Dear Mr. Salandi:
The Community Development Department has completed a review of your Process I Master Land Use
(MLU) application for the exterior site revisions and building revisions for the Northwest Kidney Centers at
the existing building at 33820 Weyerhaeuser Way South. The Process I application is hereby approved
pursuant to the findings and conclusions noted below.
FINDINGS
The zoning district for the subject property is Office Park-1 (OP-1), with a Concomitant Zoning
Agreement (CZA). The medical clinic is a permitted use in the OP-1 zoning district per the 1994 CZA.
• The proposal is to modify an existing 55,507 square foot, two-story office building with the following
additions and improvements: addition of a new patient entry, including an accessible ramp; addition of a
cover over the patient entry area; addition of a patient drop-off area; addition of a new truck loading
dock; revisions to the parking area, including eliminating eight parking spaces; and minor grading,
landscaping, and retaining walls.
The site and building modifications are all within the existing building envelope and existing parking area
envelope. The only additional exterior building area is the covered entry, which is approximately 75
square feet. The site modifications and exterior building modifications are subject to Process I review
pursuant to Federal Way Revised Code (FWRC) 19.15.030(1). Process I is an administrative land use review
process pursuant to FWRC Chapter 19.55, "Process I —Director's Approval."
• The interior of the tenant space is also being remodeled, but is exempt from land use review per FWRC
19.15.020.
• The increase of approximately 75 square feet of exterior gross floor area, and parking lot revisions do not
trigger nonconforming development compliance requirements set forth in FWRC 19.30.090.

• The proposed site modifications will result in a net reduction of eight parking stalls on -site, and with the
reduction of eight parking stalls, the subject property still meets FWRC parking stall count requirements.
Currently, there are 205 parking spaces on the subject property per the 2011 Red Plains Surveyor site
surrey. Elimination of eight parking spaces will result in the site having 197 parking stalls, which complies
with the minimum required parking stall count of 185 stalls, based on FWRC office use requirement of 1
stall per 300 square feet of gross floor area (55,507/300 = 185).
Also, the existing building has a shared access and parking agreement with three additional buildings, and
the parking for the four -building complex appears to meet the FWRC parking stall count requirement.
Neither die applicant nor city staff has a current parking stall count for the whole four -building complex.
However, in 1998 when the 260,000 square foot, four -building complex was reviewed under SEPA (Erie
98-101406-SE) and Binding Site Plan review (file 98-10140¢SU), the project documents showed that the
four -building office complex had a surplus of approximately 228 parking stalls. A total of 1,095 parking
stalls were originally planned for the 260,000 square foot four -building complex. The FWRC required 867
parking stalls, based on 1:300 square foot parking ratio (260,000/300= 867). Therefore, after the
elimination of eight parking stalls as proposed, the four -building complex has a surplus. of approximately
220 stalls.
• A bald eagle nest has been located in a cottonwood tree approximately 500 feet from the existing
building. The applicant must comply with the Eagle Nest Plan approved by the Washington Department
of Fish and Wildlife (WDFW) executed in September 1999, including the seasonal construction
restrictions shown on note number 20 of the East Campus Corporate Park Parcel 3 Binding Site Plan
recorded in Volume 3 Page 7 (Recording No. 2000320001458).
• The proposed improvements do not exceed allowable building height; do not reduce the amount of
required landscaping, bufferia&or screening; and do not change access, pedestrian connections, or
easements. The structure meets all of the minimum setback requirements.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or uses
are permitted only if approved using Process I — Director's Approval. Based on the findings above, the
proposed improvements to the developed site meet the following Process I approval criteria and land use
review thresholds of FWRC 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19
including, but not limited to: Pen -nits and Review Processes; Process I — Director's
Approval; Office Park-1 (OP-1); and Nonconformance.
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is `minor new construction' and is categorically exempt from SEPA review per
the city's flexible thresholds per FWRC 14.15.030.
BUILDING PERMIT ISSUANCE REQUIRED
The city is currently reviewing the building permit (file 17-102042-00-CO) associated with the exterior and
interior improvements. No work may begin until the building permit is issued. Please contact the permit center at

APPEALS
The effective date of this decision is June 10, 2017, or three days from the date of this letter. Pursuant to
FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to
the Federal Way Hearing Examiner within 14 calendar days, or by June 26, 2017. Any appeal must be in the
form of a letter delivered to the Department of Community Development with the established fee. The
appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors
in the director's decision; including the identification of specific findings and conclusions made by the
director, disputed by the person filing. You may waive your right to appeal, if desired, by writing the city a
letter to this effect.
APPROVAL DURATION
Unless modified or appealed, the Process Z decision is valid for one year from the date of issuance of the
decision. A one-year time extension to the decision may be requested prior to the lapse of approval following
the provisions listed in FWRC 19.15.110. The improvements must be substantially completed within the one-
year time period., or the land use decision becomes void.
CLOSING
This land use decision does not waive compliance -,vith future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of the building

complex.
Also, they provided us with this survE, prom the building/property in 2011/2012. See attached. Additionally attached,

The survey notes 205 stalls upon the building lot. If we use, parking requirement (per code): 1 space per 300 SF of gross
floor area.
Building SF = 2 x 27,754 SF = 55,508 SF / 300 = 185 stalls required
Proposed Project Change: 205 (per survey) —13 stalls removed + 5 stalls proposed = 197 stalls result.
Does this provide the information you need for the parking counts or will you need to see additional documents from
the owners or record. We and/or KPFF could provide a memo with these backup documents attached to formally
respond to your concern if required.

The project site is located adjacent to Building D within the East Campus Corporate Park Ill.
The site address is 33820 Weyerhaeuser Way South in Federal Way, Washington, and is on
King County parcel 2154660040. Boundary limits are defined by parking lot drive aisles and the
exterior of Building D. Existing site conditions include a 55,775-square foot office building,
associated parking spaces, ADA parking spaces along the west side of the building, sidewalks,
access stairs to the south side of the building, landscaping, and a rockery wall along the east
side of the building.
Proposed interior improvements include the tenant improvements of a portion of the existing
office building into a medical office dialysis facility. The tenant improvements will convert a
portion of the first floor of the building from general office use to a clinic for the Northwest
Kidney Center. Proposed site improvements include constructing an ADA ramp, four standard
and one van accessible parking spaces, patient drop-off, concrete stairs, sidewalk, and canopy
on the south side of the building, and the construction of a loading dock on the east side of the
building.
This trip generation analysis is to compare the traffic impacts of the current usage of 13,589-
square feet of the first floor of the building, to the proposed use as a clinic for the Northwest
Kidney Center.

Hours of operation is 5:00 AM to 11:OOPM with the patient stay being typically 4 hours.

Conference room usage: twice a month with seven (7) persons in attendance.
Maximum daily trips would occur on Monday, Wednesday and Friday, with the conference room
being used on one of those days.
Therefore the maximum number of trips for the Northwest Kidney Center would be (34 patients
+ 12.5 employees + 7 conference rooms)* 2 trips per day = 107 trips per day.
Since the maximum trips generated by the Northwest Kidney Center (107 trips) is less than the
average daily week day trips of the existing office building (150 trips), there will be a decrease in
the number of trips being generated by the site.
