The application proposes the widening of the entrance throat to the drive -through lane at the existing McDonald's located at the above -referenced address. Your application is hereby approved per the findings noted below. FINDINGS OF FACT 1. The widened entry throat to the existing drive -through is proposed to improve vehicle access to the stacking lane. 2. The widening also includes a longer turning radius (10') to the existing radius. 3. Vehicle access to the drive -through is within The Crossings shopping center and not directly from a right-of-way. 4. The widening and longer turning radius will require the removal of approximately 253 square feet of existing landscaping. 5. New hardscape includes asphalt, concrete, curb, gutter and rockery to match existing improvements in the stacking lane. 6. The removal of the existing landscape does not result in the interior parking lot landscaping or drive - through stacking lane screening to fall below applicable requirements of Federal Way Revised Code (FWRC) Chapter 19.125 Outdoors, Yards and Landscaping. CONCLUSIONS OF LAW 1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in F)ArRC 19.15.020 — Exceptions. 2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements are to a development site, and they do not exceed thresholds set forth in FWRC 19.15.030(1). The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(3) repair, remodeling, and maintenance activity. 4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Commercial Enterprise (CE). Pursuant to FWRC 19.240.110, the subject property's fast food restaurant use is permitted in CE zoning districts. 5. The proposed improvements meet Process I purpose criteria set forth in FWRC 19.55.020 including compliance with applicable provisions of FWRC Title 19 `Zoning and Development' and health, safety, and welfare standards. APPEALS The effective date of this decision is November 15, 2014. Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by November 29, 2014. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
