The applicant proposes to add two panel antennas and ancillary ground equipment to the existing facility. The Process III Master Land Use (MLU) application submitted April 6, 2012, is hereby approved based on the enclosed findings of fact, incorporated into this decision in full, and the following conclusions based on those facts: 1. The proposal is consistent with the comprehensive plan; 2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC); 3. The proposal is consistent with the public health, safety, and welfare; 4. The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal; 5. The proposed access to the subject property is at the optimal location and configuration; and 6. Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated. The remainder of this letter outlines the land use review process required for this particular site improvement; summarizes the State Environmental Policy Act (SEPA) process; and provides other procedural information. This land use decision does not authorize initiation of construction activities. SITE PLAN REVIEW PROCESS Pursuant to FWRC 19.15.030(3), improvements and/or additions to an existing developed site that are not exempt from SEPA shall be processed under Use Process III. The Director of Community and Economic Development will make the initial land use decision based on written comments and information gathered during site plan review. Any appeals of the decision will be decided by the Hearing Examiner after a public hearing. SEPA PROCESS The City of Federal Way issued a Determination of Nonsignificance (DNS) on May 9, 2012, pursuant to Washington Administrative Code 197-11-350. Following review of the environmental checklist, the city 131s. Ausink May 24, 2012 Page 2 determined the proposal would not have a probable significant adverse impact on the environment, and an Environmental Impact Statement would not be required, and no SEPA based mitigation was necessary. RIGHT-OF-WAY PERMIT & ELECTRICAL PERMIT REQUIRED This Process III land use decision does not constitute a right-of-way permit or electrical permit. The applicant shall obtain permits from the city prior to construction. Please contact the Permit Center at 253- 835-2607 for information regarding permit applications and requirements. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, not withstanding any program of revaluation. APPROVAL DURATION Unless modified or appealed, the Process III decision is valid for five years from the date of issuance of the decision. Time extensions to the decision may be requested prior to the lapse of approval following the provisions listed in FWRC 19.15.110. APPEALS The effective date of issuance is three calendar days following the date of this letter, or May 27, 2012. Pursuant to FWRC 19.65.120, this land use decision may be appealed by any person who submitted written comments or any person who has specifically requested a copy of the decision. Any appeal must be in the form of a letter delivered to the Community and Economic Development Department with the established fee and within 14 days after the effective date of issuance of this decision, or June 10, 2012. The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusion of the Director disputed by the person filing the appeal. The Federal Way Hearing Examiner will hear any appeals of the Process III decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. I.D. 61162 CITY OF Federal Way Exhibit A FILE Statement of Findings and Conclusions Federal Way Revised Code (FWRC) Chapter 19.65 `Process III Project Approval' AT&T Mobility — SS65 Dumas Bay - File 12-101543-UP The Planning Division hereby presents the following analysis to the Director of Community and Economic Development pursuant to content requirements of the Process III written decision as set forth in FWRC 19.65.100(4). I. FINDINGS OF FACT 1. Proposal — The project applicant proposes to install two new Long Term Evolution (LTE) antennas to an existing Personal Wireless Service Facility located on top of a Puget Sound Energy utility pole. Ancillary ground equipment will be added to the existing equipment cabinet enclosure. 2. Site — Antennas will be installed on public right-of-way on the north side of SW Dash Point Road east of the intersection of 47'h Avenue SW. Ground equipment installation is proposed on the adjacent parcel at 4451 SW 313th Street, Federal Way, WA 98023. The parcel is currently developed with a single-family residence. 3. Exempt Activity — Applicant proposes to remove one existing cabinet from the equipment enclosure and add two stacked cabinets with several other equipment additions. Proposed upgrades will occur within enclosure and no material expansions or changes to the architectural design of the enclosure are proposed. Therefore, these changes are exempt from PWSF standards set forth in FWRC Chapter 19.255 and are permitted outright with no further regulatory action required pursuant to FWRC 19.255.010(3)(g). 4. Prioritized Locations — Applicant proposes PWSF improvements in "appropriate public rights - of -way" or the fifth prioritized location set forth in FWRC 19.255.010(4). Higher prioritized locations were not feasible as this proposal is an upgrade to an existing facility. By choosing a higher priority location, redundant facilities would be created and possibly cause negative effects to the overall network. Staff finds the applicant has met the burden to utilize the fifth prioritized location. 5. Facility — The existing and proposed facility exceed microcell and minor facility thresholds defined in FWRC 19.05.130. Facilities exceeding such thresholds may be permitted if: (1) adverse visual impacts are not created; (2) equipment cabinets meet adopted development standards; and (3) the number of antennas and their size are appropriate for the location. All three criteria have been met as further analyzed in this document's findings. 6. Height — Applicant proposes to mount existing and new antennas on a replacement mounting extension near the top of the existing utility pole. This extension will cause the existing height of 52 feet to increase to 61.5 feet. The net height increase of 9.5 feet is within the allowable once - per -year 15-foot maximum increase pursuant to FWRC 19.255.020(1)(c). 7. Aesthetics — PWSF facility will be mounted parallel and as an extension to the existing utility pole. The applicant proposes to paint the antennas to match the color of the pole. Staff finds these measures appropriately mitigate visual impacts of the facility, cause no adverse cumulative effects, and meet aesthetic standards set forth in FWRC 19.255.020(1)(d). 8. Antenna Size — Proposed LTE panel antennas are eight feet in height and are needed to add 4g technology to the existing network. Existing antennas will remain for 3g data traffic. Antenna size meets eight -foot maximum requirement set forth in FWRC 19.255.020(1)(e). H. CONCLUSIONS OF LAW 1. Comprehensive Plan & Zoning — The site is within single-family high density residential (RS 9.6) comprehensive plan and zoning designations. PWSFs are a permitted use in RS zones pursuant to FWRC 19.200.190. 2. Site Plan Review Process —Pursuant to FWRC 19.15.030(3), improvements and/or additions to an existing developed site that are not exempt from SEPA shall be processed under Use Process III as set forth in FWRC Chapter 19.65. 3. State Environmental Policy Act (SEPA) — The proposed improvements are not categorically exempt from environmental review pursuant to Washington Administrative Code 197-11- 800(25)(a)(ii) as the facility is within a residential zone. Following review of the environmental checklist, the Responsible Official determined the proposal would not have a probable significant adverse impact on the environment, and an Environmental Impact Statement would not be required. The department issued a Determination of Nonsignificance (DNS) on May 9, 2012. The appeal period for the DNS expired May 23, 2012. No appeals were filed with the Federal Way City Clerk. 4. Public Notice & Comment — Pursuant to the city's environmental policy codified in FWRC 14.15.120, the department utilized the Optional DNS process and issued a combined Notice of Application and anticipated DNS, which was distributed and published in the Federal Way Mirror on the date of issuance. Distribution of the notice included one notice board posted onsite adjacent to the existing facility, City Hall, the two King County Libraries within the city limits, and mailed notices to property owners within 300 feet of the site. The department did not receive written comments regarding the Process III Master Land Use application or the environmental threshold determination during the comment period. 5. The proposal is consistent with the comprehensive plan — The applicant's proposal is consistent with the following goals and policies: LUG3 Preserve and protect Federal Way's single-family neighborhoods. LUP14 Maintain and protect the character of existing and future single-family neighborhoods through strict enforcement of the City's land use regulations. PUG1 Work with private utility companies to allow them to provide full and timely service that meets the needs of the City's residents and businesses, both present and future. PUG3 Process permits for private utility facilities in an efficient and timely manner, in accordance with franchise agreements, development regulations, the FWCP, and adopted codes. PUP17 The City should require that site -specific utility facilities such as antennas and substations be reasonably and appropriately sited and screened to mitigate adverse aesthetic impacts. 6. The proposal is consistent with all applicable provisions of the Federal Way Revised Code — The Process III application was reviewed and determined to be consistent under FWRC Title 19 — Zoning and Development Code. 7. The proposal is consistent with the public health, safety, and welfare —The proposal will provide updated technology to the network. No adverse impacts to adjacent parcels are anticipated as a result of the proposal. The Process III request has been reviewed under SEPA; the FWCP; and all applicable provisions of FWRC. 8. The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal — No significant adverse transportation impacts were identified by the city. This is an "unstaffed" facility with non -daily trips associated with the maintenance of the facility. Puget Sound Energy has not indicated there would be an adverse increase to electrical demand. 9. The proposed access to the subject property is at the optimal location and configuration — Access from adjacent SW Dash Point Road is the nearest and least obtrusive to neighboring residences. 10. Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated — This "unstaffed" facility requires no traffic mitigation as it will not generate regular trips to or from the site. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. The proposed modification consists of adding (2) new LTE antennas and ancillary equipment to the existing PSE utility pole. Proposed modifications do not change the use of the existing tower. AT&T proposes to increase the height of the utility pole from 52'-0" to 61'-6". There is no reduction, material change or adverse impact to landscaping, parking, utilities, approved architectural design, or environmentally critical areas as defined by FWRC 19.145. ANALYSES OF STEALTH SCREENING FOR PROPOSED FACILITY PER FWRC 119.225.020(4). The modification will not result in a change in visual impact, and is part of a technology upgrade being performed on AT&T/New Cingular Wireless's network, in order to improve service to its customers and strengthen reliability and capacity in its network. Pursuant to FWRC 19.255.020(20, PWSFs shall be screened or camouflaged through employing the best available technology and design. As proposed, the antennas are not overtly obtrusive. The proposed antennas will be painted to match the existing utility pole. The proposed equipment additions are exempt and no review is required as there are no material area expansions of the equipment area. Per the pre -application conference summary (#12-100713-00-PC), the submitted site plans do not need to depict existing landscaping around the existing enclosures. This is an existing wireless telecommunications facility located at the address referenced above. AT&T proposes to amend the facility to keep up with the demand while continuing to offer customers in the area quality service and access to greater and more advanced wireless services. The proposed change would add 4G technology to the site and would expand AT&T's 4G network footprint into and the immediate surrounding area. This proposed change would improve the on -street and in -car availability of 4G services (voice and data support for iPhone 4G phones for example) and would add in -building 4G services in the immediate vicinity of the site. Our current volume and payload data on this site shows a high amount of 3G data traffic. The new 4G technology will improve the overall internet/data experience of the customers in the area. This will mean faster data rate and higher efficiency. The proposed modification is part of an integrated network and if it is located too far or too close to an adjacent facility the network will not work. n The location of the site was picked because it is an existing facility. The proposed modification is part of 3 AT&T's network implementation plan to provide 4G LTE coverage in the Federal Way area. The proposed installation of the antennas/ancillary equipment is intended to operate using the existinU tt' EIVE® equipment and infrastructure at the established site. There are no alternative sites that would provide the needed height to allow for the proper functioning of the equipment. There are no multifamily, commercial, or industrial structures tall enough to meet the required height coverage for this site. Alternative sites that would provide the needed height coverage would mean that AT&T would need to propose a new wireless tower or utilization of a city light pole and locate its antennas on it or locate on a new multifamily structure and increase its height — these proposals would aesthetically be more detrimental to the neighborhood. A new facility would not be less intrusive than what is being proposed. The proposed location not only will provide the needed coverage for AT&T it will also lead to fewer adverse impacts on adjacent land uses. Here, collocating the replacing the antennas contains the impacts of the additional antennas to a single location, thus impacting fewer properties. In addition, utilizing the existing equipment lease area and ground equipment further reduces impacts to other properties in the area by avoiding duplicate ground installations at multiple locations, eliminating the need for extensive trenching between the existing ground equipment and alternative locations. In addition, the proposed facility is a passive use; there are no activities that will produce airborne emissions, odor, vibration, heat, glare, or noxious/toxic materials. The site will operate continually, 24 hours a day for seven days a week. The site will be unmanned, requiring only frequent visits by maintenance personnel, typically once a month. Due to the limited amount of traffic generated by the proposal, no off -site street improvements are required for this application. The facility will not require water or wastewater facilities or contribute to erosion due to storm water run-off. The construction valuation is $15,000.
