The Process I MLU application is hereby conditionally approved pursuant to conclusions based on findings made by the department's Planning Division. CONCLUSIONS Various sections of the zoning and development code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020: 1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Personal Wireless Service Facilities; and Professional Office (PO). 2. The health, safety, and welfare of the citizens of the city are preserved. 3. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA review. FINDINGS The zoning for the site is Professional Office (PO). The existing Verizon Wireless Personal Wireless Service Facility (PWSF) is an allowed use in the PO zone. The PWSF antennas are mounted to an existing Puget Sound Energy (PSE) utility pole located in the right-of-way, and ground equipment on a cement pad on an adjacent parcel of land. No work is proposed to the pole or antennas. The generator addition was reviewed as an administrative land use process pursuant to Federal Way Revised Code (FWRC) Chapter 19.55, `Process I — Director's Approval'. The proposed diesel generator is to be installed on a new 4' x 8' concrete slab at grade, next to the existing fenced equipment enclosure. An 8-foot-tall cedar fence with gate creates a solid screen of the generator and associated equipment. The fence incorporates sound attenuation materials and noise barriers for sound absorption. The increase of fence height of 8 feet is also proposed to mitigate any negative noise impacts to the multi -family residential zone to the north, and to meet FWRC 7.10.050, which adopts by reference the maximum environmental noise levels per Washington Administrative Code (WAC) 173.60. Ms. Zavales September 11, 2014 Page 2 The generator and fence meets the required 20-foot setback from all property lines. Additionally, five-foot landscape buffer, consisting of arborvitae shrubs, is proposed around the enclosure. However, per FWRC 19.210.050, at a minimum, a five-foot type III landscaping area is required around the facility. Type III landscaping is a visual buffer, including a mixture of evergreen and deciduous trees interspersed with large shrubs and groundcover. Prior to building permit approval, a revised landscape plan will be required, depicting Type III landscaping in the proposed 5-foot landscaped buffer area. The generator does not reduce the amount of required landscaping, buffering, open space, or public areas; and does not alter pedestrian connections, utilities, or easements. CONDITION OF APPROVAL Prior to building permit approval, a revised landscape plan must be submitted depicting Type III landscaping (shrubs, trees, and groundcover) in the 5-foot landscape buffer area. ADDITIONAL PERMIT ISSUANCE REQUIRED Prior to any site work, the applicant shall obtain a building and electrical permit from the city's Building Department. APPEALS The effective date of this decision is September 14, 2014, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by September 30, 2014. Any appeal must be in the form of a letter delivered to the Department of Community and Economic Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. We're currently working on a project for Verizon Wireless called SEA SW 3201h. On this site, Verizon Wireless is proposing the addition of a 30kW diesel generator. Through Becky Chapin, I received the following comment from the Public Works Department. " Please have the applicant explain how they will be meeting storm water source control requirements in accordance with the iCmQ County Stormwater Pollution Prevention Manual." In review of the KC SPPM, it seems that the section in concern would be the "Storage of Liquid Materials in Stationary Tanks" (section III subgroup A-2). Please see the following notes regarding BMP's being implemented in regards to this section of the code. BMP1 o This BMP is being met through the use of a double walled diesel tank. If the tank is ruptured in any way, the second level of containment will prevent a spill of the diesel. The spec sheet on MS-15 (sheet 9 of the PDF) of the plans labels the tank as "210 gallon double -walled UL listed Washington State compliant sub -base fuel tank, 125% containment with stub -up area". BMP2 o There are no catch basins in the immediate vicinity of the generator. BMP3 o All maintenance will be performed within the housing of the generator. The top of the tank has a lip that will contain small drips and spills. o A spill cleanup kit will be kept in the equipment compound adjacent to the generator compound. All Verizon Wireless service techs will be familiar with the use of this equipment. o The generator diesel tank will be equipped with spill/leak alarms. Any leaking of the tank will trigger the alarm and alert Verizon Wireless service techs remotely. Causes for the leak will then be dealt with immediately. o The generator will be continually monitored remotely and inspected routinely. I MIR Additional BMP's o The generator will be installed with a 5 gallon spill/fill box. This box will prevent the accidental spilling of diesel fuel while filling the 210 gallon tank. The property is zoned PO. There is an existing wireless facility at this location which presently consists of equipment surrounded by fencing. This proposal would create a new fenced area by the aforementioned 4'8" x 107' and the generator would be placed within the fenced area. The fence is proposed to be 8' in height and built with sound attenuation materials (wood with sound barrier and sound absorbing materials installed between the vertical posts). The proposed fence height of 8' exceeds the standard -allowable height of 6' and we will be applying for a separate, structural permit for the fence. The generator area meets the required setbacks of 20' from all property lines. The site will be also be surrounded by a five-foot landscape buffer, consisting of arborvitae (3 gallon size, 4 to 5 feet in height), planted at 3' OC minimum, or as otherwise recommended by the City. The proposed generator is for back-up emergency power outages and therefore provides public benefit. The generator will run during power outages and during routine, once a week testing. We have included a Noise Study for the proposal, which states with proper sound attenuation with noise barriers, sound absorptive material and raising the fence level to 8' will achieve the 15-minute noise limit of 62 dBA during daytime maintenance cycling at the nearest receiving property. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. Ambient Conditions Existing ambient sound levels of the site were measured on August 1, 2014 with a Larson - Davis 824 sound level meter. Measurements were conducted as close to the proposed location as possible. The average ambient noise level was 66 dBA primarily due to traffic from SW 320th Street. The weather during the measurements was overcast with dry roads. Code Requirements The site is located within the City of Federal Way Zoning jurisdiction on property designated with a PO (Professional Office) zoning. The nearest receiving property, to the north, is zoned RM3600 (Multifamily Residential). The proposed new equipment consists of an emergency generator. The generator will run once a week during daytime hours for maintenance and testing purposes only. Federal Way Municipal Code Section 7.10.050 adopts by reference the maximum noise levels set forth in WAC 173-60. Under WAC 173-60-040, noise from equipment on a Class B EDNA (Commercial) property is limited as follows: Class A EDNA (Residential) Receiver: Noise is limited to 57 dBA during daytime hours. Additionally, WAC 173-60-040 allows that during any one -hour period, the maximum permissible noise level may be exceeded by 5 dBA for a 15 minute period. Therefore, the generator must not exceed 62 dBA when running during daytime hours for maintenance testing.
