After evaluating your request, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.070), and direction provided by the Public Works Director, each of your specific requests to modify the roadway sections for this project are addressed below, with the City's response following each: Requesting waiver of the required street improvements associated with SW 356`h Street, and agreeing to dedicate right -of --way along SW 356' Street, along the project frontage - The City hereby waives the construction of required street improvements, but requires the additional it -feet of right-of-way for future road construction be dedicated to the City prior to Building permit issuance. Requesting waiver of improvements on 1st Ave S, along the project frontage - The City hereby denies the waiver of street improvements along the 1st Ave S frontage. Street improvements shall be constructed along this frontage, extending from SW 356`h Street to south of the new entrance road into the project (currently shown at approximate STA 104+20). 1st Avenue South corresponds to City Street Section V. This roadway section (1/2-street) requires 17-feet of paved roadway (centerline to face of curb, vertical curb and gutter, a 6-foot planter strip with street trees and street lights, and an 8-foot sidewalk, all within a 34-foot right of way. However, the existing roadway section (1/2 street) is constructed with 28-feet of paved roadway and a 5-foot sidewalk within a 42-foot right of way. This roadway section extends southerly along the 1st Ave S frontage for approximately 180-feet from SW 356th St then tapers to approximately 16-feet of roadway with a 6-foot paved walkway within a 3-foot right of way. The City hereby modifies the required improvements along 15t Ave S as follows: Maintain the existing 28-foot roadway and extend these improvements (curb and gutter and pavement width) to the south side of the new entrance road. Install channelization and I:\csdc\docs\save\2328181 5046.doc Abbey Road Group Permit 909-103212-00-SM August 31, 2009 Page 2 of 3 pavement markings to indicate a right turn only lane into the project site. Replace the existing access ramp (approximate STA 101+60) with a ramp that meets current City Standards. From the south edge of the new ramp, remove the existing 5-foot sidewalk and install the 6-foot planter strip (with street trees and street lights) behind the curb, and construct an 8-foot sidewalk behind the planter strip. Transition the new sidewalk as necessary to connect to the existing sidewalk at SW 356th. Provide a 3-foot wide utility easement on the church property along that section of 42-foot wide right of way. From the south side of the new church driveway, construct tapers and transitions to the existing edge of roadway/paved walkway. If the project's Trip Generation Analysis indicates that a north -bound left -turn lane is warranted, then additional pavement widening and channelization may be required on 1st Ave S, south of the proposed driveway. Ave SW — In addition to the above requirements, 2nd Avenue SW shall be constructed with t/?- street improvements, extending from SW 356th St to just south of the southerly access drive into the church property (approximately 330-feet in length). 2"d Ave SW corresponds to City street section 'W', with 28-feet of pavement, 4-foot planter strip with street trees, 5-foot sidewalk, and 3-foot utility strip with street lights, within a 52-foot right of way. Depending on timing of construction of this project relative to construction of improvements for the adjacent Retreat Meadows subdivision, whichever project goes to construction first, the minimum `t/2-street' pavement width shall be 20-feet. The conditions of this Right -of -Way Modification will be applicable for a period of one year from the date of this letter. If a permit for this project is not issued within the one-year time limit, this waiver will be void and a new request for modification must be submitted. We would like to request that the frontage improvements required for SW 356th Street and 1st Avenue South be waived. The property owner has met the City's request of dedicating 12' of right-of-way along the property frontage for both of these streets. Please review the following justification: 1. The improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or City as a whole. RESPONSE: SW 35e Street: Currently the required frontage improvements would not be harmonious with Add existing street improvements or what has previously been indicated as acceptable by the City. �\O The project will be required to construct some improvements for the entrances, utilities and handicap access to and around the proposed project to ensure project functionality and safety. Because SW 356t" Street is a main thoroughfare through Federal Way, expanding the existing roadway section in front of this property alone will create a roadway that is disjointed for the rt` vehicles traveling along it as well as an unsafe condition for pedestrians and vehicles entering .A and exiting the site. 1st Avenue South: Currently the required frontage improvements would not be harmonious with existing street improvements or what has previously been indicated as acceptable by the City. The project will be required to construct some improvements for the entrances, utilities and handicap access to and around the proposed project to ensure project functionality and safety. However, if full improvements were constructed at this time on 1st Avenue South, then the Nhorizontal alignment would not match existing conditions and will create a road section that does le not function properly and is not safe for pedestrians and vehicles entering and exiting the site. Unusual topographic or physical conditions preclude the construction of improvements as required. RESPONSE: SW 356tn Street: SW 356th Street is a main thoroughfare through Federal Way and therefore the roadway warrants additional safety measures beyond lower classified roadways in the City. Improvements currently required on SW 356th Street would not allow construction of adequate transitions from the existing roadway section to the new frontage improvements leaving pedestrians and vehicles with an unsafe ingress and egress from the site. This is especially true at the intersection of SW 356th Street and 2nd Avenue South where the south intersection corners would be at different offsets from the right-of-way centerline. The appropriate land has been dedicated (for the subject property) for right-of-way purposes so that SW 356'h Street can be properly reconstructed without transition in the future. 15' Avenue South: There are existing physical conditions that preclude the construction of the required improvements adjacent to the site along 1st Avenue South. The primary issues are the existing topography_ and utility pole relocation that make for significant improvement. These -issues occur along the undeveloped portion of the site and -!nay result in the need for retaining walls and safety fencing that is unwarranted fora dead end road-) The appropriate land has been dedicated (for the subject property) for right-of-way purposes to ensure that adequate area is available for future improvements. 3. Proper vertical or horizontal alignments cannot be determined because the existing streets do not have correct alignments. RESPONSE: SW 356th Street: Due to the unimproved right-of-way surrounding the property, SW 356th Street would not have correct alignments if frontage improvements were completed at this time for the subject property. Currently there is existing sidewalk on both sides of this street, however if the right-of-way were expanded, then the horizontal alignment would not match. If full improvements were required at this time, it would not be harmonious with existing street improvements. Adequate right-of-way has been dedicated for future improvements. 1st Avenue South: The subject project is the only property that=has=�.ece tEy been requested to increase the existing right-of-way. Improvements along�,a dead end streef-'at this time would create a confusing scenario where the existing centerline wouTd-noriffi-achthe new right-of-way centerline. 1st Avenue South is also more difficult to develop since the future access points to the adjacent undeveloped property are undetermined at this time, in which improvements would have to be removed and replaced if Lifeway Church were required to install full improvements at this time. It would be disadvantageous to construct the roadway improvements along the south undeveloped portion of the property at this time because the potential future development will more than likely require modifications to the roadway and utilities that are not yet known. 4. The required improvement is part of a larger project that has been scheduled for construction in the City's adopted six -year transportation improvement program. RESPONSE: SW 35e Street: Required frontage improvements for SW 356th Street are part of the City's adopted six -year TIP for SW 356"' Street. In accordance with the TIP, the required dedication of 12'. has been provided for future improvements. 9" Avenue South: Required frontage improvements for 1st Avenue South are not part of the City's adopted six -year TIP, however due to existing conditions, we feel that the required dedication of 12' for future improvements is adequate at this time since this is a dead end street with limited potential for future development. � If full improvements arC regquired at this time, Lifeway Church would be constructing improvements4iext-ta-6m'devetoped property, which will eventually be developed, but at this time the access points are unknown. Because of this, we feel that requiring the owner to construct full imMvements. is_.unfair due--to-t a fact that some of the improvements would need to be removed and reconstructed at the time the undeveloped property proceeds with development. Also, if improvements are required, then the sidewalk would not be contiguous because the existing center of the road is not the center of the right-of-way, therefore we feel this is unsafe for pedestrians and vehicles entering and exiting the site.
