Dear Mr. Korostlev:
The City of Federal Way's Community Development Department has received your request for
information regarding the zoning and permitting requirements for a dual use retail/entertainment type
establishment. The proposed establishment would be part of SeaTac Plaza, located at 2120-2210 South
320'h St, Parcel # 242320-0050. The subject site is zoned City Center Core (CC-C). The proposal would
establish a daytime use of tobacco and vaporizer product sales, and nighttime use of a member's only
hookah lounge; this proposal would not include the sale of alcohol.
Tobacco and vapor product sales would be permitted pursuant to Federal Way Revised Code (FWRC)
19.225.020. With regards to the nighttime use of a member's only hookah lounge, Revised Cade of
Washington (RCW) 70.160 prohibits smoking in public places within Washington State. Therefore, a
conflict arises with state law when applying FWRC 19.225.040 "Private club or lodge" for the use of a
hookah lounge. Given this information, the City is not permitting hookah lounge establishments at this
time.
To move forward with a tobacco and vapor product sales use, the review process would be contingent
upon the type of improvements that were being proposed at that time, if any. This would likely be in
conjunction with either an associated building permit or business license. Contact me if you would like to
go forward in this direction and we can discuss a specific proposal.
