The Process I application is hereby conditionally approved based on the enclosed Findings of Fact and Conclusion and the condition noted below. Condition of Site Plan Approval 1. Before beginning work, the applicant shall obtain a City of Federal Way electrical permit. Procedural Information The effective date of the decision is October 18, 2005. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services (33325 8th Avenue South, PO Box 9718, Federal Way, WA 98063-9718) on or before November 1, 2005, by any person who submitted comments or received a copy of this decision. No work on the proposal can commence until the end of the appeal period. Because you are the only party of record, you can waive your right to appeal this decision by submitting a written waiver request to the address above. Approval is effective once the waiver request is received, and work on the project can proceed immediately, provided you have obtained the necessary building permits. The City must receive this waiver request in writing. Unless modified or appealed, this Process I approval is valid for one year from the effective date of this decision. PROJECT DESCRIPTION On behalf of Clearwire, the applicant proposes to collocate a sectorized antennae array at 83 feet above ground level, and two microwave dishes at 79 feet above ground level, on an existing, 117-foot tall monopole owned by American Tower Corporation. American has agreed to the proposal. The tower site is in the northwest corner of the 50-acre U.S. Postal Service's Bulk Mail facility. Ground facilities are not visible from the public right-of-way. FINDINGS OF FACT 1. The subject property is zoned Office Park (OP) and is subject to all policies of the Federal Way Comprehensive Plan (FWCP). The proposed development is permitted, subject to administrative review and a Director's Decision. 2. Current uses of the project site and surrounding areas include: Project Site: Government facility North: Assisted living and retail, zoned BN and OP South: Hospital, zoned OP East: Office, zoned BP West: Financial services and multi -family residential, zoned OP and RM 2400 3. The project does require an electrical permit pursuant to the National Electrical Code (NEC). 4. The project is exempt from review under the State Environmental Policy Act (SEPA). 5. The project does not meet any of the conditions outlined in Federal Way City Code (FWCC) Section 22-334 that would require the applicant to rectify nonconformances on the subject property. 6. There are no changes to use, lot size, lot coverage, setbacks, height, outdoor storage/use, critical areas, or landscaping resulting from this project. The aerial equipment has been designed and located to minimize visual and aesthetic impacts within the tower's view shed. 8. The proposal has been reviewed for consistency with all applicable environmental and zoning regulations, including FWCC Article XI "District Regulations," and Article XIH "Supplementary District Regulations." 9. Pursuant to FWCC Section 22-354, and the forgoing findings, the proposal is found to be consistent with the FWCP, all applicable provisions of the FWCC, and with the public health, safety, and welfare. CONCLUSION The proposal has been reviewed for compliance with the FWCP, pertinent zoning regulations, and other applicable City regulations. Based on the findings and conclusions of this review, approval of the project is recommended. Clearwire is utilizing a higher priority location. 2. Section 22-967.1.: PWSFs Located Outside Public ROW. "PWSFs mounted on existing buildings and structures not located in a public right-of-way shall conform to the following development standards: a. The PWSF shall consist only of the following types of facilities: i. A microcell or a minor facility; or". The proposed facility will only require 4 antennas and 2 small microwave dishes. The dimensions of the antennas are 36" x 6" x 4", and the dimensions of the microwave dishes are 24" x 24". The equipment shelter will occupy roughly 4' x 4' of the 7 x 7' lease area. ii. A PWSF that exceeds the minor facility thresholds. N/A 3. Section 22-967.4.: Scregnin Standards. "PWSFs shall be screened or camouflaged through employing the best available technology and design, as determined by the city. This may be accomplished by use of compatible materials, location, landscaping, color, stealth techniques such as, but not limited to, artificial trees and hollow flag poles, and/or other methods or techniques to achieve minimum visibility of the facility as viewed from public streets or residential properties. In addition, the provision for landscaping as outlined in the use zone charts. The antennas will be flush -mounted within 8" to the existing monopole and will be painted to match the color of the pole to minimize visual impact. The equipment shelter will be placed inside the existing compound to screen the shelter from view. 4. Section 22 967.5.a.: Standards for Electronics Bquipment Enclosures. "The following shall be the required order of locations for proposed electronic equipment enclosures for all PWSFs. In proposing an equipment enclosure in a particular location, the applicant shall analyze the feasibility of locating the proposed equipment enclosure in each of the Site M WA-TAC152-A CLS G ro Zip. In requesting a lower priority location for the equipment enclosure, the burden of demonstrating impracticability shall be on the applicant. In order of preference, the prioritized locations for equipment enclosures are as follows:" a. Underground equipment enclosures. The existing compound contains underground cable. It would not be feasible to require other carriers to move their coax in order for Clearwire to be able to locate their equipment underground. b. Existing Completely Enclosed Buildings. The existing compound does not include an existing completely enclosed building with space for Clearwire's equipment. c. Equipment enclosures shall be placed above ground in an enclosed cabinet that shall not exceed six feet in height and occupy more than 48 square feet of floor area, including areas for maintenance or future expansion." Clearwire's equipment shelter will be five feet in height and occupy roughly 16 square feet of floor area. The shelter may not be expanded to more than 48 square feet of floor area, as some portion of the 49 square foot lease area must be left open to allow for access to Clearwire's equipment. Also, the equipment will be placed in the existing enclosed compound. d. New Completely Enclosed Above Ground Building. N/A 5. Section 22 967.4.b.: EgIdgment Shelter Screenin and Landsca in . Clearwire is proposing to place their equipment shelter inside an existing compound that already is screened from view and landscaped. Thus, this section does not apply to Clearwire's proposal. 6. Section 22-967.4.c.: Equipment Setbacks. The height of the existing monopole will not be extended, and Clearwire's equipment shelter will be placed within the existing compound. Thus, the city's setback requirements will be met by Clearwire's proposal. 7. Section 22 967.7.: Secu-ri Fenem . Clearwire will utilize the existing security fencing around the existing compound. Thus, this section does not apply to the proposal. 8. Section 22-967.8.: Cumulative Visual Effects. "The city shall consider the cumulative visual effects of PWSFs mounted on existing structures and/or located on a given permitted site in determining whether additional permits may be granted so as to not adversely effect the visual character of the city. The antennas and microwave dishes that Clearwire plans to add to the existing monopole will not significantly alter the visual effect of the existing tower. The antennas and microwaves that Clearwire proposes will be flush -mounted to the existing structure and are much smaller than existing antennas on the tower. The visual character of the city will not be adversely affected. 9. Section 22-970: Application Requirements. a. A diagram or map showing the primary viewshed of the proposed facility. Clearwire is proposing to use an existing 120' monopole on the property, thus utilizing the best possible option in this area to meet their coverage objectives. b. Photosimulations of the proposed facility from affected properties and public rights -of -way at varying distances. Please see the attached photosimulations. c. Architectural elevations of proposed facility and site. Please refer to the attached site plan and construction drawings. d. A coverage chart of the proposed PWSF at the requested height and an explanation of the need for that facility at that height and in that location.
