The proposed use is a church located at 34211 Pacific Hwy South. Based on analysis of the proposed use and the Federal Way Revised Code (FWRC), a "change of use" has not been triggered (please see condition on page 2). The site is located within the Commercial Enterprise (CE) zone and church uses can be established in the CE zoning district pursuant to FWRC 19.240.160. As stated in the change of use analysis handout you provided, the proposed tenant space is currently leased by a chiropractic clinic. The New Community Church of Federal Way's hours of operation would be Sunday with services from 10:00 to 11:30. Additional services include Sunday school, nursery care during services, monthly board meetings, and an office and library for the pastor. As defined in FWRC 19.05.030, a change of use is determined to have occurred when it is found that the general character of the operation has been modified. This determination shall include review of, but not be limited to, hours of operation, required parking, traffic generation, general appearance, outdoor storage, and surface water runoff of discharge. Additionally, proposed tenant improvements under review, file 12-100401-00-UP, include providing more paved parking stalls around the perimeter of the building, which would go toward satisfying the parking requirement if approved. Based on this analysis, it is found that the establishment of a church use in the existing tenant space would not modify the general character and does not constitute a change of use. As there is no "change of use," and as long as there are no negative impacts on required landscaping, required parking, existing architectural design, or to sensitive areas, the proposal is not subject to any further land use review. However, the proposed use is subject to the following condition: CONDITION: Any increase in the size of the congregation must stay consistent with the required number of parking stalls. The New Community Church shall contact the City to verify adequate parking in the instance of an increase in congregation size. A separate building permit application is required for any interior tenant improvements and/or change of occupancy analysis.
