Public Works staff has completed a review of the revisions submitted for the proposed boundary
line adjustment. Several minor items need to be addressed prior to recording the document.
1. Show the existing north line of Lot "B" as a dashed line.
2. Note the easement and recording number of AF #2279404 on the BLA document.
3. All parties that have a interest in the properties must sign the mylar and have their
signatures notarized.
After the noted revisions are made, please return to the city the following items:
1. Original, signed mylar for recording.
2. One reproducible mylar.
3. Four sets of prints.
4. A check made payable to "King County Records and Elections" in the amount of $38.00,
for recording fee.

JANUARY 25, 1994
David Dean, attorney for Dollie Elving, phoned re status of application. Civil suit between
Elving and Laurie Lien (purchaser of Lot B) has not yet been resolved. Attempts are being
made to solve out of court. Ms. Lien's previous attorney was ill for some time. A new
attorney has been hired, with whom Mr. Dean is negotiating for a settlement.
Mr. Dean wanted to refresh his memory on the zoning and building setback requirements. Two
questions specifically asked which may require administrative decision on part of city:
+■ If necessary to resolve dispute, would city accept a setback of less than 5' on Lot
A? (Mrs. Elving's property). The net effect of this proposal would be to remove
the existing nonconformance on Lot B and create one on Lot A. The rationale
would be that the city agrees to "swap" one nonconforming setback for the other.
■ If answer to above question is yes, how would this prejudice Lot A in future
development proposals relative to the nonconforming setback, i.e., would the
nonconforming setback be defined as a legal nonconformance?
■ If the lot line is settled at location currently proposed, would that line prejudice
future additions/enclosures along north side of Lot B building. I reminded him
that the distance between that building & the lot line is not shown on the
drawings, and indicated that under zoning there could in the future be no further
encroachment of the porch area into the setback, although the existing porch
could potentially be enclosed within the existing footprint. Also stated that any
future expansion of the northerly walls of the main building could not extend
closer than 5' to the p/l.
