We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and Federal Way Fire Department. Some sections of the Federal Way City Code (FWCQ and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. For specific technical questions about your project, please contact the appropriate DRC representative as listed below. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Applicant proposes to remove and replace existing PSE pole with a new wooden pole that is 15 feet taller, from 38 to 58 feet; mount antennae; and construct and landscape a new equipment -cabinet compound on adjacent private property. The zone is Single -Family Residential (RS-15). MAJOR ISSUES outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. SEPA Review —This project is subject to environmental review under the State Environmental Policy Act (SEPA) (see D, "State Environmental Policy Act (SEPA)," below for details). 2. Equipment Enclosure Standards — As proposed, the equipment enclosures is not consistent with FWCC Section 22-967(5), which stipulates equipment enclosure configurations and their corresponding permitted locations (see F, "Development Standards," below for details). 3. Personal Wireless Service Facility (PWSF) Standards —As proposed, this PWSF facility is not consistent with FWCC Section 22-967(2), "Development Standards," which stipulates what types of PWSFs are permitted inside the public right-of-way (see F, "Development Standards," below for details). • Public Works Development Services Division Right -of --Way Permit —Work within the public right-of-way requires that a plan and bond be submitted and approved by the Public Works Department. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions please contact the representative listed for that section. PLANNING DIVISION (Jeff O. Johnson, 253-835-2626, 'eff'.'ohnson ,cii offederal"-ay.coxn A. Land Use Review Process, Use Process III — Applications subject to review under SEPA are processed consistent with FWCC Chapter 22, Article VI, "Process III Review — Project Approval." This application will be reviewed accordingly and for compliance with the standards of the FWCC contained in Chapter 22, Article XI, "District Regulations for the Single -Family Residential Zone (RS 15.0)," and applicable sections of Chapter 22, Article IV, "Nonconformance"; Article XIII, "Supplementary District Regulations"; Article XIV, "Critical Areas"; Article XV, "Parking"; Article XVI, "Improvements"; Article XVII, "Landscaping"; and Article XIX, "Community Design Guidelines." The City has 28 days from the date of submittal to determine whether an application is complete. Once the application is deemed complete, public notice of the proposal is issued, followed by a 14-day public comment period. The City then begins technical review of your project and has 120 days from the date the application was deemed complete to arrive at a decision. If additional information is requested by the reviewer anytime during review, the countdown to the 120-day deadline will stop, resuming 14 days after receipt of the requested information. At the conclusion of the staff review process, recommendations are forwarded to the Director of Community Development Services, who then issues a written decision, followed by a 14-day appeal period. Unless there is an appeal of the director's decision, no public hearing is required. File N05-105812-00-PC Doc.1. D. 34079 Ms. Madeline Chaney Page 3 December 19, 2005 Submittal Requirements — An application submittal must meet minimum requirements, listed in the enclosed form, "PWSF Development Requirements." Plan/Drawing Requirements — Drawings must meet minimum standards, listed in the enclosed "PWSF Development Requirements" under "General Plan Standards." PWSF Fee for Use Process III— Fees associated with this application total $2,071.50. A check for the full amount of the fees must accompany the application at the time of submittal. Fees are subject to change annually. B. Nonconformance Threshold — Pursuant to FWCC Section 22-334(3)(b), construction of a new and separate structure on the subject property, a developed site, constitutes an increase in floor area, thereby triggering City code nonconformance requirements. Consequently, if any aspect, structure, improvement, or development in the geographic portion of the site on which the expansion occurs does not conform to current development requirements, it must be remedied. C. Critical Areas —Based maps and inventories available at the time of my preapplication analysis, there does not appear to be any critical areas on or around the subject property. Critical area conditions will be verified during the formal development review process. D. State Environmental Policy Act (SEPA) Review — PWSFs are exempt from SEPA review only if they are not in a critical area and meet one of three criteria outlined in Washington Administrative Code (WAC) 197-11-800. This project meets none of the WAC criteria and is therefore subject to environmental review under the SEPA. Please submit a completed environmental checklist at the time of your formal application. It may be possible to supplement and adopt a SEPA checklist previously completed for this site (file number 04-102099-00-SE). You may be able to acquire this checklist by submitting a public records request to the Office of the City Clerk. I have enclosed a public records request form. SEPA Fees — Fees for SEPA review of this project total $832.50. These fees are in addition to any land -use review fees and must accompany the application at the time of submittal. Fees are subject to change annually. E. District Regulations, Permitted Uses — PWSFs are permitted in the RS 15.0 zone, subject to approval of the Director, consistent with FWCC Chapter 22, Articles II, V, and XI. This proposal is located in a single-family residential zone (RS 15.0); the height limit is 67 feet and the proposed structure height is 59 feet. Facility Collocation — The proposal is for a permanent collocation on an existing PWSF at 1030 SW Dash Point Road. City code requires that PWSF providers cooperate with other providers in collocating facilities. Please submit a collocation agreement with your formal application. F. Development Standards, Cumulative Impacts — City code requires that the formal review consider the cumulative visual effects of a PWSF. Please submit photos of the existing facility and photo simulations of the proposed facility. The location you have proposed (a pole in the right-of-way) is fifth in order of the preference stipulated by City code. Provide analysis and documentation in support of rejecting the higher priority sites. Preferred Equipment Enclosure Location — Pursuant to FWCC Section 22-967, PWSF equipment enclosure sites must be considered in priority order. The location you have proposed (above ground in a compound) is third in order of preference, as. stipulated by City code. Provide analysis and documentation in support of rejecting the higher priority sites. Equipment Enclosure Standards — As proposed, the equipment enclosures is not consistent with FWCC Section 22-967(5), which stipulates equipment enclosure configurations and their corresponding permitted locations. To comply, the equipment enclosure must be no taller than six feet, or the equipment enclosure must be located in an enclosed building, or the equipment enclosure must be located underground. PWSF Standards — As proposed, this facility is not consistent with FWCC Section 22-967(2), "-`Development Standards," which stipulates what types of PWSFs are permitted inside the public right-of-way. To comply, the antennae must meet the definition of a microcell, or the equipment enclosure must be no taller than six feet, or the equipment enclosure must be located in an enclosed building, or the equipment enclosure must be located underground. Security Fence — Pursuant to FWCC Section 22-967, "Development Standards," security fencing for PWSFs must be six feet or less in height and must be screened. As proposed, with a wood fence and Type III screening, this project appears to meet this standard. G. Landscape Screening — In order to minimize visibility of PWSF facilities such as equipment cabinets enclosures, they must be screened, at a minimum, with type III landscaping, as stipulated in FWCC Sections 22-1649(3) and 22-1565(2)(c). Additional screening may be required if necessary to minimize visibility of PWSF elements, such as pole -mounted equipment, to the greatest extent possible, as stipulated in FWCC Sections 22-967(4) and (5). Landscape Plans — You must submit a landscape plan prepared by a Washington State licensed landscape architect and showing how you propose to meet landscaping and screening requirements.
