Request to Waive Sidewalk Requirements
Dear Mr. O'Brien:
The City has reviewed your request to waive sidewalk requirements for South 296th Street.
After evaluating the existing and proposed conditions, review of Federal Way City Code (FWCC)
provisions (Sections 22-1474, 22-1477, 22-1496), and direction provided by the City Council,
the Public Works Department hereby denies the request to waive sidewalk, based upon the
following reasons allowed by code to be considered:
1. The improvements as required would not be harmonious with existing street
improvements, would not function safely or would not be advantageous to
the neighborhood or City as a whole.
Your project meets the threshold requiring full street improvements under
FWCC provisions, as well as established City policy requiring incremental
improvements as development occurs. The improvements will function safely
with the existing street. Therefore, this reason does not apply.
2. Unusual topographic or physical conditions preclude the construction of
improvements as required.
There are no unusual topographic or physical conditions precluding the
installation of sidewalk. This reason does not apply.
3. Proper vertical or horizontal alignments cannot be determined because the
existing streets do not have correct alignments.
The horizontal and vertical alignments of South 296th Street are established.
The new frontage improvements augment the existing street improvements
and will align horizontally with the existing street centerline. The new
improvements will be an extension of the existing vertical alignment.

4. The required improvement is part of a larger project that has been scheduled
for construction in the City'; Capital Improvements Program.
This is not part of a larger scheduled project, therefore this reason does not
apply.
Therefore, the street frontage improvements for South 296t'' Street, as described in the City's
November 9, 2007 letter, Right -of -Way Modification Request Response, will be required to be
constructed as part of the development of this property. Sidewalk must be included.

1846 S 296" Street, Cantu Short Plat
I am asking for a review of sidewalk modification for the Cantu Short Plat. The request
is for no new sidewalks on 296t' st. This is based on several factors.
1. Existing access for current house remains the same on 296t' st. with no new
access points. New access points are on 19tk' and 20''.
2. Please re -review based upon the number of total daily trips existing and new daily
trips incurred to justify the amount of right of way and sidewalk improvements.
3. Environmental impact on cutting down potentially (8) 12" or greater diameter full
grown trees. Removing said trees will take away from the beauty of the lots and
affect the charm and aesthetics of the neighborhood.
4. This will cause the movement of 2 utility poles and therefore costing a huge
amount that is not necessary for a small subdivision and small developer in hard
economic times. Especially in this difficult real estate market.
5. New sidewalks do not fit the neighborhood. There is no existing sidewalk to
connect the proposed sidewalks to. There are no other sidewalks on 296t' street.
There are no other properties around that can be subdivided to match up with new
side walk in the future.
In final, I am asking the city attorney to please review based on the 5 conditions I have
stated.

Right -of -Way Modification Request Response
Dear Ms. Kondelis:
This letter is in response to your request to waive the right-of-way improvements adjacent to the
property, as part of your project. As per Federal Way City Code (FWCC) Section 22-1477, the
Public Works Director may grant a request to modify, defer, or waive the required street
improvements only after consideration of four specific reasons. The reasons you cite in your
request are contained in FWCC 22-1477 (1) "The improvements as required would riot be
harmonious with existing street improvements... (and) would not be advantageous to the existing
neighborhood or city as a whole ", and (3) "Proper vertical or horizontal alignments cannot be
determined because the existing streets do not have correct alignments. "
■ le Avenue South - Corresponds to City Street Section `W', consisting of a 28-foot
paved roadway with curb and gutter, four -foot planter strips with street trees and street
lights, five-foot sidewalks, and three-foot utility strips, within a 52-foot right-of-way.
Assuming a symmetrical cross section, a one -foot right-of-way dedication and half -street
improvements are required as measured from the street centerline.
South 296`h Street - Corresponds to City Street Section `S', consisting of a 36-foot paved
roadway with curb and gutter, four -foot planter strips with street trees, five-foot
sidewalks, three-foot utility strips with street lights, within a 60-foot right-of-way.
Assuming a symmetrical cross section, half -street improvements are required as
measured from the street centerline.
After evaluating the existing conditions along 19`h Avenue South and South 296t' Street, review
of FWCC provisions (Section 22-1477), and direction provided by the City Council, the Public
Works Department hereby denies your request to waive the required street improvements.

On August 9th, 2007 we attended a pre -application meeting for the Cantu short plat at the above referenced address.
The site is approximately three-quarters of an acre and currently has a single family home located on the site. The
proposal is for 4 new single family lots. The site is currently being served by paved roadways, S 296s Street and
19P Ave S both of which are categorized as local streets according to the City of Federal Way Street Map (copy
attached), but planned for Type S and Type W respectively. In the pre -application meeting it was discussed that we
would be required to install frontage improvements in accordance with FWCC Chapter 22, Article XVI, along both
street frontages. We are requesting a waiver from these improvements for the following reasons.
1) The site is located on the NE comer of S 296's Street and 19'h Ave S and there are no other frontage
improvements in the direct vicinity to connect to,, and therefore the new improvements would not be
compatible with the existing neighborhood.
2) Since both 196' Ave S and S 296 Street has no other improvements, alignments will be hard to propose.
3) The site is not located near any public facilities, or pedestrian oriented development, where there would be
an immediate need for pedestrian connectivity.
4) According to the City of Federal Way weekday ADT both 19'" Ave S and S 29e Street serves under 1,000
vehicles (see attached) per day. The conclusion is that the service of this street is very low, just a handful
of cars daily.
Given the reasons listed above we are requesting a waiver from the frontage improvements at this time. However,
we realize that in the future improvements may come through and therefore we are more than willing to provide the
appropriate dedication for future right-of-way improvement.
