NWCC Center Plaza — Fire Damage Rebuild, 2020 South 320th Street, Federal Way
The Community Development Department has completed administrative land use review of the proposed
NWCC Center Plaza project located at 2020 South 320th Street. The applicant proposes reconstruction of a
22,000 square foot multi -tenant commercial building with associated site work. The previous 22,000 square
foot building was destroyed by fire on May 21, 2017.
The Process III Master Land Use (NdLU) application submitted October 10, 2017, with subsequent
resubmittals dated October 30, 2017, January 8, 2018, and March 14, 2018, is hereby conditionally approved
based on the enclosed findings of fact, incorporated into this decision in full, and the following conclusions
based on those facts:
1. The proposal is consistent with the comprehensive plan;
2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC);
3. The proposal is consistent with the public health, safety, and welfare;
4. The streets and utilities in the area of the subject property are adequate to serve the
anticipated demand from the proposal;
5. The proposed access to the subject property is at the optimal location and configuration; and
6. Traffic safety impacts for all modes of transportation, both on and off site, are adequately
mitigated.
The remainder of this letter outlines the land use review process required for this particular site improvement;
summarizes the State Environmental Policy Act (SEPA) process; lists conditions of the land use decision; and
provides other procedural information. This land use decision does not authorize initiation of construction
activities.
REviEw PROCESS
The site is within the City Center Core (CC-C) zoning district. Retail, restaurant, and office are permitted uses
in this zone subject to the provisions of FWRC 19.225.010, "Office Use"; F\VRC 19.225.020, "Retail Use";

and FWRC 19.225.040, "Entertainment." The proposed uses, not exempt from SEPA, are reviewed under
Use Process III, Prqject Approval. The Director of Community Development makes a written decision on the
application based on the criteria listed under FWRC 19.65.100.
SEPA PROCESS -
Pursuant to Wasbin ,gton Administrative Code (WAC) 197-11-172 and FWRC 14.15.130, the project qualified as a
Planned Action on November 13, 2017. The project is not subject to a SEPA threshold determination, an
environmental impact statement (EIS), SEPA appeal, or any other additional review under SEPA.
CONDITIONS OF APPROVAL
The following conditions are reasonably necessary to eliminate or minimize any undesirable effects of granting
application approval.
1. Prior to final inspection, vents and similar appurtenances that extend above the rooffine must be
surrounded by a solid sight -obscuring screen that is integrated into the architecture of the building, to
obscure the view of the appurtenances from adjacent streets and properties.
2. Per FWRC 19.15.090(3), a Site Plan Modification (Administrative Decision) is required for the new trash
enclosure.

This Process III land use decision does not constitute a building permit, or authorize clearing/grading

REQUESTS FOR CHANGE OF VALUATION
Per FWRC 19.65.100(4)(i), affected property owners may request a change in valuation for property tax
purposes, nomithstanding any program of revaluation.
APPROVAL DURATION
Per FWRC 19.15.100(2), unless modified or appealed, the Process III decision is valid for five years from the
date of issuance of the decision. Time extensions to the decision may be requested prior to the lapse of
approval, following the provisions listed in FWRC 19.15.110. The improvements must be substantially
completed within the five-year time period, or the land use decision becomes void.
APPEALS
Per FWRC 19.05.360, the effective date of issuance is three calendar days following the date of this letter,
March 29, 2018. Pursuant to FWRC 19.65.120(l), this land use decision may be appealed by the applicant,
any person who submitted written comments or information, or any person who has specifically requested
copy of the decision. In compliance with FWRC 19.65.120(2), any appeal must be in the form of a letter
delivered to the Community Development Department, with the established fee, and within 14 days after 11
effective date of issuance of this decision, or April 12, 2018. The appeal letter must contain a staterner I

will hear any appeals of the Process Ill decision.

This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development.

The Director of Community Development hereby makes the following fitidings pursuant to content
requirements of the Process III written decision as set forth in Federal Way Revised Code (FWRC)
19.65.100(4). These findings are based on review of existing city documents and items submitted by the
applicant and received on October 10, 2017, October 30, 2017, January 8, 2018, and March 14, 2018.
1. Proposal — Reconstruction of a 22,000 square foot multi -tenant commercial building with associated
site work on a 5.9 acre site. The site contains other commercial buildings and parking areas.
2. Zoning and Comprehensive Plan Designation — Zoning for the subject property is City Center Core
(CC-C). Retail,, restaurant, and office are permitted uses in the CC-C zoning district pursuant to
FWRC 19.225.010, "Office Use"; FWRC 19.225.020, "Retail Use"; and FWRC 19.225.040,
"Entertamm . ent." The Federal Way Comprehensive Plan (FWCP) designation for the subject property
is City Center Core.
Site Plan Review Process — The project requires review under Process 111, -?'roject Approva777T*
Director of Community Development makes a written decision on the application based on the
criteria listed under FWRC 19.65. 100.
4. State Environmental Policy Act (SEPA) — Pursuant to Washington Administrative Code (WAC) 197-
11 - 172 and FWRC 14.15.13 0, the prej ect qualified as a Planned Action on November 13, 2017. The
project is not subject to a SEPA threshold determination, an environmental impact statement (EIS),
SEPA appeal, or any other additional review under SEPA.
Public Notice — Pursuant to Process III regulations, a Notice of Land Use Application (NOA) was
issued on November 17, 2017, and posted on the subject property and displayed on the designated
city notice boards. As it was not published in the newspaper as required, a revised NOA was issued

on November 24, 20, and published in the Federal Way Mirror and displayed on the designated
city notice boards. Pursuant to SEPA regulations, for projects that qualify as planned actions, public
notice shall be provided as specified in FWRC 14.15.060(3), "Public notice for projects that qualify
planned actions shall be tied to the underlying permit. If notice is otherwise required for the
underlying permit, the notice shall state that the project has qualified as a planned action." The NO
contained a statement that the project qualified as a planned action.
6. Public Comments — No public comments were received during the comment periods.

Non-Conforniing Regulations — The existing structure was destroyed by a fire on May 21, 2017. If the
applicant complies with FWRC 19.30.200, then with regard to zoning code provisions, the structure
may be rebuilt.

that use or development, including associated improvements, may be reconstructed if it meets the

10. Landscaping — Per FWRC 19.125.060(7), perimeter landscaping is required as follows: Type Ed
"Visual Buffer" landscaping five feet in width along the perimeter of parking areas abutting public
rights -of -way and all other perimeter lot lines, except that landscaping is not required along perimeter
lot lines abutting rights -of -way where no required yards apply pursuant to Chapter 19.225 FWRC.
The only perimeter landscaping affected by the project is located south of the building, where it will
be replaced. For reference, no landscaping is required on the south side as there is a 0-foot yard
(setback) required per FWRC 19.225 and FVTRC 19.125.060(7).
Per FWRC 19.125.070(2)(a)(i)(A), parking lot landscaping is required in the amount of 20 square fe
of landscaping per parking stall. Parking lot landscaping is not proposed to be modified as part of if
project, per the submitted landscaping plan. With regard to landscaping, the replacement building wi
either conform to the code requirements or not be any more non -conforming than it was previously.

11. Clearing & Grading — Clearing and grading activities will be minor as the same site is being used for
the project. As such, it will be reviewed for consistency with applicable standards set forth in FWRC
Chapter 19.120, as part of the building permit review.
12. Tree RetentionlReplacement — Per FWRC 19.120.030(14), tree removal on sites zoned CC-C is
exempt from the tree code.
14. Community Design Guidelines —FViRC Chapter 19.115 contains the Community Design Guidelines.
The applicant submitted a Crime Prevention Through Environmental Design checklist, which was
-reviewed by city staff. The primary entrances to the building will be visible from the right-of-way, as
they were previously.

The previous building used various methods to articulate blank walls on all four building fa9ades,
mainly with the use of alternating sections of windows and brick. Regarding the reconstruction,
according to the architect, "the building articulation has been accomplished by a combination of
design elements that include material, color and textural variation. Banding of materials with differe a
size, color and textural values has been incorporated in the masonry portions of the fagades." The
previous building had fagade modulation on the north and south building fagades. The replacement
building will have similar. fagade modulation on the north and south side, and will also have canopiel,
to further break up the fagade.
With regard to community design guidelines, the replacement building will either conform to the code
requirements or not be any more non -conforming than it was previously.
15. Rooftop Mechanical Equipment — Per FWRC 19.110.070, vents and similar appurtenances that extend
above the roofline must be surrounded by a solid sight -obscuring screen that is integrated into the
architecture of the building and obscures the view of the appurtenances from adjacent streets and
properties. The previous building had no visible rooftop mechanical equipment. The replacement
building's rooftop equipment will be screened by the exterior fagade of the building, as shown on the
plans. The architect indicated that, "the building design uses the height of the parapets and equipment
placement to screen the units on all elevations. Manufactured HVAC equipment screening is
proposed for the east and west elevations where wall articulation reduces the height of the parapet. If
the equipment is relocated or additional equipment added that will be visible above the screening
parapets, the owner will install additional equipment screening." A condition of approval shall requir*
compliance with the standard.
16. GarbagelRecycling — In the original land use application submittal, a trash enclosure was proposed
that would have been an addition to the site and not a replacement of one that existed previously. The
new enclosure required removal of three existing parking spaces. The applicant was requested to
detail on the site plan the number of parking spaces provided compared to the number required, and
factor in the removal of spaces for the new trash enclosure. In the project resubniittal, it stated the
trash enclosure was to be separated from the building reconstruction and permitted separately once

17. Lighting - The proposal includes outdoor lighting. Per FWRC 19.105.030(3), the applicant shall
select, place, and direct light sources, both directable and nondirectable, so that glare produced by a]
light source, to the maximum extent possible, does not extend to adjacent properties, or to the right-
of-way. The replacement building is setback from the right-of-way and adjacent properties. No
changes are proposed to the existing parking lot lighting.

19. Transportation - No concurrency and traffic impact fee are required because the project is a
replacement due to fire. Typically, the applicant/owner would be expected to construct street
improvements consistent with the planned roadway cross -sections as shown in Map HI-4 in Chapter
III of the FWCP and Capital Improvement Program (CIP) shown as Table 111- 10 (FWRC
19.135.040). However, since the fire has been determined to be an accident and the applicant is
proposing to replace the damaged building, street improvements will not be required nor warranted in
meeting nexus and FVvrRC 19.30.200.
20. StIter - The project is required to meet the current version of the stormwater manual. If the
project meets the requirements of FWRC 19.30.200, then additional requirements do not apply.
Engineering review of the submitted building permit application is ongoing.
21. WaterlSewer - Lakehaven Water & Sewer District is the water and sewer service provider. Lakehaven
issued certificates of water and sewer availability on October 27, 2017; certificates are valid for one-
year from the date of issuance. The previous building's sewer service connection was disconnected on
August 1, 2017, under Lakehaven Sewer Service Connection Permit 28218. For the new building, the
applicant will need to submit applications to Lakehaven for any necessary water and/or sewer service
connections. As of March 20, 2018, no service connection application have been submitted to
Lakehaven for sewer re -connection (required), or to upsize the existing domestic service/meter (if
necessary), or for new/additional fire -protection service connection (if necessary). The applicant will
need to address these items as part of the building process.
22. South King Fire & Rescue - This project will require two fire hydrants, and there are two existing fire
hydrants available for this project. Fire apparatus access roads shall be installed and made serviceable
prior to and during the time of construction. A recessed fire department "Knox7 brand key box shall
be installed on the building. An NFPA 13 fire sprinkler system is required. A fire alarm system is
required. The applicant will need to address these items as part of the building process.
23. Conditions ofApproval - The following conditions of approval are attached to the Process Ell decision:

a. The Parking Summary has been updated. Please reverence the revised table.
b. The trash enclosure should be separated from the Building Reconstruction and a separate permit
application will be submitted along with a revised parking count. Many times Leases designat"
specific trash storage volume dedicated to a single Tenant. We wish to confirm the required size
and best location of the enclosure based on the Tenant requirements before we proceed ftuther
with the permitting.
c. No new transformer will be installed. The screening of the existing transformer will be a
component of the landscape upgrades, reference the revised landscape drawings. A new FDC will
be installed adjacent to the existing fire hydrant east of the building. Screening landscaping will
be added as Fire Department clearances allow. Reference the revised Landscape design.
4. a. The trash enclosure is to be submitted for a separate permit review when the required size can
more accurately be determined.
5. a The Building articulation has been accomplished by a combination of design elements that
include material, color and textural variation. Banding of materials with different size, color and
textural values has been incorporated in the masonry portions of the facades. Sections of projecting
metal canopies have been used to divide the facades into smaller visual components using color and
shading. The largest blank portions of the wall use a panelized finish with a defined reveal pattern to
visually reduce the size of the wall using many smaller components. No additional landscape
screening has been added in the glazed recesses due to a basic conflict with the retail nature of the
use.
b. The north and south facades of the new building have similar modulation to the previous
building. The east and west comers of the north and south facades are angled in similar fashion to tho
original building to minimize the mass of the building. Both buildings also contain modulation in the
mid -portion of the north and south facades. The size of the proposed mid -building modulation is
greater than that provided by the original building. In addition, the parapets return onto the roof to
extend a modulation element onto the roof, which the original building did not do. The new building
also uses compliant canopy elements on the south elevation to provide an additional modulation
element. The original building used an uninterrupted canopy which did not enhance the modulation
of the fagade.
c. The mechanical design for the building is not yet complete, but it is anticipated that HVAC
equipment will consist of multiple units having the relatively small capacity of 5 tons. No large
HVAC equipment is intended to individually serve large portions of the building will be used. The
building design uses the height of the parapets and equipment placement to screen the units on all
elevations. Manufactured HVAC equipment screening is proposed for the east and west elevations
where wall articulation reduces the height of the parapet. If the equipment is relocated or additional
equipment added that will be visible above the screening parapets, the Owner will install additional
equipment screening.
d. The height of the proposed building is the same as the height of the original building.

7. The SEPA Checklist has not been revised, but the Civil Engineering has been updated. See the

confirmed and applications made for new service to the reconstructed building.

FIRE DEPARTMENT ACCESS ROADS
A. Scope and Purpose -
To provide a policy for Fire Apparatus Access Roads within the City of Federal Way and the City of Des
Moines.
B. Code Authority
Washington Administrative Code 51-24-10201 and International Fire Code section 102.
C. Special Provisions
1. Approved fire apparatus access roads shall be provided for every facility, building or portion of a
building hereafter constructed or moved into or within the jurisdiction. The fire apparatus access road
shall extend to within one -hundred -fifty (150') feet of all portions of the facility and all portions of the
exterior walls of the first story of the building as measured by an approved route around the exterior of
the building or facility.
Exception: The Fire Marshal is authorized to increase the dimension of one -hundred -fifty (150') feet
where:
a. The building is equipped throughout with an approved automatic sprinkler system. A twenty (20)
percent increase in the dimension is permitted.
b. Fire apparatus access roads cannot be installed because of location on property, topography,
waterways, non-negotiable grades or other similar conditions, and an approved alternative means
of fire protection is provided.
c. This policy may be modified for Group R-3 occupancies with an approved sprinkler system and
Group U occupancies as approved by the Fire Marshal.
2. The Fire Marshal is authorized to require more than one fire apparatus access road based on the
potential for impairment of a single road by vehicle congestion, condition of terrain, climatic conditions
or other factors that could limit access.
3. Fire apparatus access roads shall have an unobstructed width of not less than twenty (20') feet
exclusive of shoulders, and an unobstructed vertical clearance of not less than thirteen feet six (13'6")
inches. Security gates when installed shall be in accordance with Administrative policies 10.001 and
10.003.
4. The Fire Marshal shall have the authority to require an increase in the minimum access widths where
they are inadequate for fire or rescue operations.
5. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire
apparatus and shall be surfaced so as to provide all-weather driving capabilities. A paved surface is not
required by the fire department. The roadway must support 75,000 lbs. gross vehicle weight. Current
apparatus weighs 69,500 pounds. That is 22,640 lbs. on the front axle and 46,860 lbs. on the rear
tandem axles. Outrigger point load of45,000 lbs. applied on an 18"x18" inch area.
Note: Grass Crete —The only product currently approved is Presto Geosystems. When Grass Crete is
used, the driving surface must be clearly discernible as a drivable surface.
6. The required turning radius of a fire apparatus access road shall be thirty-two (32) feet inside and for
(40') feet outside radius.
7. Dead-end fire apparatus access roads in excess of one -hundred -fifty (150') feet in length shall I
provided with shall be provided with a cul-de-sac at the dead-end. All such cul-de-sacs shall not be le
than eighty (80') feet in diameter. When buildings are completely protected with an approvE
automatic fire sprinkler system, the provisions of this policy may be modified by the Fire Marshal.
8.' Where a bridge or an elevated surface is part of a fire apparatus access, road, the bridge shall t
constructed and maintained in accordance with AASHTO HB-17. Bridges and elevated surfaces shall t
designed for a live load sufficient to carry the imposed loads of fire apparatus. Vehicle load limits shi
be posted at both entrances to bridges when required by the fire code official. Where elevated surfac(
designed for emergency vehicle use are adjacent to surfaces which are not designed for such us
approved barriers, approved signs or both shall be installed and maintained when required by the Fii
Marshal.
9. The grade of the fire apparatus access road shall be within the limits established by the Fire Marsh
based on the fire department's apparatus:
a. 12% commercial property
b. 15% residential property
10. Where required, approved fire lanes shall be established and marked in accordance with applicable Cil
Codes.
11. The maximum angles of approach, departure and ground clearance for fire apparatus access roads ai
as follows:
a. Angle of departure (A): 5.5 degrees
b. Angle of approach (B): 6.5 degrees
c. Ground Clearance* (D): 8 inches

Fire Flow:
The required fire flow for this project is 2,000 gallons per minute. A Certificate of Water Availability
including a hydraulic fire flow model shall be requested from the water district and provided at the
time of building permit application.
Fire Hydrants:
This project will require 2 fire hydrant(s) in approved* locations. There are 2 existing fire hydrants
available for this project.
*Hydrant location in relationship to buildings and sprinkler FDC shall be approved by Fire Marshal's
Office
Fire hydrants shall be in service prior to and during the time of construction.
Emergency Access:
Fire apparatus access roads shall comply with all requirements of Fire Access Policy 10.006

Fire apparatus access roads shall be installed and made serviceable prior to and during the time of

Fire Department Lock Box:
A recessed fire department "Knox" brand key box shall be installed on the building. Location of box
will be approved by the plan reviewer or Deputy Fire Marshal onsite.
Fire Sprinkler System:
An automatic fire sprinkler system shall be installed in all occupancies where the total floor area
included within the surrounding exterior walls on all floor levels, including basements, exceeds 5,000
square feet. Fire walls shall not be considered to separate a building to enable deletion of the
required automatic fire -extinguishing system.
The system demand pressure (to the source) required in a hydraulically designed automatic fire
sprinkler system shall be at least 10 per cent less than the correlative water supply curve pressure.
Fire Alarm:
An automatic fine detection system shall be installed in all buildings exceeding 3.000 square feet
gross floor area. The fire alarm system is required to monitor the h klincluding water
be required for this pro'ect — check with Fire Marshal's Office when Occu�ancy use is known. This
fire detection system shall be monitored by an approved central and/or remote station.

Project Description
The project involves the reconstruction of a 22,000 SF single story commercial building located at 2020 S 320'h St in
Federal Way, A. The existing structure was destroyed by fire on May 21, 2017. The rebuilt building (Building A)
is the southernmost commercial building on the 260,258 SF lot (Parcel #0921049297). Site Access to the site will
remain from driveways located off of 21" Ave S, S 318' PI and 20"' Ave S. Improvements include utility
connections to the existing utility stubs, site grading as necessary for the construction of the replacement stiucture,

Because the previous building at 2020 S 32011 St was destroyed by a fire, the project complies with The Federal Way
Revised Code (FWRC) 19.30.200 which states that "The use of development, including associated improvements, as
reconstructed, is not any more nonconforming than it was immediately prior to the damage". As a result, the design
of the rebuilt building has been designed to be just that - no more non -conforming than the previous building prior to
its destruction by fire. Complying with FWRC 19.30.200, the rebuilt building will not add any additional impervious
area than existed beforehand. Additionally, the rebuilt building will mimic the previous building's drainage system.
Roof downspouts will be curb discharged to the parking lot as existing with the prior building. The building's
footing drain will connect to an area drain southeast of the building which will then drain to a catch basin with sump
in the parking lot.

1. Definition of Terms.
The following terms when used in the
Guarantee mean:
(a) The "Assured": the party or parties
named as the Assured in this Guarantee, or on a
supplemental writing executed by the Company.
(b) "land": the land described or referred to
in Schedule or in Part 2, and improvements
affixed thereto which by law constitute real property.
The term "land" does not include any property
beyond the lines of the area described or referred to
in Schedule A or in Part 2, nor any right title,
interest estate Or easement in abutting streets, roads,
avenues, alleys, lanes, ways or waterways.
