A right-of-way permit, electrical permit, and final landscape inspection are required for this project. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this project site. The approval date of this decision is May 18, 2005. Pursuant to Federal Way City Code (FWCC) Section 22-355, any person who received notice of the decision may appeal the decision to the Hearing Examiner by June 1, 2005. In that you are the only party of record you may waive your right to appeal, in which case the decision shall be effective immediately. The City must receive this waiver in writing. The total cost for this Process I review is $128.00 (two hours at $64 per hour). The balance due at this time is $64.00 ($128.00 less the $64.00 fee paid at the time of application). This approval does not exempt the project from other local, state, and federal permit requirements. I D 31701 CITY OF Federal Way FINDINGS AND CONCLUSIONS FILE NO.05-100658-00-UP Cingular/AT&T Wireless Metrosite 4451 SW 313tb Street Federal Way, Washington BACKGROUND The proposed Cingular project is to replace two Personal Wireless Service Facility (PWSF) panel antennas with three new panel antennas of the same size on an existing power pole in the Dash Point right-of-way. Additionally, the applicant proposes addition of ground equipment cabinets in an existing equipment enclosure area on an adjacent single-family lot at 4451 SW 31P Street. FINDINGS 1) The subject property is zoned Single -Family Residential (RS-9600). PWSF are permitted in the RS9.6 zoning district, subject to the provisions of Federal Way City Code (FWCC) Sections 22-966 through 22-975. 2) Pursuant to the siting criteria established in FWCC Section 22-966(d)(5), the proposed PWSF's location (within Appropriate Public Right -of -Way) would qualify as the fifth and lowest priority for siting PWSFs. This priority has already been established and approved through previous permitting action (02-105247-00-UP). 3) The proposed antennas measure approximately 600 square inches in area, which is the same size as the existing antennas. They exceed the size limit for minor facilities of 580 square inches by 20 square inches. FWCC Section 22-967(2)(a)(2) allows facilities that exceed the definition of minor facility if such facility does not create substantially more adverse impact than a minor facility. The two replacement antennas will have no additional impact as they are the same size as existing antennas. The new antenna will have minimal visual impact as it is the same size as existing facilities and completes the third sector of a standard three -sector antenna arrangement. Submitted photo -simulations show that visual impact associated with the new antennas is extremely minimal. 4) Replacement (and new) antennas are located at the same height as existing antennas. Pursuant to FWCC Section 22-967(2)(b), antenna height may not be increased by more than 15 feet. 5) Pursuant to FWCC Section 22-967, the proposed pole -mounted PWSF ground equipment is in the third priority location. This priority has already been established and approved through previous permitting action (04-100088-00-UP). The combination of existing and proposed ground equipment cabinets are less than six feet tall and occupy 42 square feet of ground area. Pursuant to FWCC Section 22-967(d)(4), equipment cabinets shall not exceed six feet in height or 48 square feet in area. 6) The applicant has submitted a landscaping plan to buffer the proposed ground equipment. Screening consists of a six-foot tall wooden fence, evergreen trees, large and small shrubs, and groundcover. The applicant also proposes to replace eight missing and dead trees, six shrubs, and groundcover associated with an earlier required landscaping installation in the area of the ground equipment. 7) An electrical permit is required for the project. 8) A right-of-way permit is required for the project. 9) The applicant has previously entered into a franchise lease agreement with the City of Federal Way to locate this facility in the public right-of-way. All requirements of the franchise agreement must be satisfied. 10) The proposed antennas, ground equipment, conduits, mounting hardware, and co -axle cables shall be painted a non -reflective color to match the wooden PSE pole, pursuant to FWCC Section 22-967(g). 11) To assure compliance with the approved final plans, the applicant shall contact the Planning Division of the Department of Community Development Services for a final inspection of the new facility. At that time, the applicant shall submit an affidavit to the Planning Division that verifies the PWSF has been installed in accordance with the approved plans. 12) The applicant shall comply with federal standards for EMT emissions. Pursuant to FWCC Section 22-972, within six months after the issuance of its operational permit the applicant shall submit a project implementation report that provides cumulative field measurements of radio frequency (EMF) power densities of all antennas installed at the subject site. 13) A permit for a PWSF is subject to five- and ten-year permit limitations identified in FWCC Section 22-974, unless the City earlier removes the permit for nonconformance. CONCLUSIONS The proposal has been reviewed for compliance with the Federal Way Comprehensive Plan, pertinent zoning regulations, and other applicable City regulations. Based on the findings and conclusions of this. review, approval of the project is recommended. This decision shall not waive compliance with future City of Federal Way codes, regulations, and policies relating to this decision. ("WFI") to evaluate the existing Cingular Wireless "Dumas Bali' facility, number SS-65, with antennas on the PSE pole near 4451 SW 313th St, Federal Way, Washington, for compliance with current Federal Communications Commission (FCC) rules regarding human exposure to radiofrequency (RF) electromagnetic fields (EMFs). The Cingular Wireless facility includes panel antennas mounted atop a PSE utility pole. All of the Cingular antennas appear to be centered approximately 50 feet above ground level. Thus it is unlikely that anyone other than authorized RF workers could approach near enough to any of the existing antennas to cause that person's RF exposure levels to exceed FCC limits. It is expected that exposure conditions in all accessible ground level areas, and inside nearby buildings, due to the RF fields from the Cingular transmitting antennas are well below the FCC public exposure limits. To verify that the existing Cingular Wireless facility is in compliance with FCC rules regarding human exposure to RF fields, I have performed RF exposure measurements at various ground level locations to determine the exposure conditions that exist in publicly accessible areas near the PSE pole. MEASUREMENTS OF EXISTING RF EXPOSURE CONDITIONS NEAR THE PSE POLE The RF exposure measurements were performed on October 4, 2005. The measurements took place during a busy weekday afternoon, between approximately 3:30 p.m. and 4:00 p.m., when RF activity is expected to be at or near its highest level. Hatfield & Dawson Consulting Engineers K RF EXPOSURE MEASUREMENT EQUIPMENT The exposure measurements were performed using a NARDA Model 8718B Electromagnetic Radiation Survey Meter (S/N 0001) with a NARDA Model B8742D Isotropic Shaped Electric Field Probe (S/N 05003). This meter and probe combination is a broadband instrument which measures power densities over a wide spectrum as required by IEEE Standard C95.3-2002, "IEEE Recommended Practice for Measurements and Computations of Radio Frequency Electromagnetic Fields With Respect to Human Exposure to Such Fields, 100 kHz-300 GHz." The NARDA RF survey equipment provides an output proportional to the FCC general public (Uncontrolled Environment) maximum permissible exposure (MPE) over a very wide frequency range. The meter/probe combination is sensitive to all RF signals in the frequency range of 300 kHz to 3.0 GHz. Therefore the equipment used during the survey, which has been factory - calibrated within the past twelve months, responded to RF signals from all significant transmitters at or near the Cingular facility. RF EXPOSURE MEASUREMENT METHODOLOGY Measurement procedures were performed in accordance with methods described in OET Bulletin 65, August 1997, "Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields," IEEE Standard C95.3-2002, "IEEE Recommended Practice for Measurements and Computations of Radio Frequency Electromagnetic Fields With Respect to Human Exposure to Such Fields, 100 kHz-300 GHz," and NCRP Report No. 119, `A Practical Guide to the Determination of Human Exposure to Radiofrequency Fields." The measurement survey was conducted in accessible outdoor areas near ground level. The survey included the street adjacent to the PSE pole, and the nearby SW 313th St cul-de-sac. Measurements were made during weekday business hours when, the Cingular transmitters, and all other nearby transmitters, are expected to be operating at or near full power. Hatfield & Dawson Consulting Engineers 3 During the measurement period, accessible areas were scanned with the measurement probe over an area equivalent to that of the human body (one by two meters). At the locations of the highest RF exposure readings, the probe was moved from close to ground level up to a height of approximately 2 meters (6' 7"). During this procedure, the "Spatial Averaging" feature of the survey meter was activated to capture spatially averaged RF exposure levels in accordance with IEEE Standard C95.3-2002. EXISTING RF EXPOSURE ENVIRONMENT The maximum RF exposure levels due to the combined effects of the various wireless facilities operating on and near the PSE pole were found to be well below FCC Public MPE limits. The highest measured exposure level was found to be approximately 0.26% of the Public MPE limit. The location of this measurement was in the middle of SW Dash Point Road approximately 20 yards southwest of the utility pole. All other ground level locations, including along both sides of SW Dash Point Road, and the nearby SW 313th St cul-de-sac, had measured exposure levels less that 0.26% of the public exposure limit. CONCLUSION Wireless facilities are required to comply with the FCC "Rules & Regulations" CFR 47 §1.1310, Radiotrequency radiation exposure limits. Compliance is determined by comparing RF field measurements and predictions with the general population/uncontrolled environment (i.e., "Public") Maximum Permissible Exposure limits (MPEs) allowed by the FCC rules, as specified in CFR 47 § 1.1310. Based on RF exposure measurements, the existing Cingular Wireless facility operating from the PSE utility pole near 4451 SW 313th St, Federal Way, Washington, is in compliance with current FCC rules regarding human exposure to radiofrequency electromagnetic fields. Hatfield & Dawson Consulting Engineers 4 This conclusion is based solely on the comparison of measured RF exposure conditions in specific areas with the corresponding safe exposure limits set forth in the FCC rules. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. INTERFERENCE The transmission equipment for the Cingular Wireless facility is certified by the FCC under the equipment authorization procedures set forth in Part 2 of the FCC rules. This assures that the wireless facility will operate only within the desired cellular and PCS frequency bands, and that spurious emissions are within FCC specifications. Thus the existing Cingular Wireless facility is unlikely to interfere with the reception of area television or radio broadcasts, other adjacent or neighboring transmission or reception functions, or the functioning of any other electronic devices. The opening to the ground equipment area is located five feet east of the western landscape edge, not, according to the submitted plans, approximately eleven feet east of the western landscape edge. B Setback Requirements Pursuant to FWCC Section 22-967(2)(e), within residential zones, equipment enclosures located above ground on properties adjacent to the public right-of-way shall meet all applicable yard requirements for residential development of the underlying zone. The required rear yard for the underlying zone is five feet. As a result of a site inspection on March 2, 2005, the City determined that the site is not in compliance with FWCC yard requirements. Pursuant to FWCC Section 22- 1133(5), fences and railings not over six feet in height may be located in required yards. The inspection revealed that the west and east sides of an eight -foot high wooden fence is located in a required yard. You have proposed to relocate the eight -foot high wooden fence three feet east. As a result of this alteration and in consideration of your noncompliance with yard requirements, please revise your plans to meet the code requirements. You may either lower the height of the fence that is located within the five-foot required yard to six feet or you may entirely remove the parts of the fence located within the five-foot required yard. C Landscaping Requirements As a result of a landscape inspection on March 2, 2005, the City determined that the site is not in compliance with Federal Way City Code (FWCC) landscape maintenance standards.' The inspection revealed that there were at least eight missing evergreen trees, five dead evergreen trees, six missing small shrubs, and no groundcover. You have proposed to relocate the east landscape buffer three feet east and add three feet of landscape buffer north and south of the ground equipment area. Asa result of these alterations and in consideration of your noncompliance with landscape maintenance standards, please submit a landscape plan prepared by a Washington State licensed landscape architect that addresses the following items: Pursuant to FWCC Section 22-1564, all outside storage areas shall be fully screened by Type I landscaping a minimum of five feet in width. Pursuant to FWCC Section 22-1565, Type I landscaping consists of 100 percent evergreen treesz, tan shrubs, and groundcove? so that a 100 percent sight obscuring landscaping screen is achieved within three years from the time of planting; or a combination of 75 percent evergreen and 25 percent deciduous trees (+/- 5%), with large shrubs and groundcover backed by a 100 percent sight obscuring fence. Tree, shrub, 1 Pursuant to FWCC Section 22-1569, maintenance of planted areas shall include continuous operations of removal of weeds before flowering; mowing; trimming; edging; cultivation; reseeding; plant replacement; appropriate fertilization; spraying; control of pests, insects, and rodents by nontoxic methods whenever possible; water; or other operations necessary to assure normal plant growth. 2 Pursuant to FWCC Section 22-1564, evergreen trees at the time of planting shall measure six feet in height. 3 Pursuant to FWCC Section 22-1564, groundcovers shall be planted and spaced, using a triangular planting arrangement, to result in total coverage of a landscaped area within three years. 4 Pursuant to FWCC Section 22-1564, deciduous trees at the time of planting shall have a caliper of 1.5 inches measured 4.5 feet above the root ball or root structure. 5 Pursuant to FWCC Section 22-1564, large shrubs shall be 24 inches in height (measured from top of shrub to the ground) at the time of planting. 05-100658 Doc. Pursuant to FWCC Section 22-1564(1), required landscaping areas shall contain at least four inches of topsoil at finish grade. D Application Requirements Pursuant to FWCC Section 22-970, permit applications shall include photo simulations of the proposed facility from affected properties and public rights -of -way at varying distances. You have proposed to remove two existing antennas and install three new panel antennas at exactly the same height. Since your plans do not include this information, please include it in the revised plans in order to meet the code requirements. Civil enforcement of the provisions of the FWCC and the terms and conditions of any permit or approval shall be governed by FWCC, Chapter 1, Article III, "Civil Enforcement of Code." In order to avoid code enforcement action, the applicant must bring the site into compliance within 90 days of issuance of this letter. The site must be brought into compliance either as a part of the project currently under review or as a separate independent action. If the applicant chooses to bring the site into compliance independently from the current project, the following must be implemented: 1. Lower the height of the wooden fence that is located within the five-foot required rear yard to six feet or entirely remove the parts of the wooden fence that is located within the five-foot required rear yard. 2.
