building Permit
and Land Use Process I approvals were required, File 4 16-10213 5-00-VO.
At this time, the department is unable to grant land use approval for the constructed improvements as they
encroach into the rear yard setback. The subject site is zoned Office Park (OP). Pursuant to Federal Way
�Revised Code (FWRC) 19.23 5.010, the minimum rear yard setback requirement from the rear property
line in the OP zone is 20 feet. Submitted plans depict the addition and mechanical equipment 14 feet from
the rear property line.
REQUIRED YARDS
Per FWRC 19.125.160, no improvement or structure may be in a required setback yard except as follows:
• Any improvement or structure that is not more than four inches above finished grade may be
anywhere in a required setback yard.
• An improvement or structure that is not more than 18 inches above finished grade may extend not
more than five feet into a required yard.
• Chimneys, bay windows, greenhouse 'Windows, eaves, awnings and similar elements of a
structure that customarily extend beyond the exterior walls of a structure may extend up to 18
inches into any required yard. The total horizontal dimension of the elements that extend into a
required yard, excluding eaves, may not exceed 25 percent of the length of the facade of the
structure from which the elements extend.
• Fences and railings not over six feet in height may be located in required yards subject to the
fence regulations contained within this chapter.
• Rockeries and retaining walls may be located in required yards if-
• The rockery or retaining wall is not being used as a direct structural support for a major
improvement;
• The rockery or retaining wall is reasonably necessary to provide support to a cut, fill, or
slope; and
• The rockery or retaining wall also meets the requirements of FWRC 19.120.120 et seq.

The constructed improvements, building addition and mechanical equipment enclosure, do not meet any
of the above exceptions.
