SUBJECT: West Hylebos Creek Bridge Gravel Removal — SEPA Compliance Analysis

City Planning Division staff evaluated the 2008 Hylebos Creek gravel removal proposal to remove
approximately 100 cubic yards of gravel from West Hylebos Creek to restore the stream flow, protect the
existing bridge, and allow inspection and potential maintenance of the bridge. The proposed action is
further described in the attachment to Fei Tang's letter to Greg Fewins received April 17, 2008.
Upon review of the current proposal, it was determined that it is consistent with the gravel removal
described and reviewed in the May 19, 1995, SEPA checklist and July 13, 1995, Determination of
Nonsignificance (DNS). The 2008 proposal is essentially the same as the project proposed and conducted
in 1995; however, the current proposed action is to occur in the summer of 2008 rather than in the summer
of 1995. The current proposal involves removal of a smaller amount of gravel than removed in 1995,
The proposed action was determined .by the Responsible SEPA Official, pursuant to WAC 197-11-
600(3)(b), to not require a new SEPA threshold determination because: (1) the environmental impacts
associated with the gravel removal were previously evaluated in the 1995 SEPA review, pursuant to the
SEPA rules; and (2) the proposal does not represent any new or substantial changes that are likely to have
significant adverse environmental impacts beyond those evaluated in previous environmental decisions.
Similar gravel removal actions were conducted by the Public Works Department and approved by the
Department of Community Development Services in 1997 and 2002, and by the Washington State
Department of Transportation in 2006. The 1997 and 2002 projects relied on the 1995 SEPA documents.
Environmental conditions in the vicinity of the proposal have not significantly changed since 1995,
Planning Division staff considered the potential implications of the listing of Puget Sound Chinook
salmonids as endangered species. Although Chinook salmon have historically been present in Hylebos
Creek and were observed in the creek in 2001, the proposed project should not adversely impact Chinook
salmon due to the nature and timing of the project. The proposed action must receive a Hydraulic Permit
Approval (EPA) from Washington Department of Fish and Wildlife (WDFW) and conditions attached to
the permit will regulate construction practices and construction timing and mitigate potential impacts to
salmonids and associated habitat. An HPA was required and approved for the same proposal in 1995,
1997, and 2002. Construction activity for the proposal will occur in the "low flow" summer months when
salmon and salmon redds are not present in the creek. Compliance with conditions on the HPA as
required by WDFW will adequately mitigate potential impacts to salmonids.

Dear Mr. Tang:
The City of Federal Way has completed the technical review of your request to excavate approximately
100 cubic yards of gravel from West Hylebos Creek in the vicinity of the South 37P Street Bridge. The
proposed action and request are described in your April 17, 2008, cover letter to Greg Fewins. The
requested stream rehabilitation is hereby approved based on the conclusions below.
Pursuant to Federal Way City Code (FWCC) Section 22-1311 regarding stream rehabilitation, the
Director of Community Development Services may permit stream rehabilitation or stream maintenance
by requiring the removal of detrimental materials such as debris, sediment, and invasive non-native
vegetation. The requested gravel removal is necessary in order to restore the stream flow and protect the
existing vehicular bridge from localized flooding and to allow inspection and maintenance of the bridge.
-Similar stream maintenance actions previously occurred at the same site in 1991, twice in 1995, in 1997,
in 2002, and by the Washington State Department of Transportation in 2006.
CONCLUSION
The proposed gravel removal meets the standards of FWCC Section 22-1311 by removing detrimental
gravel and sediment which, in the past, has created a localized flooding condition at the project site and
prohibits inspection and maintenance of the bridge. Environmental review pursuant to the State
Environmental Policy Act has been completed and no comment or appeal periods apply.
This approval does not exempt the project from other local, state, and federal permit requirements. If you
