application for a proposed building remodel for the Burger King at 34801 Pacific Highway S. The
Process I application is hereby approved per the findings and conclusions noted below.
FINDINGS OF FACT
I . The applicant proposes a substantial remodel including new towers at entries and new drive-thru
windows. Also included are the removal of both the building's greenhouse and its mansard roof.
2. All existing siding is to be removed and replaced with stucco siding. The new entry towers are to
have horizontal cement board siding with faux cedar finish. Also, new silver canopies are to be added
over doors and windows.
3. The zoning for the subject property is Commercial Enterprise (CE). The existing business is allowed
in the CE zone per Federal Way Revised Code (FWRC) 19.240.120,
4. The proposed building does not exceed twenty feet in height after remodel, compliant with elevation
requirements in FWRC 19.240.110.
5. The existing greenhouse area is to be demolished. New landscaping is to be added after demolition
where current landscaping sits.
6. The minimum setbacks for restaurants within the CE zone are five feet in the front, ten feet along side
and rear yards. The proposed changes meet these requirements,
7. A building permit is required for the project.
8. Development Services, Lakehaven Water and Sewer District, South King Fire and Rescue, and
Traffic have all reviewed and have no comments on this project.
CONCLUSIONS OF LAW
I . The proposed improvements are not exempt from use process review as they do not meet criteria set
forth in FWRC 19.15.020, "Exceptions."
2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements
are to a developed site and do not exceed thresholds set forth in FVV-RC 19.15.030(l).
3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of
work meets categorical exemption WAC 197-11-800(l) and FWRC 14.15.030(c).
4. The proposed improvements meet Community Design Guidelines in the Commercial Enterprise zone
set forth in FWRC 19.115.090.
APPEALS
The effective date of this decision per FWRC 19.05.360 is April 9, 2018. Pursuant to FWRC 19.55.050,
the applicant, any person who submitted written comments or information, any person who has
specifically requested a copy of the decision, or the city may appeal this decision to the Federal Way
Hearing Examiner by April 23, 2018. Any appeal must be in the form of a letter delivered to the
Community Development Department with the established fee. The notice of appeal must contain a
aiAvs-mle4 alon with a coNIA of the decision, a statement of the
alleged errors in the director's decision, including identification of specific factual findings and
conclusions of the director disputed by the person filing the appeal; and the appellant's name, address,
telephone number, and fax number, and any other information to facilitate communications with the
appellant.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a buildinly
