The Process III Master Land Use (MLU) application submitted May 28, 2014, and subsequent resubmittal
received August 8, 2014, is hereby conditionally approved based on the enclosed findings of fact,
incorporated into this decision in full, and the following conclusions based on those facts:
1 . The proposal is consistent with the comprehensive plan;
2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC);
3. The proposal is consistent with the public health, safety, and welfare;
4. Traffic safety impacts for all modes of transportation, both on and off site, are adequately
gated; and
5. The combined sign package will provide more coordinated, effective, and efficient signs.
REViEw PROCESSES REQUIRED
Pursuant to FW-RC 19.140.140(5), a combined sign package for adjacent property owners shall be
processed under Use Process M. The Director of Community Development will make the initial land use
decision based on written comments and information gathered during site plan review. Any appeals of the
decision will be decided by the Hearing Examiner after a public hearing. The proposed combined sip
package is categorically exempt from an environmental threshold determination pursuant to Washington
Administrative Code (WAC) 197-11-800(2)(c).

The Planning Division makes the following findings pursuant to content requirements of the Process III
written decision as set forth in Federal Way Revised Code (FV;RC) 19.65.100(4). These findings are based
on review of existing city documents and submitted items by the applicant.
Proposal — The prcject applkaiits� O'Reilly Auto Parts and Qualitylim, propose to install tw*

2. Review Process — The proposed combined sign package is subject to review pursuant to FV;RC
19.140.140(5), Combined sign packagefor adjacent property owners. The city has reviewed and
decided upon the proposal using Process III 'Project Approval', pursuant to FNVRC Chapter 19.65.
3. Environmental Review — The application is exempt from review under the State Environmental
Policy Act (SEPA) as it meets categorical exemptions set forth in Washington Administrative Code
(WAC) 197-11-800(2)(c) for construction or installation of commercial on -premise signs.
4. Public Notice — The application was deemed complete on June 23, 2014, and a Notice of
Application was posted on June 27, 2014. The notice was posted at the subject property, posted at
each of the city's official notification boards, published in the Federal Way Mirror, and mailed to
property owners within 300 feet of the subject property. The comment period due date was July 14,
2014, and no comments were received.

Sign Criteria — The allowable sign area, sign type, sign height, and number of signs is determine U1

Sign Type — Medium profile signs may either be pedestal or monument signs. As proposed,
there will be two monument signs.
Sign Height — The height of a medium profile sign is calculated at a rate of one and one-half
feet in sign height for every 10 lineal feet of frontage along a public right-of-way for any mull
tenant complex, however, such height cannot exceed a maximum height of 12 feet. The total
frontage for O'Reilly's and Quality hm is 190 lineal ft. The applicants are allowed, and
propose, the maximum height of 12 feet.
Sign Area — For a multi -tenant complex, sign area is calculated at a rate of two sq. ft. per lineal
foot of frontage on a public right-of-way not to exceed a maximum sign area of 128 sq. ft. for
the total of all sign faces on each permitted sign with no one sign face exceeding 64 sq. ft. The
applicants are allowed the maximum sign area of 128 sq. ft. per sign. The proposed signs are
two-sided and have a total sign face of approximately 110.5 sq. ft. for each sign, which meets
the allowed sign area.

along each frontage for a total of two signs.
7. Construction Standards — Sign construction is consistent with FWRC 19.140.170 "Construction
Standards" based • provisions • the following elements:
a. Both signs meet the setback requirement of three feet from the property line.
b. As proposed, the signs meet the dimensional standards for monument signs.
C. The proposed signs meet applicable design criteria, the sign base is constructed with stone
veneer, and both sign faces are harmonious with the character of the primary structures on site.

drawn to a minimum scale of I " = 20'. The scale must be indicated on the site plan.
2. Depict on the site plan the total lineal feet of frontage along the right-of-way. The lineal feet frontage
along • Hwy South should only include the lease area O'Reilly is currently occupying.
3. The elevation drawing must include the calculated total sign area. Pursuant to Federal Way Revised
Code (FWRC) 19.140.140, for medium profile signs, the sign area cannot exceed a maximum of 128
square feet for the total of all sign faces on each permitted sign (two signs are permitted) with no one
sign face exceeding 64 square feet. As depicted, the total sign area for each of the permitted signs is
approx. 22 8 square feet, with each sign face approx. 114 square feet. Please reduce the ' size of the
sign faces for each of the pennitted signs. The foundation details and wind load calculations must be
revised accordingly.

Project Narrative for Federal Way, WA Process III Review
O'Reilly Auto Parts and Quality Inn & Suites are proposing to share two
freestanding signs, one on O'Reilly's property off of Pacific Hwy S and one
by a shared driveway off of 348th St. This collaboration which allows for
increased size and height of a monument sign is one of the most effective
ways these two companies can achieve their ultimate goal which is the
continuation of building a brand dedicated to superior customer service.
The community of Federal Way will also be positively impacted as well from
this coordinated sign plan. The well being of citizens will increase as
they can drive safer and more informed with the more visible proposed signage
and the added knowledge that both businesses can be accessed off of two cross
streets. This means our customers can drive and enter our parking lots in a
more efficient and safer way. The LED illumination that these signs will
have at night will be great for the customers and also great for the
environment. LEDs are a much more efficient use of electricity and produce a
substantially less amount of CO2 compared to the next leading bulb or lamp
that other signs might be using.

All liability and obligation under this Commitment shall cease and terminate 6 months after the Effective
Date or when the policy or policies committed for shall issue, whichever first occurs, provided that the
failure to issue the policy or policies is not -the fault of the Company.
The Company will provide a sample of the policy form upon request.

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B
hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability
for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so
disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company
at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company
from liability previously incurred pursuant . to paragraph 3 of these Conditions.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included
under the definition of Insured in the form of.p6licy or policies committed for and only for actual loss incurred in reliance
hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions" shown in
Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event
shall, such liability exceed the amount stated in Schedule A for the policy or. policies committed for and such liability is
subject to the insuring provisions and Conditions and the Exclusions from Coverage -of the form of policy or policies
committedfor in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this
Commitment except as expressly modified herein.
4. This Commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a report of the
conditiod of title. Any action or actions or rights of action that the proposed Insured* may have or may bring against the
Company arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this
Commitment must be based on and are subject to the provisions of this Commitment.
5. The policy -to be issued contains an arbitration clause. All arbitrable matters when the Amounts of Insurance is $2,000,000
or less shall be arbitrated at the' option of either the Company or the Insured as the exclusive remedy of the parties. You
