16-102886CITY OF ti Federal Way February 2, 2017 Mr. Eric LaBrie ESM Consulting Engineers LLC 33400 8th Avenue South, Suite 205 Federal Way, WA 98003 33325 8th Avenue South Federal Way, WA 98003-6325 (253) 835-7000 www. cityoffederalway. com Jim Ferrell, Mayor RE: File 416-102886-00-SU; BOUNDARY" LINE ADJUSTMENT APPROVAL Federal Way Campus 2-Lot BLA, 33663 Weyerhaeuser Way South, Federal Way Dear Mr. LaBrie; The City of Federal Way has completed an administrative review of the above -referenced Boundary Line Adjustment (BLA) application. The proposal is to modify the interior lot line between tax parcels 614260- 0005 and 614260-0200. Zoning for both parcels is Corporate Park-1 * with a 1994 Concomitant Zoning Agreement (CZA) (CP- I *). The original proposal under this application was for a 10-lot BLA; however, the 10-lot BLA application was modified to a 2-lot BLA in an August 24, 2016, letter and revision from ESM. The BLA application was complete on September 29, 2016. The Department of Community Development hereby approves the Federal Way Campus 2-Lot BLA based on the survey drawing prepared and resubmitted to the City on January 30, 2017 by ESM. DECISIONAL CRITERIA City staff has detennined the BLA meets decisional criteria set forth in Federal. Way Revised Code (FWRC) Chapter 18.10: The BLA is a minor alteration of lot boundaries on two existing lots. The proposal is to relocate the interior lot line between tax parcels 614260-0005 and 614260-0200. The two lots in the BLA contain approximately 57.76 acres of land area. The BLA will not increase the number of lots, nor diminish the size of open space or other protected environments. There are several regulated wetlands identified on proposed Lot 1. At the request of the applicant, the City provided an exception to the Federal Way Revised Code, to not depict environmental ly critical areas on proposed Lot 2, as identified in Notes I and 2, sheet 3 of the BLA. Environmental review will occur with subsequent site development. 2. The BLA will not diminish the size of any lot so as to result in a lot of less square footage than prescribed in the CP-I zoning district. The 1994 CZA agreement for the subject property does not cuntain prescriptive lot size minimums for the CP-1 zone. 3. The BLA will not result in the reduction of setbacks or lot coverage to less than prescribed in the CP- T * zoning district, as both of the subject lots are presently undeveloped. Mr. LaBrie February 2, 2017 Page 2 4. All lots resulting from the BLA will be in conformance with the design standards of the city's subdivision title, except proposed Lot 2 includes portions of land remnants that are not contiguous with the primary parcel, as existing public rights -of -way bisect portions of these existing parcels. The land remnants remain unchanged as a result of the BLA. RECORDATION Pursuant to FWRC 18.10.060, all boundary line adjustments shall be recorded with the King County Recorder's Office. To finalize the BLA process, please use the enclosed Resubrnittal Information form and submit to the Perm it Center payment for recording fees in the amount of $198.00.1 If you are providing payment with a check, please make it payable to City of Federal Way. The City will sign the BLA document and have it recorded at King County at the expense of the applicant. You will be provided a conformed copy of the recorded BLA. Please note: Blue ink is not acceptable on documents and maps which will be recorded; all signatures and writing must be made with permanent black ink. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. Please make the following revision to the Boundary Line Adjustment Map and provide two copies of the revised BLA map for further review. Upon review and approval of this final item, City staff will provide further direction for proceeding to recording the BLA. In order for the city to approve the BLA, the second sentence that has been added in note 3 sheet 3, needs to be removed. During the course of the BLA review, ESM did not have data and information regarding the wetlands on proposed lot 2. Following City review and discussion with ESM staff, the text included in note 2 on sheet 3 was provided and suggested by the City as an alternative to delineating and showing the wetlands and buffers on proposed lot 2. Information in Note 2 on sheet 3 regarding the lack of available wetland data was agreed upon by the ESM staff as a method for the City to review and approve the BLA, absent wetland information on proposed lot 2. The second sentence in proposed note 3 was added to the BLA document submitted on December 8, 2016, and goes beyond language suggested by City staff and is inappropriate to include on a BLA. City regulation of the wetlands and wetland buffers will be in accordance with applicable regulations for the property. In order for the City to approve the BLA, City staff is requesting elimination of the second sentence in note 3 sheet 3. The determination of whether a wetland meets the criteria, whether it can be mitigated and then what buffers apply is usually addressed with the site development plan and are subject to change over time as regulations are updated or changed. Since a boundary line adjustment cannot legally establish new easements and restrictions, it seems inappropriate to give the impression that buffers are being created. Given the way the project has progressed we felt it appropriate to include a statement that clarifies the legal position should anyone attempt to challenge any future site development plans for the site. Please make the following revisions to the Boundary Line Adjustment Map and provide two copies of the revised BLA map for further review. Upon review and approval of these three items, City staff will provide further direction for proceeding to recordintD g the BLA. As previously identified in the City's September 29, 2016 review, all wetlands and buffers must be depicted on revised Lot no. 1. The wetlands are shown on the BLA map; however, the code required 100-foot wetland buffers are not shown. In addition, the BLA map must include a reference of the preparer and date of the wetland delineation information. 2. A clear depiction of the entire subject site at 300 scale, all on one page, should be added to the plan set to clarify the proposal and how it affects existing and proposed lots. At the very least, the current 300-scale drawings on sheets 4 and 5 should show the existing property line E with the same line type on both sheets, and it should be clearly laei e1. so, t ere is a ig t font "MATCH LINE" label (sheet 4, beneath block 8) that doesn't clearly apply to any line; an arrow would be helpful. Having only one match line instead of two would also be helpful. 3. The requirement to set lot corners also applies to changes in direction or radius that outline the curved portion of the new lot lines. These lot "corners" must also be set. ESM appreciates the opportunity to respond to technical review comments in line with this letter. In recognition that the application has been determined complete, ESM is submitting 4 copies of revised BLA plans to reflect changes requested by the Technical Review Committee. Per previous discussions, all wetlands and buffers must be depicted on revised Lot no. 1. The revised plans reflect these changes. Correspondingly, with respect to sheets 6 through 12, we have provided two versions for each sheet The first version is the sheet that we would like to propose recording and does not contain the topographical information or wetlands. The second version of each sheet contains the topographical information and wetlands. This second version would not be recorded. This is not unlike a final plat wherein the recorded version of the plat does not contain the topography. 2. Include a note to the following effect under the note column on sheet 3: As an exception to the Federal Way Revised Code, critical areas are not depicted on revised lot No. 2, as that information is not available from the property owner at the time of preparIng this Boundary Line Adjustment Critical areas may exist on Lot No. 2 and will need to be delineated prior to development and if those wetlands or other critical areas prevent development they don get an accommodation. The BLA does not guarantee the lots will be suitable for development now or in the future. The aforementioned note has been added to sheet 3. In summary, the Department does not support the request to waive the critical area report for the entire proposed 242-acre BLA site, as critical areas are required to be depicted on boundary line adjustments, pursuant to FWRC 18.10.030(1). Environmentally critical areas information is a key element for any land division and it is imperative to have adequate information to make an informed decision. In order to assist in expediting the Preferred Freezer development, the City will consider partially waiving the critical area report requirements for the BLA to the extent that allows the property owner to reconfigure the minimum number of lot lines to achieve the 18.9-acre Preferred Freezer site. One potential solution to achieve this outcome would be to revise your application with a 2-lot BLA, reconfiguring the lot lines of only parcels "U" and "V" into a configuration that achieves the desired revised parcel "U" into the 18.9-acre Preferred Freezer site. City staff would partially waive the critical area report requirements for the BLA under this configuration, as we are currently in the process of reviewing wetlands on (revised) parcel "U" in conjunction with the Preferred Freezer SEPA and Process III applications. Under this scenario, wetlands and critical areas would be shown on the 18.9-acre site and a note on the BLA would identify the unknown and unverified status of wetlands and critical areas on the revised parcel "W'. The solution outlined above for a 2-lot BLA and a partial critical area report waiver should meet You[ - objectives to create the 18.9-acre Preferred Freezer parcel (revised lot U /lot 8). Additional BLAB could be processed in the future when your design team gathers environmentally critical area information for the remainder of the site. Mr. LaBrie July 21. 2016 Page 2 INCOMPLETE APPLICATION At this time, we still consider the 10-lot BLA application as incomplete. If you choose to revise the BLA into a 2-lot reconfiguration as discussed above, then City staff would consider the BLA complete upon resubmittal of the revised 2-lot BLA and accompanying materials. Obviously, a full technical review of the BLA would be required. Any resubmittals for this application must be accompanied with a resubmittal form (enclosed). After receipt of the requested information noted in the incomplete application section of this letter, the department will notify you within 14 days whether your application is considered complete for processing, or what, if any, information is still needed. The review clock for processing your formal application will not begin until all items are submitted. In his letter, Mr. Harris states that "during the course of the citys review, the following item was found to be missing or incomplete... A wetland and stream delineation and analysis must be submitted with the Boundary Line Adjustment (BLA) application per FWRC 18.10.0300). The submitted BLA shows several wetlands and drainages, but no supporting documentation has been submitted to the city regarding the wetland/stream delineation and classification..." ESM respectfully requests that you waive this requirement from the 10-lot BLA application. Pursuant to FWRC section 19.145.080 a critical area report may be waived or modified by the director in accordance with subsection (4). Subsection (4) goes on to state; "the critical area report may be waived or modified if the director determines: (a) there will be no alteration of the critical area or buffer; or (b) the applicant cannot obtain permission to access off -site critical areas or buffers." No development is being proposed with the BLA that would alter any critical areas or their buffers. The intention of this BLA is to clean up the lot boundaries so that existing structures and existing roadways do not bisect parcel boundaries, and to create lots that may be sold and developed at a later date under separate applications. This is specifically the case for the Preferred Freezer site that was recently submitted for Process III review. That application included a wetland delineation and report since there are critical areas (wetlands) located on that specific property. In order for your application to be considered -complete and ready for processing, the item below must be provided. • A wetland and stream delineation and analysis must be submitted with the Boundary Line Adjustment (BLA) application per FWRC 18.10.030(1). The submitted BLA shows several wetlands and drainages, but no supporting documentation has been submitted to the city regarding the wetland/stream delineation and classification. We will need five copies of the wetland/stream report. Wetland/stream analysis reports submitted to the city as part of a land use application receive a third -party peer review at the applicant's expense. Following submittal of a report, the city establishes a contract and scope of work with the city's on -call environmental consultant. The applicant must provide a deposit for the anticipated amount of review cost in the scope of work. We are unable to determine the potential cost of peer review until the appropriate report is submitted and a scope of work is prepared by a city review consultant. PRELIMINARY TECHNICAL COMMENTS Since the application is incomplete and the critical areas have not been evaluated, a technical review of the proposal has not been conducted. A complete technical review of the proposed BLA will occur after the critical area studies are submitted to the city, and reviewed as required by city staff and consultants. Ms. Cindy Flood Page 2of2 July 8, 2016 Any resubmittals for this applicadon must be accompanied with a resubmittal form (enclosed). After receipt of the requested information noted in the incomplete application section of this letter, the department will notify you within 14 days whether your application is considered complete for processing, or what, if any, information is still needed. The review clock for processing your formal application will not begin until all items are submitted. Please contact me at jA-ri:Kkris c?tvflTMeral wt4.com or 253 835-2652, if you have any questions. We appreciate your cursory review of the application materials submitted to the City planning department on October 13, 2016. Enclosed with this response you will find the following: • Two copies of the Title report prepared for the property on September 22, 2016, well within the 90 day timeframe of submittal. • Three copies of lot closures for existing and proposed lots sealed by a professional land surveyor. Eight copies of the signed SEPA checklist that was prepared for the Binding Site Plan submittal on October 13. • Four copies of the Technical Information Report. During our intake appointment, we went through the submittal checklist with the permit technicians and verified that everything was included in both of the submittals made that day; the Short Plat and the Binding Site Plan. We are surprised that you were not able to locate the aforementioned items. We believe that there may have been a mix up in the box of information you reviewed since these items were also included in the Short Plat submittal documents. Nevertheless, these items are provided with this letter. Please note that the directions provided in the FWRC 18.20.020, 18.30.030 regarding the number of copies of the Technical Information Report required for a binding site plan submittal state that "all short subdivision applications must at the minimum provide the information contained within City of Federal Way Department of Community Development Services Bulletin No. 010, Short Subdivision Submittal Requirements.; however, Bulletin #10 states that only two copies of the TIR are required. We politely request that Bulletin #10 be updated to reflect that the number of required copies is (4) four instead of the listed (2) two so that future permit applications reflect the appropriate number of copies. Following the sequence of code, FWRC 18.20.020 and FWRC 18.30.030 we do not see a direct correlation as to how a lack of TIA upon submitting for a Binding Site Plan application contributes to a determination of incomplete application. Consequently, ESM is requesting that this requirement for a determination be removed and complete application status issued. This information is also helpful to determine if available avoidance, minimization, or compensatory mitigation measures will address the probable significant impacts, or if an environmental impact statement will be prepared to further analyze the proposal. Instructions for applicants wl This environmental checklist asks you to describe some basic information about your proposal. Please answer each question accurately and carefully, to the best of your knowledge. You may need to consult with an agency specialist or private consultant for some questions. You may Use 'Snot applicable" or "'does not apply" only when you can explain whyit does not apply and not when the answer is unknown. You may also attach or incorporate by reference additional studies and/or reports. Complete and accurate answers to these questions often avoid delays with the SEPA process, as well as later in the decision -making process. The checklist questions apply to all pacts ofyourproposa4 even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. Instructions for Lead Agencaes: Additional information may be necessary to evaluate the existing environment, all interrelated aspects of the proposal, and an analysis of adverse impacts. The checklist is considered the first, but not necessarily the only source of information needed to make an adequate threshold determination. If prompt notice shall not be given to the Company, then all liability of the Company shall terminate with regard to the matter or matters for which prompt notice is required; provided, however, that failure to notify the Company shall in no case prejudice the rights of any Assured under this Guarantee unless the Company shall be prejudiced by the failure and then only to the extent of the prejudice. 3.
