Dear Mr. Rueber:
The Federal Way Community Development Department has completed the administrative review for the
`KC Investments, LLC' BSP. The applicant proposes to subdivide one existing 1.66-acre commercial lot
into two commercial lots comprised of 0.99 acres and 0.67 acres. The site is located at 34720 Pacific Hwy
South (King County parcel #202104-9065) and an address to be determined upon a building permit
submission. The department received your application on September 8, 2014, and deemed the application
complete on September 30, 2014. Resubmitted plans and associated documents were received on January
8, 2014, January 20, 2015, and February 17, 2015.
The City of Federal Way hereby grants preliminary approval of the KC Investments,
LLC BSP. This approval corresponds to the BSP drawing, date -stamped as a resubmittal February 17,
2015.
Pursuant to Federal Way Revised Code (FWRC), Binding Site Plan applications shall be processed in
accordance with the provisions of short subdivisions; therefore, this Decision of the Director is based on
the enclosed Statement of Facts and Conclusions and in accordance with decision criteria set forth in
FWRC 18.30.110(2).
RECORDATION
Please submit the following four items to the City of Federal Way permit center with the enclosed
resubmittal form: (1) one set of signed and notarized mylars; (2) two sets of paper copies of the
signed/notarized mylars; (3) the current King County recording fee payable to City of Federal Way in the
amount of $144.001; and (4) one copy of this decision. The department will record the mylars following
expiration of the appeal period and route the conformed copy to the applicant.
1 Recording fee for the two -page BSP is based on $138.00 for the first survey page, $5.00 for one additional page, and $1.00 for a
conformed copy.

APPEAL PROCESS
Pursuant to FWRC 18.30.140, any person who receives a copy of this decision may appeal the decision
within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to
the Community Development Department by 5:00 p.m., March 27, 2015. An appeal letter must contain a
clear reference to the matter being appealed, along with a copy of the decision. A statement of the alleged
errors in the decision and required appeal fee must be included.
SEPA THRESHOLD DETERMINATION
Pursuant to the State Environmental Policy Act (RCW Chapter 43.21C), the proposal is exempt from
SEPA review.
DURATION OF APPROVAL
Binding Site Plan preliminary approval shall expire five years from the date of issuance of this decision.
However, the applicant may submit a written request in the form of a letter with supporting
documentation to the Community Development Department requesting an extension pursuant to FWRC
18.05.090.
OTHER AGENCY PERMITS
The applicant is responsible for identifying and obtaining all required state, federal, or other agency
permits, as may be required.
REQUESTS FOR CHANGE OF VALUATION
Any affected property owners may request a change in valuation for property tax purposes,
notwithstanding any program of revaluation.
CLOSING
This decision does not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development. This BSP approval does not constitute approval of land clearing or building

The Planning Division hereby presents the following findings to the Director of Community Development
pursuant to content requirements of the Binding Site Plan. (BSP) written decision as set forth in Federal Way
Revised Code (FWRC) 18.20.050. These Bindings are based on review of existing city documents and BSP
sheets 1-2 resubmitted by the applicant and stamped by the Permit Center on February 17, 2015:
Proposal — The applicant proposes to subdivide one commercial lot into two lots. The BSP will
result in Lot 1 — 29,029 square feet (0.67 acres) and Lot 2 — 43,117 square feet (0.99 acres) as
depicted on Page 2 of 2 of the preliminary BSP document. A shared access easement will be
established during the recording process between Lot 1 and Lot 2.
2. Review Process — Pursuant to Federal Way Revised Code (FWRC) Chapter 18.20, `Binding
Site Plans,' the proposed BSP is subject to administrative review and a decision by the Director
of Community Development. The proposal has been reviewed by the Development Review
Committee, which includes staff from the City's Planning and Building Divisions, Public
Works Department, Lakehaven Utility District, and South King Fire and Rescue.
3. Comprehensive Plan & Zoning — The subject property is located within a Commercial
Enterprise (CE) zone and designated Commercial Enterprise in the Comprehensive Plan. The
existing land use for proposed Lot 1 is specialty retail sales (auto parts vendor), a permitted use
in the CE zone per FWRC 19.240.070. On the date of this administrative decision no proposed
land use for Lot 2 has been determined. Future uses and regulations for Lot 2 will be limited to
those uses and bulk regulations identified in the FWRC Chapter 19.240 `Commercial
Enterprise' and any future code amendments thereto shall apply on the date of a complete
building permit application. This proposal is consistent with the comprehensive plan and Title
18 and 19 of the FWRC.
4. Notice — A Notice of Land Use Application was published in the Federal Way Mirror on
October 3, 2014, in accordance with code requirements. A 14-day comment period followed
notice, ending on October 17, 2014. No comment letters were received during or after the
comment period.
5. State Environmental Policy Act (SEPA) — The proposed BSP is exempt from SEPA pursuant
to Washington Administrative Code (WAC) 197-11-800(6)(a).
6. Ingress/Egress — The property owner, on filing a record of survey with the County, will record
a 30-foot shared ingress/egress easement against both properties, located between Lot 1 and 2,
situated off of Pacific Highway South. Access is limited to right -in -right -out to Pacific
Highway South. The associated file number for the driveway is 13-105351-EN. The easement
connects with existing access easements on Lot B, City of Federal Way Boundary Line
Adjustment No. 99-0005 to the south and east.
7. Critical Areas — The City's critical area inventory shows no environmentally sensitive areas.
No critical areas have been identified on or proximate to the site.
8. Servicing — If new or additional hydrants or other fire protection systems are required, a developer
extension agreement with Lakehaven Utility District will be required. Water and sewer connections
for Lot 2 may proceed at the time of development proposal via water and sewer service connection
permits.
9. Engineering — The applicant must obtain engineering approval from the Public Works Department,
Development Services Division, for future development and improvements on Lot 2. Lot 1 contains
an existing commercial development.
10. Street Frontage Improvements —During the development of Lot 1 the applicant dedicated 18
feet of right-of-way along Pacific Highway South for both lots proposed under this decision.
Prior to the issuance of the building permit for Lot 1, the applicant paid a frontage improvement
fee in lieu of improvement construction in the amount of $101,186.00.
11. Transportation — The applicant has been issued a Capacity Reserve Certificate (CRC) for Lot
1. A future proposal for Lot 2 will be subject to concurrency requirements. Per FWRC 19.91,
the applicant is required to pay a traffic impact fee based on the proposed land use for Lot 2 at
the time of building permit issuance. Fees will be calculated based on the impact fee schedule
in effect at the time of a complete building permit application.
12. Stormwater — In accordance with the 2009 King County Surface Water Design Manual, the
applicant has provided flow control and water quality treatment to mitigate the effects of runoff
from the commercial retail development on Lot 1. Future development on Lot 2 will be
required to provide flow control and water quality treatment meeting City standards that are in
place at the time of development.
13. Building Permit — The applicant will be required to obtain commercial building approval from
all applicable departments for development of Lot 2. There are no building permits currently
being reviewed by city staff. An address for Lot 2 will be assigned by the Building Department
on building permit review.
14. Decisional Criteria— The proposal is consistent with all items listed in FWRC 18.30.110(2),
which include the following: (1) FWCP; (2) FWRC Chapter 18.30 `Short Subdivision Plats';
(3) public health, safety, and welfare; (4) design criteria, development standards, Revised Code
of Washington (RCW) 58.17, and other applicable ordinances or regulations of the City.

COMPLETE APPLICATION
Please consider this correspondence as a Letter of Complete Application. The application is deemed complete
as of September 30, 2014, based on a review of your submittal relative to those requirements as set out in
FWRC 18.30.030. The submittal requirements are not intended to determine if an application conforms to the
City of Federal Way codes; they are used only to determine if all required materials have been submitted. A
technical review of the Binding Site Plan application will now begin. You can expect a combined technical
review letter for the Binding Site Plan in approximately two to four weeks of this letter.
The Director of Community Development will issue a decision on the application within 120 days of this
letter. Please be advised that any period in which the city requests additional information or correction to plans
is not included in the 120-day "review clock."

the following comments and update the Binding Site Plan accordingly. After the Binding Site Plan has
been revised, submit three copies of the revised BSP for final review and decision on the application.
1. Provide lot closure calculations for existing and proposed lots.
2. The name of the person(s) who will sign on behalf of KC Investments must be printed in the
declaration. Provide proof of authority to sign.
3. An ingress/egress easement between proposed lots 1 and 2 should be shown on the plans and
recorded against the property for the new shared driveway and connection with Lot B.
4. Show the city file number, 14-104588-00-SU, on Sheet 1.
5. Provide the distance between the O'Reilly's building and the proposed property line on the southwest
side.
6. Please verify the vertical datum. Typically, vertical datum is either KCAS or NGVD-29.
7. Show existing pedestrian walkways on the BSP per FWRC 18.55.070.
8. Remove the BSBL table, and the BSBL lines on the plat map drawing. In the CE zone, there are
variable building setbacks, depending on the use of the property. Therefore, showing 5-foot BSBL's
as currently shown on the map is incorrect, as certain types of uses allowed in the CE zone require
greater than 5-foot setbacks.
9. Revise the vicinity map as follows:
North of SR 18 change Enchanted Parkway label to 16`h Ave. S.
0 South of SR 18, change Kitts Corner Rd. S. label to Enchanted Parkway.
